9.11 ANIMAL REGULATIONS.

  1. No person shall own, harbor or keep any dog, cat or other animal in a domesticated environment which does any of the following:
    1. Habitually pursues any vehicle upon any public street, alley or highway or is allowed to run at large.
    2. Habitually barks, crows, cries, screeches, howls or makes any other loud or annoying sound which may tend to annoy or disturb one or more persons within the City; or
    3. Has not been licensed as required by the ordinances of the City and the laws of the State.
  2. PROHIBITED ANIMALS. No person shall bring into, keep, maintain, offer for sale or barter, or release to the wild, nor shall any person permit such activities to occur on premises owned, controlled, rented, or maintained by that person:
    1. Any rooster, fowl other than chicken (Gallus gallus domesticus), turkeys, ducks, geese, cows, cattle, horses, sheep, swine, goats, pot-bellied pigs, or any other domesticated livestock.
    2. Wild animals, including but not limited to, any live monkey, or other nonhuman primate, raccoon, skunk, prairie dog, fox, wolf, panther, lynx, opossum, or any other warm-blooded animal which can normally be found in the wild. For the purposes of this code, wolf-dog hybrids are considered wild animals.
    3. Any poisonous or venomous, biting or injecting species of reptiles, amphibians, arachnids, or insects, including bees, unless such bees are part of an agricultural operation.
    4. Snakes not indigenous to Wisconsin or any snake exceeding three feet in length.
    5. The above paragraph shall not be construed to apply to zoological parks, circuses or like entertainment organization or to an educational or medical institution.

14.020 Regulation of Dogs, Cats, and Other Animals.

  1. Limit on Possession of Dogs or Cats. No person shall own, harbor, or keep in his possession at any one dwelling at any one time more than three dogs and more than three cats over six months of age, nor more than a total of 12 dogs or cats of any age, for more than three days, nor shall any person retain a litter or portion of a litter of dogs or cats longer than four months, if such litter or portion of a litter increases the total number of dogs or cats to more than three, except that none of the provisions of this subsection apply to the licensee of a duly licensed kennel.

    In rare circumstances, the Chief of Police or his designee is authorized to issue a permit allowing a person to keep up to four dogs or four cats at one time in any one dwelling upon receipt of an application accompanied by a $15.00 fee. In determining whether or not to grant any such permit, the Chief of Police or his designee shall consider the likelihood of a public or private nuisance and may contact residents in the neighborhood prior to making a decision. An initial inspection of the property by the Chief of Police or his designee shall be required to confirm that all animals are properly cared for, sheltered, and do not pose a health problem within the property. Any applicant seeking such a permit shall further agree in writing to make their property available for such inspections by the Chief of Police or his designee as a condition of obtaining the permit. Any such permit granted shall be limited to specifically identified dogs or cats owned at the time of permit issuance and shall not automatically apply to later-purchased dogs or cats.
  2. Restricted Species.
    1. Exotic or Wild Animals Prohibited. No person may bring into or keep, raise, possess or have under such person’s control, either temporarily or permanently, any venomous reptile or snake, constrictor snake or any nonvenomous snake more than five feet in length at maturity, lizard up to more than five feet in length at maturity, poisonous insect or arachnid, a wild animal, including but not limited to a live monkey or other nonhuman primate, alligator or crocodile, bat, cheetah, coyote and coyote-dog hybrids, cougar, fox, jaguar, leopard, lion, lynx, panther, prairie dog, raccoon, skunk, tiger or hybrids thereof, wolf and wolf-dog hybrids, or any other animal or bird of prey which can normally be found in the wild state, without the written permission of the Chief of Police or his designee.
    2. Certain Domestic Species Prohibited. No person may bring into or keep within the corporate limits of the City, either temporarily or permanently, gamecocks and other fighting birds, cows, cattle, horses, sheep, swine, pigs, goats, turkeys, geese, or any other domesticated livestock without the written permission of the Chief of Police or his designee.
    3. Dangerous Animals Prohibited. No person may bring into or keep within the corporate limits of the City, either temporarily or permanently, a prohibited dangerous animal. Prohibited dangerous animal means any of the following:
      1. 1. Any animal that, while off the owner’s or caretaker’s property, has inflicted serious injury to or killed a domesticated animal without provocation;
      2. 2. Any animal that inflicts bodily harm to a person on public or private property;
      3. 3. Any animal brought from another city, village, town or county that has been declared dangerous or vicious by that jurisdiction;
      4. 4. Any animal that is subject to being destroyed under Wis. Stat. § 174.02(3);
      5. 5. Any dog trained, owned, or harbored for the purpose of dog fighting.
    4. In considering any request for permission under subsection (2)(a) or (b) of this section, the Chief of Police or his designee shall consider the number and type of animals or creatures, their location, the facilities to be used for such purpose, the likelihood of a public or private nuisance being created or a health hazard, and the ability of the owner to responsibly control and care for the creatures.
    5. Compliance with Federal Regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
    6. Exemption. The provisions outlined in this section shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by a public agency; licensed veterinary clinics; pet shops; zoological gardens; public or private educational institutions; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; circuses and professional animal acts; research purposes; persons holding Federal permits; or by a person holding a scientific collector’s permit issued by the Secretary of the Department of Natural Resources of the State; or to any person or organization licensed to present a circus or similar recreational event.
  3. Prohibited Dangerous Animals. The Chief of Police may determine an animal to be a prohibited dangerous animal whenever he finds that an animal meets the definition of a prohibited dangerous animal as set forth in subsection (2)(c) of this section.
    1. Upon conducting an investigation and finding an animal meets the definition of a prohibited dangerous animal, the Chief of Police may issue an order declaring an animal to be a prohibited dangerous animal. Whenever an owner or caretaker wishes to contest an order, he or she shall, within 72 hours after receipt of the order, deliver to the Chief of Police a written objection to the order stating specific reasons for contesting the order. Upon receipt of the written objection, the matter shall be placed on the agenda for the Public Safety Committee to be reviewed at the next regular meeting. The Public Safety Committee shall act as a quasi-judicial body allowing the animal’s owner or caretaker an opportunity to present evidence as to why the animal should not be declared a prohibited dangerous animal.
    2. Pending the outcome of the hearing, the animal may be confined subject to Wis. Stat. § 173.21 or held at a location outside the limits of the City.
    3. After the hearing, the owner or caretaker shall be notified in writing of the Committee’s determination. If a determination is made that the animal is a prohibited dangerous animal, the owner or caretaker shall remove the animal from within the City within five days after the date of the determination. If the owner or caretaker further contests the determination, he or she may, within five days of receiving the panel’s decision, seek review of the decision by the Circuit Court.
    4. Destruction. Any animal that has caused bodily harm to a person, persons, or a domestic animal on two separate occasions, without reasonable cause, may be destroyed as a result of a judgment rendered by a court of competent jurisdiction, as specified under Wis. Stat. § 174.02(3). The City Attorney may petition an appropriate court to obtain a court order to destroy such an animal.
    5. Exemptions.
      1. The Chief of Police may waive the provisions of this section for a law enforcement or military animal upon presentation by the animal’s owner or handler of a satisfactory arrangement for safe keeping of the animal.
      2. No animal may be declared dangerous if death, injury or damage is sustained by a person who, at the time such injury or damage was sustained, was committing a trespass on the land or criminal trespass on the dwelling upon premises occupied by the owner of the animal; was teasing, tormenting, abusing or assaulting the animal; or was committing or attempting to commit a crime or violating or attempting to violate an ordinance which protects persons or property.
      3. No animal may be declared dangerous if the animal was protecting or defending a human being within the immediate vicinity of the animal from an unjustified attack or assault.
    6. Enforcement. The Chief of Police may make whatever inquiry is deemed necessary to ensure compliance with this section.
    7. Costs of Disposition. Any owner or caretaker of a prohibited dangerous animal shall pay the costs for the animal’s removal, impoundment, destruction or other disposition.
    8. Noncompliance. Any person failing to comply with any written terms, conditions or restrictions imposed by the City regarding a dangerous animal shall be subject to a forfeiture of not less than $50.00 nor more than $500.00 for a first offense and not less than $200.00 nor more than $1,000 for any subsequent offense. Each and every day that such violation continues shall be considered a separate offense.

Village of Cleveland

Sec. 7-1-13 – Prohibited and protected animals.

  1. Protected animals.
    1. Possession and sale of protected animals. It shall be unlawful for any person, firm, or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the village any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (Thalarctos maritimus), red wolf (Canis niger), vicuna (Vicugna vicugna), or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (Canis lupus), sea otter (Enhydra lutris), Pacific ridley turtle (Lepidochelys olivacea), Atlantic green turtle (Chelonia mydas), Mexican ridley turtle (Lepidochelys kempi).
    2. Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian, or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
    3. Regulating the importation of certain birds. No person, firm, or corporation shall import or cause to be imported into this village any part of the plumage, skin or dead body of any species of hawk, owl, or eagle. This paragraph shall not be construed to forbid or restrict the importation or use of the plumage, skin, body, or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
  2. Exceptions. The provisions of subsection (a) above shall not be deemed to prevent the importation, possession, purchase, or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collectors permit issued by the secretary of the department of natural resources of the state, or to any person or organization licensed to present a circus.
  3. Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the village any poisonous reptile or any other dangerous or carnivorous wild animal or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the village any of the following animals:
    1. All poisonous animals and reptiles including rear-fang snakes.
    2. Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); ans siamangs (Symphalangus).
    3. Baboons (Papoi, Mandrillus).
    4. Bears (Ursidae).
    5. Bison (Bison).
    6. Cheetahs (Acinonyx jubatus).
    7. Crocodilians (Crocodilia), 30 inches in length or more.
    8. Constrictor snakes, six feet in length or more.
    9. Coyotes (Canis latrans).
    10. Deer (Cervidae); includes all members of the deer family, for example, white-tailed deer, elk, antelope and moose.
    11. Elephants (Elephas and Loxodonta).
    12. Game cocks and other fighting birds.
    13. Hippopotami (Hippopotamidae).
    14. Hyenas (Hyaenidae).
    15. Jaguars (Panthera onca).
    16. Leopards (Panthera pardus).
    17. Lions (Panthera leo).
    18. Lynxes (Lynx).

    3. Animals are maintained in quarters so constructed as to prevent their escape.
    4. No person lives or resides within 100 feet of the quarters in which the animals are kept.

12.04(17) PROTECTED AND WILD ANIMALS PROHIBITED

  1. Possession and Sale of Protected Animals. It shall be unlawful for any person to possess with intent to sell or offer for sale, or buy or attempt to buy, within the Village limits any protected animal, alive or dead or any part of product thereof.
  2. Wild Animals. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village limits, any poisonous reptile or any other dangerous, carnivorous, or exotic wild animal, insect, or reptile, any vicious or dangerous domesticated animal or any other type of animal or reptile of wild, which is vicious or of dangerous propensities.
  3. Farm Animals/Domesticated Animals or Fowl. It shall be unlawful under this section, to have on any premises, inside or out, caged or not, any farm type of animal or fowl, except hen chickens as allowed in §12.04(16). (ie.; but not limited to; cows, cattle, horses, donkey, mules, sheep, goats, pigs, turkeys, geese, ducks, roosters, game cocks, fighting birds or the like). The only exception shall be on the premises of a slaughterhouse and then only held for slaughter, not for raising. Slaughterhouses are considered to be slaughterhouses when in proper zoned areas, and under the control of the State of Wisconsin Department of Agriculture as a business. Private residences which are located in a residential zoned area, cannot apply as slaughterhouses.
  4. Exceptions. The prohibitions of this subsection shall not apply where the creatures are in the care, custody or control of:
    1. Veterinarian for treatment.
    2. Agricultural fairs, shows, projects for judging purposes.
    3. Carnivals or circuses.
    4. Educational institutions.
    5. Farm animals in areas zoned agricultural or held for slaughter at a slaughterhouse (wholesale or resale).

Household Pet and Animal Control Ordinances

SECTION 1 – TITLE AND PURPOSE:

The title of this ordinance is the Town of Newton Household Pet and Animal Control Ordinance. This Ordinance is hereby adopted in the interest of promoting the public’s health, safety and welfare and in protection of the Town’s animal population.

SECTION 2 – AUTHORITY:

The Town Board has the authority under its village powers under s. 60.22, Wis. Stats., and the specific authority under s. 60.22, and chapters 173 and 174, Wis. Stats., to adopt this ordinance.

SECTION 3 – STATE STATUTES ADOPTED:

Wisconsin Statutes Chapter 95 (Animal Health), 170 (Strays and Lost Chattels), 172 (Animal Distrained or Doing Damage), 173 (Animals: Humane Officers), 174 (Dogs), and 951 (Crimes against Animals), and all acts supplementary thereto and amendatory thereof, are hereby adopted by reference. If there is a conflict between the provisions of Wisconsin Statutes and this Ordinance, the provisions of this Ordinance shall apply except in those cases where State Statutes are preemptive.

SECTION 4 – DEFINITIONS:

4.1 Dwelling Unit: One or more rooms that are arranged, designed, or used as living quarters for one family only.

4.2 Exotic Pet: any companion animal other than a dog, domestic cat, ferret, hedgehog, pet bird, hen chicken, rabbit, domestic rodent (gerbil, guinea pig, hamster, or domestic mouse or rat). Any small pets that exceed 12 inches in height or length.

4.3 Household: a dwelling unit as defined in this ordinance.

4.4 Household Pet: for the purpose of this ordinance, a “Household Pet” is an animal from a traditional companion animal species: dog, domestic cat, ferret, hedgehog, pet bird,hen chicken, rabbit, domestic rodent (gerbil, guinea pig, hamster, or domestic mouse or rat), and small pets as defined herein. Household pets can inhabit primary and accessory structures plus the premise yard.

4.5 Small Pets: For the purpose of this ordinance, “small pets” are considered hamsters, chinchillas, mice, gerbils, guinea pigs, reptiles and tropical birds. Small pets exceeding 12″ in height or length shall be considered “exotic” for purposes of this ordinance.

SECTION 5 – KEEPING OF HOUSEHOLD PETS:

Household pets shall be allowed in all zoning districts provided that not more than four dogs are kept on any one premise.

SECTION 6 – EXOTIC PETS

Exotic pets are prohibited in all zoning districts.

SECTION 7 – IN THE RESIDENTIAL DISTRICTS

Including the RCC, R-2, LMSR, LR and the PRD:
7.1 No residential structure, regardless the number of dwelling units contained therein, may exceed six (6) household pets provided, however, that no more than four (4) of the household pets may be dogs, and further provided that no more than five (5) of the household pets may be hen chickens.

7.2 No animals, fowl or pets may be bred or reared on such premises for commercial purposes or sold therefrom. However, offspring of permitted household pets may be kept at and sold from the premises until the age of eight months.

7.3 Cattle, swine, horses, sheep, goats, lamas or other livestock as defined in Wis. Stat. § 91.01 are prohibited in the Residential Districts.

7.4 Domesticated wild animals are prohibited in the Residential Districts.

7.5 Except as provided in Section 7.1, roosters, poultry, and other fowl are prohibited in the Residential Districts.

SECTION 8 – BARKING DOGS; NUISANCE PETS:

No person shall harbor any dog within his care or custody which shall continuously bark or create a continuous or intermittent noise or disturbance, or allow such animals to make any unusual or unnecessary noise to the disturbance of the neighborhood or to people passing upon the roadways. No person shall harbor any dog which is at large or by frequent and habitual howling, yelping, barking, or other noise, shall cause serious annoyance or disturbance to persons or to a neighborhood or habitually pursues any vehicle upon any public street or highway.

SECTION 9 – COMPLAINTS; VIOLATIONS

9.1 Complaints shall be investigated by the Town of Newton Animal Control Officer.

9.2 A violation of this Ordinance constitutes a public nuisance and is subject to enforcement under the Town’s Public Nuisance Ordinance.

SECTION 10 – INTERPRETATION:

The provisions of this Ordinance shall be liberally construed in favor of the protection of the health, safety and welfare of the public, and of the Town, and shall not be construed to be a limitation or repeal of any other power now possessed or granted to the Town.

SECTION 11 – SEVERABILITY AND CONFLICT:

If any section, subsection, sentence, clause, phrase, or word of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions. This Ordinance is not intended to repeal or overrule any other existing Ordinance or Town regulation, except that where a conflict between this Ordinance and another Ordinance occurs, the provisions of this Ordinance shall apply.

SECTION 12 – EFFECTIVE DATE

Following passage by the Town Board, this Ordinance shall take effect the day after the date of publication as provided by Wis. Stat. §60.80(2) and (3).
