9.25 – REGULATION OF ANIMALS.
- Definitions.
- Domestic fowl means any of several, usually gallinaceous, birds that are barnyard or domesticated, including, but not limited to, chickens, turkeys, ducks, geese, guinea fowl, emus, ostriches, and the like.
- Livestock means cattle and other useful domestic animals usually kept or raised on a farm or ranch, including, but not limited to, horses, cows, steers, bulls, sheep, swine, hogs, goats, llamas, burros, donkeys, ponies, mules, oxen, yaks, water buffalo, and the like.
- Wildlife means undomesticated animals which usually live in the wild, including those hunted or trapped for food, sport, or profit.
- Reptiles and Amphibians means all turtles, lizards, snakes, frogs, toads, salamanders and any other reptiles or amphibians included as such in the definitions provided by the US Fish and Wildlife Service.
- Animals at large prohibited. No person who owns or has custody of an animal shall permit or allow, either intentionally or unintentionally, the animal to be at large in the City.
- Animals prohibited in the City. No person shall keep or maintain any domestic fowl, livestock, wildlife, reptiles or amphibians in the City, regardless of form or place of acquisition of said animals.
- Limitation on number of pets. No person or persons shall keep or maintain more than three cats or three dogs, or a combination thereof exceeding three, on his, her, or their premises in the City.
- Exception for temporary presence. This ordinance shall not be construed to prohibit the temporary presence of animals in the City for purposes of transportation, or showing at fairs, parades, or other exhibitions, provided the presence in the City of an animal for such a purpose does not exceed 72 hours.

City of Lancaster
§ 154-19: Purpose.
The purpose of this article is for the City of Lancaster to regulate by permit and penalty the possession, display, sale, purchase, and exhibition of certain harmful wild animals and exotic or wild animals in the City.
§ 154-20: Authority.
The City of Lancaster has the specific authority under § 169.43, Wis. Stats., to adopt this article.
§ 154-21: Definitions.
As used in this article, the following terms shall have the meanings indicated:
- BOVINE ANIMAL – Domestic cattle and American bison of any age or sex.
- CATTLE – Any of the various animals of the domesticated genus Bos.
- CERVID – A member of the family of animals that includes deer, elk, moose, caribou, reindeer, and the subfamily musk deer. “Cervid” includes all farm-raised deer.
- CIRCUS – A scheduled event staged by a traveling company with mobile facilities in which entertainment consisting of a variety of performances by acrobats, clowns, or trained animals is the primary attraction or principal business.
- CITY CLERK/TREASURER – The City Clerk/Treasurer of the City of Lancaster, Wisconsin.
- DOMESTIC ANIMAL – Any of the following:
- Domesticated cats of the subspecies Felis silvestris catus.
- Domesticated dogs of the subspecies Canis lupus familiaris.
- Rodents kept in cages, aquariums, or similar containers, including gerbils, hamsters, guinea pigs, and white mice.
- Fish kept in aquariums or self-contained bodies of water and farm-raised fish, except fish that have been released to waters of the state.
- Farm-raised deer that are kept by a person registered under § 95.55, Wis. Stats.
- Livestock.
- Poultry.
- Farm-raised game birds, except farm-raised game birds that have been released to the wild.
- Ratites.
- Foxes, fitch, nutria, marten, fisher, mink, chinchilla, rabbit, or caracul that are born, bred, and raised in captivity and are not endangered or threatened species.
- Pet birds.
- Any other animal listed as a domestic animal by rule by the State of Wisconsin, Department of Agriculture, Trade and Consumer Protection.
- EQUINE ANIMAL – A horse, mule, zebra, donkey, or ass.
- EXOTIC OR WILD ANIMAL – Any animal that is not a domestic animal and specifically includes all of the following:
- Nonhuman primates and prosimians, including chimpanzees and monkeys.
- Felids, except domesticated cats of the subspecies Felis silvestris catus, including lions, tigers, and other felids generally referred to as big cats.
- Canids, except domesticated dogs of the subspecies Canis lupus familiaris, including foxes not born, bred, and raised in captivity, and all wolves, coyotes, and wolf hybrids.
- Ursids, including all bears.
- Elephants.
- Crocodilians, including alligators and crocodiles.
- Marsupials, including kangaroos, wallabies, and opossums.
- Hippopotami.
- Rhinoceroses.
- Hyenas.
- Mustelids, except domestic ferrets, including skunks, otters, and badgers.
- Procyonids, including raccoons and coatis.
- Dasypodidae, including anteaters, sloth, and armadillos.
- Viverrids, including mongooses, civets, and genets.
- Reptilia over three feet in length, including boa constrictors, pythons, and any other snakes.
- Venomous reptilia.
- Cervids, except farm-raised deer that are kept by a person registered under § 95.55, Wis. Stats.
- Camelids, except South American camelids.
- FARM-RAISED DEER – A captive cervid, but includes a noncaptive cervid that has an ear tag or other mark identifying it as being raised on a farm. “Farm-raised deer” does not include a cervid kept by an institution accredited by the Association of Zoos and Aquariums.
- FARM-RAISED GAME BIRD – A captive bird of a wild nature that is not native. “Farm-raised game bird” does not include poultry or ratites, or birds kept pursuant to a license issued under § 169.15, 169.19, 169.20, or 169.21, Wis. Stats.
- HARMFUL WILD ANIMAL – Members of the family ursidae, commonly knows as bears, the species Felis concolor, commonly known as cougars, and any other animal designated as a harmful wild animal under Wisconsin Statutes, or by rule of the State of Wisconsin, Department of Natural Resources.
- LIVESTOCK – Bovine animals, equine animals, goats, poultry, sheep, swine other than wild hogs, farm-raised deer, farm-raised game birds, South American camelids, and ratites.
- PERSON – An individual, partnership, firm, joint-stock company, corporation, association, trust, estate, or other legal entity.
- PET BIRD – A psittacine or softbill that is not native, is not identified on the federal list of endangered and threatened species, and is not a migratory bird.
- POLICE CHIEF – The Police Chief of the City of Lancaster, Wisconsin.
- POSSESS – To own, control, restrain, transport, or keep.
- POULTRY – Domesticated fowl, including chickens, turkeys, and waterfowl, that are bred for the primary purpose of exhibition or producing eggs or meat. “Poultry” does not include ratites.
- PUBLIC ZOO OR AQUARIUM – A zoo or aquarium that is an accredited member of the Association of Zoos and Aquariums.
- RATITE – A member of the group of flightless birds that includes the ostrich, emu, cassowary, kiwi, and rhea.
- SELF-CONTAINED BODY OF WATER – A body of water that has no inlet from or outlet to a natural body of water, except that it may have pipes or similar conduits to put in or withdraw water that are equipped with barriers that prevent the passage of fish between the body of water and the other waters of the State of Wisconsin.
- SOUTH AMERICAN CAMELID – A llama, alpaca, vicuna, or guanaco.
- VETERINARIAN – A person who is licensed in the State of Wisconsin to practice veterinary medicine under Ch. 453, Wis. Stats., and who is certified under rules promulgated by the Department of Agriculture, Trade and Consumer Protection.
§ 154-22: Authorized possession.
- The following persons may possess exotic or wild animals in the City:
- A person licensed by the State of Wisconsin, Department of Natural Resources, under Ch. 169, Wis. Stats.
- A veterinarian, for the purpose of providing medical treatment to the animal.
- A public zoo or aquarium, with a permit issued by A veterinarian, for the purpose of providing medical treatment to the animal. City.
- A circus, with a permit issued by the City.
- A person authorized by the State of Wisconsin, Department of Natural Resources, for the possession of the specific type of harmful wild animal or exotic or wild animal in the City.
- Except as provided in Subsection C, any person not included in Subsection A may possess in the City an exotic or wild animal only with a permit issued by the Police Chief under the specific conditions established by the Police Chief.
- A person is exempt from holding a license or other approval under § 169.04(4), Wis. Stats., or any permit from the City, to possess live native wild animals, if these wild animals are not endangered or threatened species and are any of the following:
- Arthropods.
- Chipmunks.
- Pocket gophers.
- Mice.
- Moles.
- Mollusks.
- Opossums.
- Pigeons.
- Porcupines.
- Rats.
- Shrews.
- English sparrows.
- Starlings.
- Ground squirrels.
- Red squirrels.
- Voles.
- Weasels.
§ 154-23: Exhibition of certain animals.
- No person may, without a permit issued under § 154-24, display in the City for the purpose of public viewing any exotic or wild animals or harmful wild animals.
- This section shall not apply to any of the following:
- Persons that have received a license or authorization from the State of Wisconsin, Department of Natural Resources, under Ch. 169, Wis. Stats.
- A public zoo or aquarium, with a permit issued by the Police Chief.
- A veterinarian, for the purposes of providing medical treatment to the animal.
- A circus with permits issued by the Police Chief.
§ 154-24: Permits.
- No person may exhibit, possess, sell, or purchase an exotic or wild animal or harmful wild animal in the City without a written permit from the Police Chief.
- The applicant for a permit shall submit an application that contains all of the following:
- The name of the applicant, any agent of the applicant, and the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
- The address of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased.
- The business and residential telephone number of the applicant, the business and residential telephone number of any agent of the applicant, and the business and residential telephone number of the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
- The age of the applicant and of the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
- The legal description of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased.
- The manner, if any, of keeping the exotic or wild animal or harmful wild animal.
- The type and number of wild animals or harmful wild animals, if more than one, that will be exhibited, possessed, sold, or purchased.
- Any other items requested by the Police Chief in writing.
- The Police Chief may issue a permit in writing only if the Police Chief determines that the exhibition, possession, sale, or purchase in the City of an exotic or wild animal or a harmful wild animal proposed by the applicant will not constitute a public nuisance or a threat to the health and safety of the residents of the City. The Police Chief may include in the permit specific conditions to protect public health and safety and to prevent a public nuisance.
- A permit shall be for a fixed period determined by the Police Chief and is subject to revocation in the event of the violation of the conditions of the permit or this article after an applicable public hearing and notice and determination, as provided in this section for an initial permit application. Upon a determined emergency condition in the City, the Police Chief may suspend the permit without a hearing.
§ 154-25: Animals running at large.
No person may permit an exotic or wild animal or a harmful wild animal to run at large or to be released from captivity within the City. Any exotic or wild animal or harmful wild animal running at large shall be subject to seizure, detention, and disposal.
§ 154-26: Violations and penalties.
Any person, partnership, corporation, or other legal entity that fails to comply with the provisions of this article shall, upon conviction, be subject to a penalty as provided in § 1-4 of this Code. Each day a violation exists or continues constitutes a separate offense under this article. In addition, the Police Chief may seek injunctive relief from a court of record to enjoin further violations.

Sec 7-5-70 Certain Animals Prohibited
- It is unlawful for any person to keep, harbor or herd any hogs, pigs, goats, sheep, buffalo, deer, elk, cattle, horses, fowl (such term to include, but not be limited to roosters, chickens and geese) or any other livestock except as otherwise provided in this Code. The prohibition set forth in this Section shall not apply in any area zoned A-1 Agricultural.
- Upon the effective date of the ordinance codified herein, all citizens keeping or harboring fowl outside of the A-1 Agricultural zone district, except for the lawful keeping of chicken hens pursuant to Section 7-5-75 of this Code, shall be permitted to retain such fowl for the remainder of the fowl’s natural life. When any such fowl dies, it may not be replaced and any offspring of the existing fowl “grandfathered” under this Section shall not be kept in any zone district other than the A-1 Agricultural zone district.
- If any conflict exists between the provisions of the Article, any other provision of the Code and any state of federal law concerning the keeping of animals within the Town, including without limitation, such federal or state law shall control. In making this determination, the Town will consider any applicable health and safety concerns related to keeping of animals and the existence of any administrative or financial burdens on the Town.

Village of Livingston
Sec. 7-1-14 Prohibited and Protected Animals, Fowl, Reptiles and Insects; Farm Animals.
- Protected Animals.
- Possession and Sale of Protected Animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the Village any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas), Mexican ridley turtle (lepidochelys kempi).
- Compliance with Federal Regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the Importation of Certain Birds. No person, firm or corporation shall import or cause to be imported into this Village any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This paragraph shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of Subsections (a) and (c) herein shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus. However, such facilities shall comply with Village zoning requirements.
- Wild Animals; Prohibition on Keeping. It shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the Village any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the Village any of the following animals, reptiles or insects:
- All poisonous animals and reptiles.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); ans siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), thirty (30) inches in length or more.
- Coyotes (Canis latrans).
- Deer (Cervidae); includes all members of the deer family; for example, whitetailed deer, elk, antelope and moose.
- Elephants (Elephas and Loxodonta).
- Game cocks and other fighting birds.
- Hippopotami (Hippopotamidae).
- Hyenas (Hyaenidae).
- Jaguars (Panthera onca).
- Leopards (Panthera pardus).
- Lions (Panthera leo).
- Lynxes (Lynx).
- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Pumas (Felis concolor); also known as cougars, mountain lions and panthers.
- Rhinoceroses (Rhinocero tidae).
- Snow leopards (Panthera uncia).
- Tigers (Panthera tigris).
- Wolves (Canis lupus).
- Poisonous insects.
- Snakes.
- For purposes of this Subsection, “poisonous” shall mean having the ability to cause serious harm or death by the transfer of venom or poison to a person or animal.
- No person shall keep or possess any snake in the Village which is poisonous or in excess of ten (10) feet in length. This prohibition shall not apply to bona fide zoos, educational institutions or exhibitions keeping such snakes for display or for instructional or research purposes. Any person legally possessing any such animal in this capacity shall notify the Chief of Police in writing of the location and type of snake being kept and the purpose for such possession.
- Exceptions; Animal Trials; Wildlife Rehabilitators. The prohibitions of Subsection (c) above shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
- Their location conforms to the provisions of the zoning ordinance of the Village.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within seventy-five (75) feet of the quarters in which the animals are kept. The prohibitions in this Section shall not apply to animals in the possession of a wildlife rehabilitator who is licensed by the State of Wisconsin, Department of Natural Resources, while such animal is being lawfully nurtured or rehabilitated for release in the wild. No animal may be kept under this exception for a period of more than fifty-five (55) days.
- No animal may be kept under this exception that poses a danger to the community.
- Farm Animals; Miniature Pigs. Except as provided in Section 7-1-23 regarding miniature pigs and on properties zoned in an agricultural classification, no person shall own, keep, harbor or board any cattle, horses, ponies, swine, goats, sheep, fowl [more than two (2)] or rabbits [more than four (4)]. For purposes of this Subsection, the term “swine” shall not include any miniature pigs of either sex weighing less than eighty (80) pounds which are intended for and kept as domestic pets.

Village of Montfort
4.05 OTHER DANGEROUS ANIMALS
- Keeping of Animals Prohibited. It shall be unlawful to keep, harbor, own or in any way possess the following within the corporate limits of the Village of Montfort:
- Any warm-blooded, carnivorous or omnivorous, wild or exotic animal including but not limited to non-human primates, raccoons, skunks, foxes and wild and exotic cats.
- Any animal having poisonous bites.
- Penalty. Failure to comply. The penalty for violation of this section shall be a forfeiture of not less than $50 nor more than $200 for a first offense, and not less than $100 nor more than $300 for a second and each subsequent offense, together with the costs of prosecution, and in default of payment of such forfeiture and costs, imprisonment in the County Jail until such forfeiture and costs are paid, not exceeding 30 days. Each day any such violation continues shall constitute a separate offense.

- Protected Animals.
- Possession and Sale of Protected Animals. It shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the Village any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the Village any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); ans siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).

- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within one hundred (100) feet of the quarters in which the animals are kept.
- Farm Animals. Except on properties zoned agricultural, no person shall keep or harbor in the Village any horses, swine, cattle, fowl or other farm-type animals excluding chickens.
