23.49 – POSSESSION OF EXOTIC OR WILD ANIMALS.

  1. Definitions.
    Circus” means a scheduled event staged by a traveling company with mobile facilities in which entertainment consisting of a variety of performances by acrobats, clowns or trained animals is the primary attraction or principle business.
    Exotic Animal” means any animal that is not normally domesticated in the United States or is wild by nature.
    Person” means an individual, partnership, firm, joint stock company, corporation, association, trust, estate, or other legal entity.
    Possess” means to own, control, restrain, transport, or keep.
    Public zoo or aquarium” means a zoo or aquarium that is operated by the state or city or that is an accredited member of the American Zoo and Aquarium Association.
    Veterinarian” means a person who is licensed in this state to practice veterinary medicine under Wis. Stats. Chap. 453 and who is certified under rules promulgated by the department of agriculture, trade and consumer protection.
    Wild Animal” means any of the following animals, whether bred in the wild or in captivity, and also any of their hybrids with domestic species. The animals listed in parentheses are intended to act as examples and are not to be construed as an exhaustive list or limit the generality of each group of animals, unless otherwise specified.
    1. Nonhuman primates and prosimians (chimpanzees, monkeys);
    2. Felids, except domesticated cats;
    3. Canids (wolf, coyotes, foxes) except domesticated dogs;
    4. Prairie dogs; (Am. by Ord. 13,380, 8-2-03)
    5. Elephants;
    6. Crocodilians (alligators, crocodiles);
    7. Marsupials (kangaroos, opossums) except sugar gliders; (Am. by ORD-13-00012, 1-30-13)

    10. Mustelids (skunks, otters, badgers) except ferrets;

  2. Intent and Purpose . The Common Council of the City of Madison hereby finds that wild animals are inherently dangerous and do not adjust well to captive environment. It is the intent of the Common Council to protect the public against health and safety risks that wild animals pose and hereby prohibit the possession of wild animals within the City of Madison.
  3. It shall be unlawful for any person to possess, sell or purchase an exotic or wild animal.
  4. Exceptions . The following persons or entities may possess exotic or wild animals:
    1. A person licensed by the State under Wis. Stats. Chap. 169.
    2. A veterinarian, for the purpose of providing medical treatment to wild animals.
    3. A public zoo or aquarium.
    4. A circus.
    5. A person authorized by the Department of Natural Resources.
  5. Penalties . Any person convicted of a violation of this section shall be subject to a forfeiture of not more than five hundred dollars ($500).

City of Monona

§ 159-6 Restrictions on keeping of dogs, cats, fowl and other animals.

  1. Restrictions. It shall be unlawful for any person within the City of Monona to own, harbor or keep any dog, cat or other animal in a domesticated environment, which:
    1. Habitually pursues any vehicle upon any public street, alley or highway in the City.
    2. Assaults or attacks any person as described in Subsection C, or destroys property.
    3. Is at large within the limits of the City.
    4. Habitually barks, crows, cries, screeches, howls or makes any other loud or discordant sound which greatly disturbs the peace and quiet of a neighborhood or any two or more persons within the City.
    5. Kills, wounds or worries any domestic animal.
    6. Is known by such person to be infected with rabies or to have been bitten by an animal known to have been infected with rabies.
    7. In the case of a dog or cat, is unlicensed.
  2. Confinement of offending or running animals. The Police Department or any officer of any agency appointed by the Common Council may apprehend any dog or other animal found running at large within the City, or which does any of the things prohibited under Subsection A, and confine the same in a suitable place.
  3. Vicious dogs and animals.
    1. No vicious dog shall be allowed off the premises of its owner unless muzzled or on a leash in charge of the owner or a member of the owner’s immediate family over 16 years of age. For purposes of enforcing this section, a dog shall be deemed as being of a vicious disposition if, within any twelve-month period, it bites two or more persons or inflicts serious injury to one person in unprovoked circumstances off the owner’s premises.
    2. No person shall harbor or permit to remain on his or her premises any animal that is habitually inclined toward attacking persons or animals, destroying property, barking excessively or making excessive noises or running after automobiles.

City of Stoughton

Sec. 6-2. – Keeping of animals, birds and honey bees.

  1. No person shall keep any hoofed animal or bees within the city, except as permitted in subsections (b), (c), and (d) below. In no event shall poisonous snakes or those snakes having a normal adult size that exceed four feet in length or members of the genus Canis or genus Felis other than common dogs and cats be permitted to be kept as pets in the city.
  2. A maximum of three rabbits may be kept out of doors as pets, but not bred for meat or sale. Dogs may be kept out of doors in appropriate enclosures with proper shelter. Small animals, reptiles, birds and fish that are housed within a residence shall be permitted. Small animals include, but are not limited to, dogs, tropical fish, parrots, parakeets, cockatiels, canaries, cockatoos, finches, love birds, house cats, guinea pigs, gerbils, hamsters, fancy mice and rats, reptiles and turtles. Horses are conditionally allowed within the rural holding and exurban residential districts.
  3. Any person keeping chickens in the city shall register such activity with the city clerk. All registrations expire December 31, and must be renewed by March 31 of the following year.
  4. Any person keeping honey bees in the city shall register such activity with the city clerk. All registrations expire December 31, and must be renewed by March 31 of the following year.
  5. Animals or birds not listed in this section shall be prohibited unless similar to those listed in subsections (b), (c), and (d) above.

  1. Protected Animals.
    1. Possession and Sale of Protected Animals. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian, or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
    3. Regulating the Importation of Certain Birds. No person, firm or corporation shall import or cause to be imported into this city any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body, or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
  2. Exceptions. The provisions of subsection A of this section above shall not be deemed to prevent the importation, possession, purchase, or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
  3. Wild Animals—Prohibition on Keeping. It is unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the city any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the city any of the following animals, reptiles or insects:
    1. All poisonous animals and reptiles including rear-fang snakes;
    2. Apes, chimpanzees (Pan), gibbons (Hylobates), gorillas (Gorilla), orangutans (Pongo), and siamangs (Symphalangus);
    3. Baboons (Papoi, Mandrillus);
    4. Bears (Ursidae);
    5. Bison (Bison);
    6. Cheetahs (Acinonyx jubatus);
    7. Crocodilians (Crocodilia), thirty (30) inches in length or more;
    8. Constrictor snakes, six feet in length or more;
    9. Coyotes (Canis latrans);
    10. Deer (Cervidae); includes all members of the deer family, for example, white-tailed deer, elk, antelope and moose;
    11. Elephants (Elephas and Loxodonta);
    12. Game cocks and other fighting birds;
    13. Hippopotami (Hippopotamidae);

The prohibitions of subsection C of this section shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
    1. Their location conforms to the provisions of the zoning ordinance of the city;
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors;
    3. Animals are maintained in quarters so constructed as to prevent their escape;
    4. No person lives or resides within one hundred (100) feet of the quarters in which the animals are kept.

  3. Farm animals. Except on lands zoned R-D Rural Development District, no person shall harbor, raise or keep in any zoning district any poultry, pigeons, or fowl, or any animal raised for fur-bearing purposes, or any livestock, including but not limited to cattle, horses, sheep, goats, pigs or swine, whether or not such animal is domesticated, tamed or a pet.

Village of Blue Mounds

§ 95-3 Wild animals.

No person shall keep or permit to be kept on his/her premises any wild or vicious animal or poisonous snake or reptile or display for exhibition purposes unless the same is securely enclosed in a manner to prevent its escape and to keep it from doing injury to any person. The Enforcement Officer shall, upon complaint or on his own initiative, inspect premises on which wild animals are kept to determine if the owner has violated the terms of this section.

  3. Wild Animals—Prohibition on Keeping. It is unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the village any exotic animal, poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities.
  4. Exceptions—Pet Shops. The prohibitions of subsection C of this section shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
    1. Their location conforms to the provisions of the zoning ordinance of the village;
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors;
    3. Animals are maintained in quarters so constructed as to prevent their escape;
    4. No person lives or resides within one hundred (100) feet of the quarters in which the animals are kept.
  5. Farm Animals—Miniature Pigs. Except on properties zoned in an agricultural classification, no person shall own, keep, harbor or board any cattle, horses, ponies, swine, goats, sheep, fowl (more than two) or rabbits (more than two). For purposes of this subsection, the term “swine” shall not include any miniature pigs of either sex weighing less than eighty (80) pounds which are intended for and kept as domestic pets.

SECTION 21.12 Possession of Exotic or Wild Animals.

  1. Definitions. As used in this section, the following terms shall have the meanings indicated:
    1. Circus. A scheduled event staged by a traveling company with mobile facilities in which entertainment consisting of a variety of performances by acrobats, clowns or trained animals is the primary attraction or principal business.
    2. Exotic Animal. Any snake or animal that is not normally domesticated in the United States or is wild by nature.
    3. Person. An individual, partnership, firm, joint-stock company, corporation, association, trust, estate, or other legal entity.
    4. Possess. To own, control, restrain, transport, or keep.
    5. Public Zoo or Aquarium. A zoo or aquarium that is operated by the state or Village or that is an accredited member of the American Zoo and Aquarium Association.
    6. Veterinarian. A person who is licensed in this state to practice veterinary medicine under Ch. 453, Wis. Stats., and who is certified under rules promulgated by the Department of Agriculture, Trade and Consumer Protection.
    7. Wild Animal. Any of the following animals, whether bred in the wild or in captivity, and also any of their hybrids with domestic species. The animals listed in parentheses are intended to act as examples and are not to be construed as an exhaustive list or to limit the generality of each group of animals, unless otherwise specified.
      1. Nonhuman primates and prosimians (chimpanzees, monkeys).
      2. Felids, except domesticated cats.
      3. Canids (wolf, coyotes, foxes), except domesticated dogs.
      4. Prairie dogs.
      5. Elephants.
      6. Crocodilians (alligators, crocodiles).
      7. Marsupials (kangaroos, opossums).
      8. Ungulates (hippopotamus, rhinoceros).
      9. Hyenas.
      10. Mustelids (skunks, otters, badgers), except ferrets.
      11. Procyonidae (raccoons, coatis).
      12. Dasypodidae (anteaters, sloth, armadillos).
      13. Viverridae (mongooses, civets, genets).
      14. Reptilia over 10 feet in length (boa constrictors, pythons).

  2. Intent and Purpose. The Village Board of the Village of Cross Plains hereby finds that wild or exotic animals are inherently dangerous and do not adjust well to a captive environment. It is the intent of the Village Board to protect the public against health and safety risks that wild animals pose and hereby prohibit the possession of wild or exotic animals within the Village of Cross Plains.
  3. Possession Prohibited. It shall be unlawful for any person to possess, sell or purchase an exotic or wild animal.
  4. Exceptions. The following persons or entities may possess exotic or wild animals:
    1. A person licensed by the state under Ch. 169, Wis. Stats.
    2. A veterinarian, for the purpose of providing medical treatment to wild animals.
    3. A public zoo or aquarium.
    4. A circus.
    5. A person authorized by the Department of Natural Resources.

  1. Protected animals.

It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
    3. Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into this Village any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
  2. Exceptions. The provisions of Subsection A above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collectors permit issued by the Secretary of the Department of Natural Resources of the state or to any person or organization licensed to present a circus.
  3. Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any of the following animals, reptiles or insects:

  1. Protected Animals. The provisions of §29.604, Wis. Stats. are hereby adopted and incorporated herein by reference.
  2. Dangerous, Poisonous or Wild Animals: Prohibition on Keeping. It shall be unlawful for any person to keep, maintain or have in her/his possession or under her/his control within the Village of DeForest any dangerous, poisonous or wild animal, including, but not limited to, the following animals:
    1. All poisonous animals including rear-fang snakes, and all poisonous insects or arachnids.
    2. Large Reptiles, including all alligators, crocodiles, constrictor snakes over 6 feet in length, Komodo Dragons.
    3. Other large animals, including all apes, bears, bison, elephants, rhinoceroses, hippopotami.
    4. Large Cats, including all cheetahs, jaguars, leopards, pumas (including mountain cats, panthers and bobcats), lynxes, lions and tigers.
    5. All Coyotes, hyenas, foxes, wolves, and all wolf-hybrids.
    6. Bats, raccoons and skunks.
    7. All Deer, including all members of the deer family, such as elk, antelope and moose.
    8. Prairie dogs and Gambian rats.
    9. All cats and dogs which have not been issued a certificate of vaccination against rabies; not including dogs and cats meeting the exception described under 9.07(3)(a)(1), supra.
    10. All sharks, eels, rays, piranhas, barracudas, sea bass, rabbitfish, scorpion fish, zebra fish, siganus fish, stonefish, tang fish, surgeonfish, toadfish, weever fish, Portuguese man-of-war, octopi, cone shells, terebra shells, and all fish with toxic flesh, including puffer and trigger fish.
    11. All monkeys. This prohibition does not include any service animal, including helper monkeys.
  3. Other Animals Prohibited. It shall be unlawful for any person to keep maintain or have in her/his possession or under her/his control within the Village of DeForest any of the following animals:
    1. Except in an A-1 Agricultural District and an A-B Agricultural Business District, bees, cattle, sheep, goats, roosters, other fowl (except chicken hens), ponies, horses, pigs, llamas, oxen, donkeys, mules or any other livestock or experimental animals, or any animals of a species under the jurisdiction of the Wisconsin Department of Natural Resources and/or the U.S. Fish and Wildlife Service;
    2. Animals raised for fur-bearing purposes;
  4. Diseased Animals Prohibited. It shall be unlawful for any person to keep, maintain or have in her/his possession or under her/his control within the Village of DeForest any animal carrying an infectious disease. The provisions of this paragraph do not apply where the diseased animal is in the custody of a licensed veterinarian for purposes of treating the disease, or where the owner or keeper of the diseased animal is keeping the animal in accordance with all prescribed instructions from a veterinarian who is treating the animal for the disease.
  5. Exceptions. The provisions of pars. (a) through (c) of this subsection do not apply where the animal is in the custody of a veterinarian for treatment or where the animal is in the custody of a public or private educational institution.
  6. Finding of Public Nuisance. The keeping of any dangerous, prohibited or diseased animal in violation of the provisions of this subsection is declared to be a public nuisance.

    1. Definitions. As used in this Subsection:
      1. Livestock” means any wild or domestic animal normally used or raised on a farm including specifically, but not exclusively, horses, cattle, mules, sheep, goats, swine, chickens, ducks, turkeys, mink, pigeons, but does not include cats or dogs, or small animals kept exclusively in the home.
      2. Non-agricultural area” means any area not zoned AG District.
    2. License Required. No person shall keep or allow the keeping, or lease property for the keeping, of livestock within the Village in any non-agricultural area without a license therefore issued pursuant to this Subsection.
    3. Eligibility. No person shall be granted a license under this Subsection unless they were a resident of the Village on November 24, 1981, and as of that date owned and kept within the Village one (1) or more animals not exempt under this Subsection.
      1. Exception: The keeping of livestock will be allowed on public school grounds when they are in the care, control or custody of public school staff.
    4. Application and Issuance. All applications for a livestock license shall be in writing, signed by the applicant, and submitted to the Village Clerk-Treasurer on or before March 1, 1982. A Five Dollar ($5.00) fee must accompany each application. The application shall specifically identify each animal owned and kept within the Village on November 24, 1981. The application shall specify the area where the animal or animals are kept, the type of confinement or shelter to be used, and the name of the person responsible for the animals’ care and feeding. Licenses shall be issued by the Clerk-Treasurer upon verification of the accuracy of the application.
    5. Non-transferability and Expiration. Licenses issued pursuant to this Subsection shall be non-transferable from the original applicant to another person, nor can the license holder transfer the location of the animal or animals to another prohibited area within the Village. Animals can be substituted for those, for which the license was originally issued, but they must be the same type of animal, and the total number of animals cannot exceed the number of animals listed on the original application for license. Licenses shall be automatically renewed by the Clerk-Treasurer and shall expire upon the occurrence of any of the following:
      1. The death or relocation of the applicant.
      2. The transfer of ownership of the property.
    6. Penalty. In addition to license suspension or revocation, and the penalties provided for in Section 1-1-7, the Village Board may, after written notice to the owner and a hearing, order the Village police to confiscate and impound any animals kept contrary to the provisions of this Subsection.

    3. Animals are maintained in quarters so constructed as to prevent their escape.
    4. No person lives or resides within 100 feet of the quarters in which the animals are kept.
  5. Farm animals. Cows, horses, pigs, sheep, poultry, with the exception of hen chickens, as outlined in §158-14F, and other farm animals shall not be kept within the Village limits unless kept in a properly zoned agricultural district under the Zoning Code.
  6. Possession of hen chickens. The raising of hen chickens shall be considered an accessory use in all single-family residential zoning districts, and shall meet the following requirements.
    1. A total of four hen chickens or hens shall be allowed per single-family dwelling. Roosters shall not be allowed.
    2. No slaughtering shall be allowed.
    3. Hen chickens shall be kept within a secure enclosure.
    4. All hen chickens shall be kept in an enclosed space. Enclosures shall be located no closer than 25 feet to neighboring dwellings and a minimum of five feet from the property line.

  1. Specifically, it shall be unlawful for any person to keep, maintain or have in their possession or under their control within the Village any of the following animals, reptiles or insects:
    1. All poisonous animals and reptiles including rear-fang snakes.
    2. Apes: Chimpanzees (Pan); Gibbons (Hylobates); Gorillas (Gorilla); Orangutans (Pongo); Ans Siamangs (Symphalangus).

    6. Crocodilians (Crocodilia), thirty (30) inches in length or more.
    7. Constrictor snakes

    1. Their location conforms to the provisions of the Zoning Code of the Village.
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
    3. Animals are maintained in quarters so constructed as to prevent their escape.

4.15 PROHIBITED AND PROTECTED ANIMALS, FOWL, REPTILES AND INSECTS FARM ANIMALS.

  1. Protected Animals.
    1. Possession and Sale of Protected Animals. It is unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the Village, any exotic animals, alive or dead, or any part or product thereof.
    2. Compliance With Federal Regulations. It is unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969.
    3. Regulating the Importation of Certain Birds. No person firm or corporation shall import or cause to be imported into the Village any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation of use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
  2. Exceptions. The provisions of subsection A of this section shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
  3. Wild Animals Prohibition on Keeping. It is unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the Village any exotic animal, poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities.
  4. Pet Shops. The prohibitions of subsection C of this section shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
    1. Their location conforms to the provisions of the zoning ordinance of the Village;
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors;
    3. Animals are maintained in quarters so constructed as to prevent their escape;
    4. No person lives or resides within one hundred (100) feet of the quarters in which the animals are kept.
  5. No person shall own, keep, harbor or board any cattle, horses, ponies, swine, goats, sheep, fowl within the Village boundaries. Permission for the keeping of hens may be granted by the Village Board.

This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
  2. Exceptions to subsection (a). Subsection (a) of this section shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collector’s permit issued by the secretary of the department of natural resources of the state or to any person or organization licensed to represent a circus.
  3. Keeping wild animals. Not withstanding subsection (a) of this section, it shall be unlawful for any person to keep, maintain or have in such person’s possession or under such person’s control within the village any poisonous reptile; any other dangerous or carnivorous wild animal, insect or reptile; any vicious or dangerous domesticated animal; or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in such person’s possession or under such person’s control within the village any of the following animals, reptiles or insects:
    1. All poisonous animals and reptiles including rear-fang snakes.
    2. Apes:

Exceptions to subsection (c). The prohibitions of subsection (c) of this section shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
    1. Their location conforms to chapter 133 pertaining to zoning.
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
    3. Animals are maintained in quarters so constructed as to prevent their escape.
    4. No person lives or resides within 100 feet of the quarters in which the animals are kept.

It shall be unlawful for any person to possess, buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian, or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the Federal secretary of the interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1973, 16 USC § 1531 et seq., as may be subsequently amended.
  3. No person, firm, or corporation shall import or cause to be imported into the Village any part of the plumage, skin or dead body of any species of hawk, owl, or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body, or any part thereof legally collected for use by Native Americans for ceremonial purposes or in the preservation of their tribal customs and heritage in accordance with applicable state or federal law.
  4. The provisions of this section shall not be deemed to prevent the importation, possession, purchase, or sale of any species by any public agency, school, persons holding Federal permits, or by a person holding a scientific collector’s permit issued by the Secretary of the Wisconsin Department of Natural Resources, or to any person or organization licensed to present a circus.

CHAPTER 11 – DANGEROUS OR EXOTIC ANIMALS

11.1 – DEFINITIONS.

Unless specifically defined below, words or phrases used in this Section shall be interpreted as having the same meaning as they have in common law, the Wisconsin Statutes or Wisconsin Administrative Code, to give this ordinance it’s most reasonable application. Words used in the present tense include the future, and vice-versa. Words used in the singular include the plural, and vice-versa. The word “shall” is always mandatory; the word “may” is always permissive.

  1. Animal. Any member of the animal kingdom except human beings.
  2. Board. The Town of Black Earth Board.
  3. Dangerous or Exotic Animal.
    1. any genus/species of animal which is capable of killing, inflicting serious injury upon, or causing illness or disease among, human beings or domestic animals and having a known tendency, (either in its natural state, in the wild, or as a tame, feral or domesticated animal) as a species to do so, and is declared to be a dangerous animal by the Board;
    2. those animals deemed to be “dangerous animals” include the following, subject to amendment by the Board:
      1. Canidae: e.g. wolves, wolf-dog hybrids, coyotes, coyote-dog hybrids, foxes, jackals, within the order Carnivora but excluding Canis familiaris, the domestic dog.
      2. Felidae; e.g. lions, tigers, jaguars, leopards, cougars, lynx, ocelots, bobcats, within the order Carnivora but excluding Felis domestica, the domestic cat.
      3. Mustelidae; e.g. badgers, wolverines, weasels, skunks, mink, otters within the order Carnivora, but not including domestic ferrets.
      4. Procyonidae; e.g. raccoons, pandas, kinkajous within the order Carnivora.
      5. Ursidae; e.g. black bears, brown bears, grizzly bears, polar bears, of the order Carnivora.
      6. Cebidae; e.g. monkeys.
      7. Cercopithecidae; e.g. baboons.
      8. Callithricidae; e.g. marmosets, tamarins.
      9. Pongidae; e.g. gibbons, orangutans, chimpanzees, gorillas.
      10. Lemuridae; e.g. lemurs.

  4. Keeping. The act of confining, harboring, maintaining, owning or sheltering an animal.
  5. Owner. Any person keeping an animal.
  6. Person. Any agency, association, business, club, company, corporation, firm, individual, institution, organization, partnership, syndicate, trust, trustee, or any federal, state or local governmental agency or instrumentality of other entity recognized by the law as the subject of rights and duties. The feminine, masculine, singular or plural is included in any circumstance.
  7. Uncontrolled Dangerous Animal. A dangerous animal on or off the premises of the owner and not under the control of the owner or persons acting for the owner or not confined in a secure enclosure.
  8. Vicious Animal. An animal that has attack and/or bitten a person without provocation.
    1. Dogs used in security or police work shall not be classified as vicious dogs if a bite or bites occur while the dog is actually performing in such a capacity.
    2. Dogs shall not be classified as vicious dogs if a bite or bites are inflicted upon a person who is, at the time of the bite or bites, engaged in a criminal act against the person or property of another.
    3. Animals used in agriculture as defined by the United States Department of Agriculture shall not be considered dangerous animals.
  9. Designated Pound. The Town of Black Earth hereby designates the Dane County Humane Society, a non-profit organization located at Voges Rd., Madison, Wisconsin, the official pound for dogs and other animals detained.
11.2 – DANGEROUS OR EXOTIC ANIMALS PROHIBITED.

No person shall keep a dangerous or exotic animal in the Town of Black Earth except by permit as hereafter provided.

11.3 – DANGEROUS OR EXOTIC ANIMALS ALLOWED.

The prohibition contained in Section 2 of this Ordinance shall not apply to the keeping of dangerous animals in the Town of Black Earth under any of the following circumstances:

  1. Dangerous or exotic animals kept at state licensed veterinary hospitals, humane societies, licensed rehabilitator or animal control pounds for treatment or impoundment.
  2. Dangerous or exotic animals kept by federal, state, county and municipal authorities and their designees or veterinarians pursuant to the enforcement of this or any animal control ordinance.
  3. Dangerous or exotic animals kept by governmental agencies, educational institutions, medical institutions or research laboratories for instructional or research purposes.
  4. Dangerous or exotic animals kept in publicly owned zoos.
  5. Dangerous or exotic animals kept for fur pelting businesses on properly zoned land.
  6. Dangerous or exotic animals kept by individuals meeting USDA permit requirements and the permit requirements contained herein.
  7. Dangerous or exotic animals commercially exhibited for ten (10) days or less.
  8. Animals being commercially transported through the Town of Black Earth.
11.4 – KEEPING OF LARGE NON-VENOMOUS REPTILES.
  1. No person shall be permitted to keep a species of constricting snake as specified in Section 2.1(3)(b) unless the person can show two (2) years experience in the secure and humane keeping of snakes.
  2. Snakes as specified in Section 2.1(3)(b) shall be kept in locked cages in locked rooms.
  3. Cages shall be so constructed as to not break or give way as a result of a reasonably foreseeable accident or misuse.
  4. No person shall be permitted to keep a reticulated python, African rock python or an anaconda.
11.5 – SEIZURE, IMPOUNDMENT AND DISPOSITION OF DANGEROUS OR EXOTIC ANIMALS
  1. The Town may cause to be seized and removed any dangerous or exotic animal kept without a permit or any permitted dangerous or exotic animal that is not kept confined under USDA standards. Any dangerous or exotic animal seized may be euthanized by the designated pound or other facility to which the seized animal is removed.
  2. The owner of a seized animal may be assessed for any cost incurred for capturing, maintenance of, or euthanizing the animal.
  3. A dangerous or exotic animal that kills or causes serious injury to a human being shall be immediately surrendered as directed by the Board.
11.6 – LIABILITY.

Nothing in this ordinance absolves the owner of an animal that inflicts injury on a person or property from financial responsibility for the animal’s actions.

  3. Wild Animals; Prohibition on Keeping. Unless prior approval is received from the Town Board, it shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the Town any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful without Town Board approval for any person to keep, maintain or have in his or her possession or under his or her control within the Town any of the animals, reptiles or insects identified on the list of prohibited wild animals, insects or reptiles approved from time to time by the Town Board by resolution and maintained in the Town Office and which is incorporated herein by reference as if fully set forth herein.
  4. Exceptions; Pet Shops. The prohibitions of Subsection (3) above shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; accredited public or private educational institutions; licensed pet shops; zoological gardens; if:
    1. Their location conforms to the provisions of the zoning ordinance of the Town.
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
    3. Animals are maintained in quarters so constructed as to prevent their escape.
    4. No person lives or resides within 100 feet of the quarters in which the animals are kept.

7-1-6(g) Prohibited and Protected Animals

  1. Protected Animals. The provisions of section 29.604, Wis. Stats., are hereby adopted and incorporated herein by reference. Dangerous, Poisonous or Wild Animals: Prohibition on Keeping. It shall be unlawful for any person to keep, maintain or have in her/his possession or under her/his control within the Town of Westport any dangerous, poisonous or wild animal, including, but not limited to:
    1. All poisonous animals including rear-fang snakes, and all poisonous insects or arachnids.
    2. Large Reptiles, including all alligators, crocodiles, constrictor snakes over 6 feet in length, Komodo Dragons.
    3. Other large animals, including all apes, bears, elephants, rhinoceroses, hippopotami.
    4. Large Cats, including all cheetahs, jaguars, leopards, pumas (including mountain cats, panthers and bobcats), lynxes, lions and tigers.
    5. All Coyotes, hyenas, foxes, wolves, and all wolf-hybrids including wolf-dog hybrids.
    6. Bats, raccoons and skunks.
    7. All deer, including all members of the deer family, such as elk, antelope and moose.
    8. Prairie dogs and Gambian rats.
    9. All cats and dogs which have not been issued a certificate of vaccination against rabies; not including dogs and cats meeting any specific exception in this Code.
    10. All sharks, eels, rays, piranhas, barracudas, sea bass, rabbitfish, scorpion fish, zebra fish, siganus fish, stonefish, tang fish, surgeonfish, toadfish, weever fish, Portugese man-of-war, octopi, cone shells, terebra shells, and all fish with toxic flesh, including puffer fish.
    11. All monkeys. This prohibition does not include any service animal, including monkeys.
  2. Diseased Animals Prohibited. It shall be unlawful for any person to keep, maintain or have in her/his possession or under her/his control within the Town any animal carrying an infectious disease. The provisions of this paragraph do not apply where the diseased animal is in custody of a licensed veterinarian for purpose of treating the disease, or where the owner or keeper of the diseased animal is keeping the animal in accordance with all prescribed instructions from a veterinarian who is treating the animal for the disease.
  3. Exceptions. The provisions herein do not apply where the animal is in the custody of a veterinarian for treatment or where the animal is in the custody of a public or private educational institution.
  4. Finding of Public Nuisance. The keeping of any dangerous, prohibited or diseased animal in violation of the provisions of this subsection is declared to be a public nuisance.
