City of Beaver Dam
Sec. 10-4. – Certain creatures forbidden.
No person shall purchase, bring into, possess, maintain, or sell in the city any wasps, hornets, poisonous snakes, horses, mules, ponies, donkeys, cows, pigs, goats, sheep, chickens, ducks, geese or any animal being raised for furbearing purposes or other wild animals (defined below) unless otherwise permitted in this Code. The prohibitions in this section do not apply where the above-named creatures, other than wild animals which are defined below, are in the care, custody or control of a veterinarian for treatment; agricultural fairs, parades, shows or projects of the 4-H Clubs, not including the raising of such animal; a display for judging purposes; an itinerant or transient carnival, circus or other like show; dog or cat shows or trials; public or private educational institutions, and service animals as defined below.
- Definitions.
- Disability means a physical or mental impairment that substantially limits one or more major life activities, a record of having such an impairment or being regarded as having such an impairment. “Disability” does not include the current illegal use of a controlled substance, as defined in Wis. Stats. § 961.01(4), or a controlled substance analog, as defined in Wis. Stats. § 961.01(4m), unless the individual is participating in a supervised drug rehabilitation program.
- Itinerant, transient carnival, circus or other like show means a scheduled event staged by a traveling company with mobile facilities in which entertainment consisting of a variety of performances by acrobats, clowns or trained animals is the primary attraction or principle business.
- Person means an individual, partnership, firm, joint stock company, corporation, association, trust, estate, or other legal entity.
- Possess means to own, control, restrain, transport, or keep.
- Public zoo or aquarium means a zoo or aquarium that is operated by the state or city or that is an accredited member of the American Zoo and Aquarium Association.
- Service animals means a guide dog, signal dog, or a pony that is individually trained or is being trained to do work or perform tasks for the benefit of a person with a disability, including the work or task of guiding a person with impaired vision, alerting a person with impaired hearing to intruders or sound, providing minimal protection or rescue work, pulling a wheelchair, or fetching dropped items. Under the Americans with Disabilities Act (ADA) only two animals are service animals, a dog or a pony. The State Statutes also defines service animals as a dog or a pony and are adopted by this section.
- Veterinarian means a person who is licensed in this state to practice veterinary medicine under Wis. Stats. ch. 453 and who is certified under rules promulgated by the department of agriculture, trade, and consumer protection.
- Wild animals means any of the following animals, whether bred in the wild or in captivity, and also any of their hybrids with domestic species. The animals listed in parentheses are intended to act as examples and are not to be construed as an exhaustive list or limit the generality of each group of animals, unless otherwise specified.
- Nonhuman primates and prosimians (chimpanzees, monkeys);
- Felids, except domesticated cats;
- Canids (wolf, coyotes, foxes) except domesticated dogs;
- Prairie dogs;
- Elephants;
- Crocodilians (alligators, crocodiles);
- Marsupials (kangaroos, opossums);
- Ungulates (hippopotamus, rhinoceros);
- Hyenas;
- Mustelids (skunks, otters, badgers) except ferrets;
- Procyonids (raccoons, coatis);
- Dasypodidae (anteaters, sloth, armadillos);
- Viverrids (mongooses, civets, genets);
- Reptilia over ten feet in length (boa constrictors, pythons);
- Venomous reptilia.
- Intent and purpose with regard to wild animals. The common council of the City of Beaver Dam hereby finds that wild animals are inherently dangerous and do not adjust well to captive environment. It is the intent of the common council to protect the public against health and safety risks that wild animals pose and hereby prohibit the possession of wild animals within the City of Beaver Dam.
- Exceptions with regard to wild animals. The following persons or entities may possess wild animals:
- A person licensed by the state under Wis. Stats. ch. 169.
- A veterinarian, for the purpose of providing medical treatment to wild animals.
- A public zoo or aquarium.
- An itinerant or transient carnival, circus or other like show.
- A person authorized by the Department of Natural Resources.
- A person with a disability (defined above) who requires a service animal (defined above).
- Penalties. Any person convicted of a violation of this section shall be subject to a forfeiture of not more than $500.00.

City of Columbus
Sec. 14-12. – Keeping of wild or vicious animals.
- No person shall keep or permit to be kept on their premises, any wild or vicious animal for display or exhibition purposes, whether gratuitously or for a fee. This chapter shall not be construed to apply to zoological parks or circuses, or to nonpoisonous snakes exceeding three feet in length, which are kept and displayed for educational purposes in city public or parochial schools.
- No person shall keep, or permit to be kept, any wild animal as a pet.

§ 197-13: Protected animals; wild or dangerous animals; farm animals.
- Protected animals.
- Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the City any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family Felidae, polar bear (Thalarctos maritimus), red wolf (Canis niger), vicuna (Vicugna vicugna), gray or timber wolf (Canis lupus), sea otter (Enhydra lutris), Pacific ridley turtle (Lepidochelys olivacea), Atlantic green turtle (Chelonia mydas), or Mexican ridley turtle (Lepidochelys kempii).
- Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into this City any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of Subsection A above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collector’s permit issued by the Secretary of the Department of Natural Resources of the state, or by any person or organization licensed to present a circus.
- Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his/her possession or under his control within the City any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the City any of the following animals, reptiles or insects:
- All poisonous animals and reptiles, including rear-fang snakes.
- Apes: chimpanzees (Pan), gibbons (Hylobates), gorillas (Gorilla), orangutans (Pongo), and siamangs (Symphalangus).
- Baboons (Papio, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), 30 inches in length or more.
- Constrictor snakes.
- Coyotes (Canis latrans).
- Deer (Cervidae); includes all members of the deer family; for example, whitetailed deer, elk, antelope and moose.
- Elephants (Elephas and Loxodonta).
- Game cocks and other fighting birds.
- Hippopotami (Hippopotamidae).
- Hyenas (Hyaenidae).
- Jaguars (Panthera onca).
- Leopards (Panthera pardus).
- Lions (Panthera leo).
- Lynxes (Lynx).
- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Pumas (Felis concolor); also known as cougars, mountain lions and panthers.
- Rhinoceroses (Rhinocerotidae).
- Sharks (class Chondrichthyes).
- Snow leopards (Panthera uncia).
- Tigers (Panthera tigris).
- Wolves (Canis lupus).

- Exceptions; pet shops. The prohibitions of Subsection C above shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; or zoological gardens, if:
- Their location conforms to the provisions of the Zoning Code of the City.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.
- Farm animals; miniature pigs. Except as provided in §197-22 regarding miniature pigs and on properties zoned in an agricultural classification, no person shall own, keep, harbor or board any cattle, horses, ponies, swine, goats, sheep, fowl (laying hens may be permitted under §197-24) or rabbits (more than two).

26.09 KEEPING OF WILD AND EXOTIC ANIMALS REGULATED.
- Keeping Wild and Exotic Animals Prohibited. No person shall keep, maintain or have in such person’s possession or under such person’s control any poisonous reptile, dangerous or wild animal or insect, including, but not limited to, poisonous insects and arachnids, all venomous snakes, constrictor snakes, any snake exceeding four (4) feet in length, non-human primates, bears, crocodiles, alligators, monitor lizards, bats, wild and domestic animal hybrids such as coyote/dog, coyotes, elephants, gamecocks and other fighting birds, hippopotami, hyenas, jaguars, leopards, lions, lynx, pumas, cougars, mountain lions, panthers, ocelots, tigers, or other wild feline species, wolves, and prairie dogs.
- Exceptions. The prohibitions set forth in subsection (1) shall not apply to: residents of the City who possessed one or more of the prohibited species prior to October 25, 2005 and who register same with the office of the City Clerk within 60 days of the effective date; licensed veterinary clinics; licensed animal rehabilitation homes; zoological gardens; public or private educational institutions; agricultural fairs; a display for judging purposes; circuses and professional animal acts or other shows requiring a license under Section 32.01 of the Municipal Code; provided that:
- Their location conforms to the zoning requirements of Chapter 13 of the Municipal Code.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- Any resident who shall claim exemption under subsection (a) above shall furnish satisfactory evidence in the form of a bill of sale, veterinary records, or other proof satisfactory to the Clerk, which demonstrates ownership of the otherwise prohibited species prior to the effective date of this ordinance. All ordinances or parts of ordinances contrary to the terms of this ordinance are hereby and to that extent repealed.
- Exceptions. The prohibitions set forth in subsection (1) shall not apply to: residents of the City who possessed one or more of the prohibited species prior to October 25, 2005 and who register same with the office of the City Clerk within 60 days of the effective date; licensed veterinary clinics; licensed animal rehabilitation homes; zoological gardens; public or private educational institutions; agricultural fairs; a display for judging purposes; circuses and professional animal acts or other shows requiring a license under Section 32.01 of the Municipal Code; provided that:

§ 212-13 Prohibited and protected animals, fowl, reptiles and insects.
- Protected animals.
- Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the City any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (Thalarctos maritimus), red wolf (Canis niger), vicuna (Vicugna vicugna), gray or timber wolf (Canis lupus), sea otter (Enhydra lutris), Pacific ridley turtle (Lepidochelys olivacea), Atlantic green turtle (Chelonia mydas), Mexican ridley turtle (Lepidochelys kempi), or alligator, caiman or crocodile of the order of crocodilia.

The prohibitions of Subsection C above shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; or zoological gardens if:
- Their location conforms to the provisions of Chapter 600, Zoning, of the City of Horicon.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.

6.04.130 – Prohibited and protected animals, reptiles and insects – Farm animals.
- Protected Animals. It is unlawful for any person to possess within the city of Juneau any animal or insect the possession of which is contrary to state or federal law, rules or regulation.
- Exceptions. The provisions of subsection A of this section shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.

- Animals are maintained in quarters so constructed as to prevent their escape;
- No person lives or resides within one hundred (100) feet of the quarters in which the animals are kept.
- Farm Animals; Miniature Pigs. Except as provided in Section 6.04.220 regarding miniature pigs and on properties zoned in an agricultural classification, no person shall own, keep, harbor or board any cattle, horses, ponies, swine, goats, sheep, fowl, or more than two rabbits.

Article IV – Wild and Exotic Animals
§ 150-26 Restrictions.
No person shall keep, maintain or have in such person’s possession or under such person’s control any poisonous reptile, dangerous or wild animal or insect, including but not limited to poisonous insects and arachnids, all venomous snakes, constrictor snakes, any snake exceeding four feet in length, monitor lizards, nonhuman primates, bears, crocodiles, alligators, coyotes, elephants, gamecocks and other fighting birds, bats, hippopotami, hyenas, jaguars, leopards, lions, lynx, pumas, cougars, mountain lions, panthers, ocelots, tigers or other wild feline species, wolves, prairie dogs, and wild and domestic animal hybrids such as coyote/dog.
§ 150-27 Exemptions.
- The prohibitions set forth in § 150-26 shall not apply to residents of the City who possessed one or more of the prohibited species prior to the effective date of this article and who register the same with the office of the City Clerk within 60 days of the effective date; licensed veterinary clinics; licensed animal rehabilitation homes; municipal zoos or those accredited by the Association of Zoos and Aquariums; public or private educational institutions; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; circuses, traveling exhibits, fair exhibitions, and petting zoos that are currently licensed under the federal Animal Welfare Act and also licensed by the United States Department of Agriculture; and professional animal acts or other shows requiring an entertainment activity license under Chapter 211 of the City Code, provided that:
- Their location conforms to the zoning requirements of Chapter 430 of the City Code.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- Any resident who shall claim exemption under Subsection A above shall furnish satisfactory evidence in the form of a bill of sale, veterinary records, or other proof satisfactory to the Clerk which demonstrates ownership of the otherwise prohibited species prior to the effective date of this article. All such animals shall be photographed and microchipped for identification.
§ 150-28 Violations and penalties.
Any person who violates this article shall be subject to a penalty as provided in § 1-4 of this Code.

City of Watertown
Article III – Keeping of Domestic Animals
§ 228-6 Definitions.
- As used in this article, the following terms shall have the meanings indicated:
- CAT – Any domestic feline, regardless of age or sex.
- DOG – Any domestic canine, regardless of age or sex.
- DOMESTIC ANIMAL – Includes domestic canines, domestic felines, domestic rabbits, domestic rodents, domestic reptiles, domestic arachnids, domestic weasels, domestic marsupials, domestic erinaceidae, and domestic birds.
- WILD, DANGEROUS OR UNDOMESTICATED ANIMAL – That which is not of a species customarily used as an ordinary household pet, an animal that would ordinarily be confined to a zoo, is on the Wisconsin DNR or the U.S. Fish and Wildlife Service list of threatened or endangered species, one which would ordinarily be found in the wilderness of this or any other country, or one which otherwise causes a reasonable person to be fearful of bodily harm or property damage. This shall include, but not be limited to, all venomous animals (excluding bees), including snakes and constrictor snakes six feet in length or more.
- The definitions listed above shall not be construed to impact agricultural land uses under § 550-50 or keeping and raising of chickens under § 550-56X.
§ 228-7 Legislative intent.
The Common Council of the City of Watertown hereby finds that the keeping of an unlimited number of domestic animals in the City for a period of time will adversely affect sanitary conditions and the health and safety of its occupants and the general public. Therefore, the keeping of an unlimited number of domestic animals is declared to be a public nuisance.
§ 228-8 Nonconforming use.
Any person who becomes nonconforming with respect to the requirements set forth in § 228-9 may continue to keep those dogs which that person had licensed in the City of Watertown prior to the effective date of this article. This nonconforming use exemption shall be valid while the person resides on the property listed on the license, and so long as the dogs licensed on the effective date have not been replaced with additional dogs that would cause the owner to remain in noncomformity with this article.
§ 228-9 Limitations.
- It shall be unlawful for any person or persons to keep more than 10 rabbits, guinea pigs, hamsters, rats, mice, gerbils, ferrets, chinchillas, iguanas, birds, turtles or snakes, with the exceptions to snakes noted above, or any combination of these animals totaling more than 10, within the City. A litter or a portion of a litter of these animals may be kept for a period of time not to exceed one month from weaning.
- It shall be unlawful for any person or persons to keep more than four dogs or more than five cats within the City, with the exception that a litter of pups or litter of kittens or a portion of litter may be kept for a period of time not exceeding four months from birth.
- It shall be unlawful for any person or persons to keep more than 10 animals as defined at § 228-6, or more than 10 animals including any animal not defined in § 228-6 but allowed pursuant to this section, at the same residence.
- It shall be unlawful for any person, other than an owner of a licensed pet shop, zoo or circus, to harbor, keep, maintain or have in his or her possession a wild, dangerous or undomesticated animal within the Watertown City limits.
- Pigs, goats, ducks, doves, geese, turkeys and pheasants shall not be kept in the City except for school-related educational purposes or as part of a licensed pet shop, zoo, petting zoo or circus.
§ 228-10 Exceptions.
- An annual written permit for the keeping of pigs, goats, chickens, ducks, doves, geese, turkeys and pheasants for school-related educational purposes or as part of a licensed pet shop, zoo, petting zoo or circus may be obtained from the Health Officer, who shall issue a permit only after inspection of the premises where the animal or animals are to be kept and a determination is made that no nuisance or other ordinance or statutory violation will be created thereby.
- A permit shall be required for any animal(s) not listed herein in the definitions of “domestic animal,” “dog” and “cat” in § 228-6. Such permit shall be obtained by submitting a written request for the permit to the Health Officer. The Health Officer may require an annual inspection of the premises where the animal or animals are to be kept. If a determination is made that no nuisance will be created thereby and said animal is not considered a wild, dangerous or undomesticated animal as defined herein, any inspection will be at the discretion of the Health Officer. The cost of obtaining or renewing such permit shall be as set by the Common Council and provided under separate fee schedule, provided no inspection is required. In the event that an inspection is required by the Health Officer, an additional fee shall be required to cover the time and expense related to the inspection.
- Any person owning domestic animals as defined in the definitions of “domestic animal,” “dog” and “cat” in § 228-6 may apply to the Health Officer seeking an exception to the numerical limits set forth in § 228-9A to C. Such person shall obtain a permit requesting an exception to § 228-9A to C from the Health Officer, who may issue a permit only after an annual inspection of the premises where the animal or animals are to be kept and a determination is made that no nuisance will be created by exceeding the numerical limits set forth above, and a determination is made that no human health hazard is posed. The cost of obtaining or renewing such permit shall be as set by the Common Council and provided under separate fee schedule, provided no inspection is required. In the event that an inspection is required by the Health Officer, an additional fee shall be required to cover the time and expense related to the inspection.
- All permits issued shall state with specificity the type and number of animals for which the exception has been granted. Permits shall be reviewed on an annual basis. Permits may be rescinded at any time that the Health Officer makes the determination that the type or number of animals or the condition in which they are kept has created a public nuisance or a human health hazard.
- In the event that the Health Officer or designated representative does not issue a permit upon a written request, the permit seeker may appeal in writing to the Board of Health within 30 days of the date of the mailing of the order to such permit seeker, which shall notify the Board of Health and the Health Officer, in writing, of the nature of the objection and of a request for a hearing thereon. The order of the Health Officer shall be deemed the initial determination, and the municipal authority charged with conducting the review, pursuant to §10-8B of this Code, shall be the Watertown Board of Health. The Board of Health shall proceed to conduct a hearing on the appellant’s objections, pursuant to §§10-9 and 10-10 of this Code of Ordinances. The Health Officer shall be present at such hearing. The appellant may be represented by counsel. The Board of Health may affirm, cancel or modify the order of the Health Officer, in its discretion, to best conform such order to the intent of this article.
- An exception to this permit requirement shall be made for any individual that is state or federally licensed as an animal rescue or rehabilitation specialist.

8.02(8) ANIMALS; CARE AND CONTROL.
- Keeping Certain Animals Prohibited. Except as provided in subsection (b) below, no person shall bring into, keep, harbor, feed, possess or maintain in the City any of the following: bees; wasps; hornets; poisonous snakes or other reptiles; nonpoisonous snakes or other reptiles over 3 feet in length; alligators; crocodiles; monkeys or other nonhuman primates; feral cats; mink, raccoon or other animals raised for fur-bearing purposes; muskrats; skunks woodchucks; opossums; foxes; wolves; leopards; panthers; tigers; lions; lynx; horses; ponies; mules; donkeys; cows; pigs (except pot-belly or Guinea pigs); goats; sheep; or chickens, ducks, geese or other birds.
- Exceptions. The prohibitions contained in subsection (a) above shall not apply to the following:
- Animals kept under the care, custody or control of a veterinarian for treatment on a temporary basis;
- Animals kept for less than 2 weeks as a part of a transient or temporary carnival, circus, fair, show or similar project or contest;
- Animals kept by public or private educational institutions solely for instructional purposes;
- Domesticated birds that are commonly kept as pets, including without limitation parrots, parakeets, budgies, finches and love birds, provided that such birds are kept in a home or similar controlled environment on the owner’s property, or in a locked cage or container while being transported. Nothing in this subsection shall be construed to permit the keeping of chickens, ducks, geese or other game birds.
- Chickens as permitted under Section 8.025 below.
- Feed placed on private property by a property owner or tenant for the purpose of attracting and feeding wild birds, when placed in bird feeding devices and structures at a sufficient height or design to prevent access by deer.
- “Service animals” that are trained for the purpose of assisting persons with sensory, mental or physical disabilities or accommodating such disabilities.

6.21 – PROHIBITED AND PROTECTED ANIMALS, FOWL, REPTILES, INSECTS AND FARM ANIMALS.
- PROTECTED ANIMALS.
- Possession and Sale of Protected Animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the Village any of the following animals, alive or dead, or any part or product thereof all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), gray or timber wolf (canislupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas), Mexican ridley turtle (lepidochelys kempi).
- Compliance With Federal Regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91St Congress).
- Regulating the Importation of Certain Birds. No person, firm or corporation shall import or cause to be imported into this Village any part of the plumage, skin or dead body of any species of hawk, owl, or eagle. This paragraph shall not be construed to forbid or restrict the importation or possession of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of subs. (c) shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
- WILD ANIMALS; PROHIBITION ON KEEPING. It shall be unlawful for an person to keep, maintain or have in his possession or under his control within the Village any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities.
- Possession Prohibited. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); ans siamungs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), thirty (30) inches in length or more.
- Constrictor snakes.
- Coyotes (Canis latrans).
- Deer (Cervidae); includes all members of the deer family; for example, whitetailed deer, elk, antelope and moose.

- Ferret.
- Game cocks and other fighting birds.

(a) above shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show: dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
- Their location conforms to the provisions of the zoning ordinance of the Village.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within one hundred (100) feet of the quarters in which the animals are kept.
- Farm Animals; Miniature Pigs. No person shall bring into, keep or maintain in the Village any bees, wasps, hornets, poisonous snakes, horses, mules, ponies, donkeys, cattle, swine, goats, sheep, chickens, ducks, geese, rabbits [more than four (4)], or any animal being raised for furbearing purposes or other wild animals unless otherwise permitted elsewhere in this Code of Ordinances. The prohibitions herein do not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fans, shows or projects of the 4-H clubs, not including the raising of said animal; a display for judging purposes; and itinerant or transient carnival, circus or other like show; dog or cat shows or trials; public or private educational institutions. The prohibitions herein also do not apply to the keeping or maintaining of farm animals in areas zoned for agricultural purposes by the Village Board. For purposes of this Subsection, the term “swine” shall not include any miniature pigs of either sex weighing less than eighty (80) pounds which are intended for and kept as domestic pets.
- Possession Prohibited. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any of the following animals, reptiles or insects:

- Farm animals. Cows, horse, pigs, sheep, poultry and other farm animals shall not be kept within the Village limits unless a conditional use permit under Chapter 365, Zoning, of the Code of the Village of Iron Ridge is obtained.

- Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:
- Exotic animal means those species of animal that are not domesticated by humans. Exotic animals include but are not limited to, animals belonging to any or all of the orders and families on the prohibited animal list as adopted by the village board.
- Possess means to own, possess, keep, harbor, bring into the Village, act as a custodian, or have custody or control of an animal.

The following orders and families, whether bred in the wild or in captivity, and any or all hybrids shall be defined as “exotic animals” pursuant to this section. - Keeping of exotic animals.
- Permit required. No person shall possess an exotic animal without first obtaining an exotic animal permit.
- Exceptions. This subsection (c) shall not apply to institutions accredited by the American Zoo and Aquarium Association, licensed veterinary hospitals or clinics, licensed or accredited research or medical institutions, licensed or accredited educational institutions, including museums, an animal certified as having been specially trained to assist an individual with impaired vision, hearing, or mobility, any government-owned or -operated facility, volunteers working on behalf of a government-owned or -operated facility, or a person temporarily transporting an exotic animal through the Village if the transit time is not more than 24 hours and the animal is at all times maintained within a confinement sufficient to prevent the exotic animal from escaping.
- Exotic or excess animal permit.
- Applications.
- Application for an exotic or excess animal permit shall be made to the village clerk on a form supplied by the village clerk’s office.
- Upon receipt of an application, the clerk shall forward the application to law enforcement for verification of the veracity of the application as well as research into the qualifications of the applicant in accordance with the requirements of this section.
- All applications shall be accurately completed in its entirety or shall be rendered void by the village clerk.
- A permit may be granted without further review by the village board in the event law enforcement approves of the application.
- Each permit shall expire upon the death of the animal which is the subject of the permit.
- Factors to be considered. In determining whether a permit under this section shall be granted, law enforcement shall consider the number and type of animals to be possessed, the applicant’s criminal record, including any animal-related police calls for service, known prior history of the animals, health of the animals, whether proper licenses and vaccinations have been obtained, the condition of the applicant’s residence where the animals will be kept, the likelihood of a public or private nuisance being created, and any other factors determined to be relevant
- Denial.
- If the humane officer determines that any portion of the application is false or that the applicant does not possess the necessary qualifications, the application may be denied by law enforcement.
- Law enforcement shall notify any applicant so denied.
- Any applicant whose application has been denied by law enforcement may appeal such determination to the board of appeals. Upon appeal, the board of appeals shall determine if the applicant possesses the qualifications of this section. After making such determination, the board of appeals shall forward its recommendation to the village board.
- Issuance of license. The village clerk shall not issue any exotic or excess animal permit until all the requirements above have been satisfied.
- Applications.
- Construction of animal structures. All stables, coops, yards, pens, or other structures wherein any animal is kept shall be constructed so as to be easily cleaned and kept in good repair. The inside and outside of such structures shall be washed as often as necessary to keep them clean or finished with such material as can be easily cleaned. All such structures shall be kept clean and sanitary and shall not cause any objectionable odor.
- Removal of animal waste. No person who possesses an animal shall permit such animal to defecate upon any property other than that of its owner or custodian unless the custodian immediately thereafter cleans up and removes such animal excreta from such property.
- Accumulation of animal waste. No person possessing an animal shall permit more than 72 hours’ accumulation of such animal’s feces to remain on property under the possessor’s control.
- Controlling animals. No person who possesses an animal shall walk or escort such animal off the property under the possessor’s control unless the person is in possession of equipment to clean up any defecation which may be deposited by such animal.
- Harvesting animals. No person may slaughter any animal unless specifically allowed to slaughter animals as regulated.
- Penalties. Any person who shall violate this section shall forfeit not less than $100.00 nor more than $1,000.00 for each offense. Each violation of this section shall be considered a separate offense, and any violation continuing more than one day shall be considered a separate offense.
- Animals to be confined.
- No person, owner, or custodian shall permit any animal to be at large within the village. Any animal shall be deemed to be at large when it is off the premises owned or leased by its owner or custodian unless crated, penned, or under the control of a person able to control the animal by means of a leash of sufficient strength to control the action of the animal, or such other personal attention as will reasonably control the conduct and actions of the animal.
- No person, owner, or custodian shall permit any animal to be left unattended within five feet of a public right-of-way. a. Such public rights-of-way include, but are not limited to, sidewalks, streets, alleys, and parking lots. b. Unattended animals shall include those animals which are crated, penned, or leashed but which are without personal supervision or control sufficient to properly restrain the animal.

§ 118-13 Protected and prohibited animals; exceptions; farm animals.
- Protected animals.
- Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the Village any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas), or Mexican ridley turtle (lepidochelys kempi).
- Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into this Village any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of Subsection A above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collectors permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
- Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the Village any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities, except for dangerous or pit bull dogs kept in accordance with § 118-9 of this chapter. Specifically, it shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the Village any of the following animals, reptiles or insects:
- All poisonous animals and reptiles, including rear-fang snakes.
- Apes: chimpanzees (pan); gibbons (hylobates); gorillas (gorilla); orangutans (pongo); ans siamangs (symphalangus).
- Baboons (papoi, mandrillus).
- Bears (ursidae).
- Bison (bison).
- Cheetahs (acinonyx jubatus).
- Crocodilians (crocodilia), 30 inches in length or more.
- Constrictor snakes.
- Coyotes (canis latrans).
- Deer (cervidae); includes all members of the deer family; for example, whitetailed deer, elk, antelope and moose.
- Elephants (elephas and loxodonta).
- Game cocks and other fighting birds.
- Hippopotami (hippopotamidae).
- Hyenas (hyaenidae).
- Jaguars (panthera onca).
- Leopards (panthera pardus).
- Lions (panthera leo).

- Exceptions; pet shops. The prohibitions of Subsection C above shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; and zoological gardens, if:
- Their location conforms to the provisions of Chapter 375, Zoning, of this Code.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.
- Farm animals. Except on properties zoned in an agricultural classification, no person shall own, keep, harbor or board:
- Any cattle, horses, ponies, swine, goats or sheep.
- More than two fowl.
- More than four rabbits.
- Keeping of mink prohibited. All persons are prohibited from keeping, feeding, raising and breeding mink of either wild or domesticated species within the Village of Randolph

- Their location conforms to the provisions of Chapter 480, Zoning, of the Code of the Village of Reeseville.

- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.

- No person lives or resides within 100 feet of the quarters in which the animals are kept.
- Farm animals; miniature pigs. No person shall bring into, keep or maintain in the Village any bees, wasps, hornets, poisonous snakes, horses, mules, ponies, donkeys, cattle, swine, goats, sheep, chickens, ducks, geese, rabbits (more than four), or any animal being raised for furbearing purposes or other wild animals unless otherwise permitted elsewhere in this Code. The prohibitions herein do not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs, shows or projects of the 4-H Clubs, not including the raising of said animal; a display for judging purposes; an itinerant or transient carnival, circus or other like show; dog or cat shows or trials; or public or private educational institutions. The prohibitions herein also do not apply to the keeping or maintaining of farm animals in areas zoned for agricultural purposes by the Village Board. For purposes of this subsection, the term “swine” shall not include any miniature pigs of either sex weighing less than 80 pounds which are intended for and kept as domestic pets.
