§ 173-20 Vietnamese potbellied pigs; exotic animals.
- Definitions. As used in this section, the following words and phrases shall have the following meanings, unless the context clearly indicates that a different meaning is intended:
VIETNAMESE POTBELLIED PIG – A purebred Vietnamese potbellied pig registered through a North American Vietnamese potbellied pig registry, which does not exceed 100 pounds in weight. - License required/fee. It is unlawful for any person, party, firm or corporation to keep or maintain within the Village of Neshkoro limits a Vietnamese potbellied pig or exotic animals normally associated with zoos, without first getting approval from the Village Board and obtaining a license from the Village Clerk-Treasurer annually.

- Suspension, revocation or denial of renewal of license. The Village Board or a law enforcement officer shall have the right to suspend or revoke any license once granted or deny annual renewal thereof when it appears that any licensee has violated any of the provisions of this chapter or any ordinance of the Village or law, rule or regulation of the State of Wisconsin involving cruelty or mistreatment of the animal or the unlawful possession of the animal. Prior to the suspension or revocation of any license or the denial of an application for a renewal thereof, written notice of the reason for such action shall be given to the applicant or licensee by the officer.

Sec. 18-115 – Prohibited and protected animals.
- Protected animals.
- Possession and sale. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the village any of the following animals, alive or dead, or any part of product thereof: all wild cats (Felidae vicugna) gray or timber wolf (Canis lupus), sea otter (Enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (Chelonia mydas), Mexican ridley turtle (lepidochelys kempi).
- Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135 91st Congress).
- Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into this village any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of subsection (a) of this section shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, persons holding federal permits, or by a person holding a scientific collector’s permit issued by the state secretary of the department of natural resources, or to any person or organization licensed to present a circus.
- Wild animals; prohibition on keeping. It shall be unlawful for any person, firm or corporation to keep, maintain, possess or control within the village any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile and vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person, firm or corporation to keep, maintain, possess or control within the village any of the following animals, reptiles or insects:
- All poisonous animals and reptiles, including rear-fang snakes.
- Apes: Chimpanzees (Pa); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo) and siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia) 30 inches in length or more.
- Constrictor snakes.
- Coyotes (Canis latrans).
- Deer (Cervidae); includes all members of the deer family; for example, white-tailed deer, elk, antelope and moose.
- Elephants (Elephas and Loxodonta).
- Ferret.
- Games cocks and other fighting birds.
- Hippopotami (Hippopotamidae).
- Hyenas (Hyaenidae).
- Jaguars (Pantherea onca).
- Leopards (Panthera pardus).
- Lions (Panthera leo).
- Lynxes (Lynx).
- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Pumas (Felis concolor); also known as cougars, mountain lions and panthers.
- Rhinoceroses (Rhinocero tidae).
- Snow leopards (Panthera uncia).
- Tigers (Panthera tigris).
- Wolves (Canis lupus).
- Poisonous insects.
- Domesticated animals; prohibition on keeping. It shall be unlawful for any person to keep, harbor, possess or control within the limits of the village any horse, mule, donkey, pony, cow, pig, goat, sheep or any animal raised for fur-bearing purposes.
- Domesticated fowl; prohibition on keeping. It shall be unlawful for any person to keep, harbor, possess or control within the limits of the village any chickens, ducks, geese, turkeys, pheasants, or other domesticated fowl.
- Exceptions. The prohibitions of subsections (d) and (e) of this section shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment in the animal hospital; agricultural fairs; a display for judging purposes; and itinerant or transient carnival, circus or other show.

Village of Westfield
§ 195-4 Prohibited animals.
It shall be unlawful to domicile or have any livestock or exotic animals anywhere in the Village, for more than 24 hours, whether for business or pleasure, unless specific advance approval has been granted by the Village Board. “Livestock” is defined as animals normally associated with agriculture, such as cows, goats, sheep, horses, swine (including miniature pigs), etc. Exotic animals are those normally associated with zoos and may or may not be suitable for domestication. Birds, such as parrots and canaries, and reptiles are permitted when maintained within the owner’s residence or place of business. Exceptions:
- As provided for in Chapter 525, Zoning, of this Code.
- Animals kept at the Marquette County fairgrounds.
- Horses used as a means of transportation by resident members of the Amish/Mennonite religious sects.

Household Pet and Animal Control Ordinances
SECTION 1 – TITLE AND PURPOSE:
The title of this ordinance is the Town of Newton Household Pet and Animal Control Ordinance. This Ordinance is hereby adopted in the interest of promoting the public’s health, safety and welfare and in protection of the Town’s animal population.
SECTION 2 – AUTHORITY:
The Town Board has the authority under its village powers under s. 60.22, Wis. Stats., and the specific authority under s. 60.22, and chapters 173 and 174, Wis. Stats., to adopt this ordinance.
SECTION 3 – STATE STATUTES ADOPTED:
Wisconsin Statutes Chapter 95 (Animal Health), 170 (Strays and Lost Chattels), 172 (Animal Distrained or Doing Damage), 173 (Animals: Humane Officers), 174 (Dogs), and 951 (Crimes against Animals), and all acts supplementary thereto and amendatory thereof, are hereby adopted by reference. If there is a conflict between the provisions of Wisconsin Statutes and this Ordinance, the provisions of this Ordinance shall apply except in those cases where State Statutes are preemptive.
SECTION 4 – DEFINITIONS:
4.1 Dwelling Unit: One or more rooms that are arranged, designed, or used as living quarters for one family only.
4.2 Exotic Pet: any companion animal other than a dog, domestic cat, ferret, hedgehog, pet bird, hen chicken, rabbit, domestic rodent (gerbil, guinea pig, hamster, or domestic mouse or rat). Any small pets that exceed 12 inches in height or length.
4.3 Household: a dwelling unit as defined in this ordinance.
4.4 Household Pet: for the purpose of this ordinance, a “Household Pet” is an animal from a traditional companion animal species: dog, domestic cat, ferret, hedgehog, pet bird,hen chicken, rabbit, domestic rodent (gerbil, guinea pig, hamster, or domestic mouse or rat), and small pets as defined herein. Household pets can inhabit primary and accessory structures plus the premise yard.
4.5 Small Pets: For the purpose of this ordinance, “small pets” are considered hamsters, chinchillas, mice, gerbils, guinea pigs, reptiles and tropical birds. Small pets exceeding 12″ in height or length shall be considered “exotic” for purposes of this ordinance.
SECTION 5 – KEEPING OF HOUSEHOLD PETS:
Household pets shall be allowed in all zoning districts provided that not more than four dogs are kept on any one premise.
SECTION 6 – EXOTIC PETS
Exotic pets are prohibited in all zoning districts.
SECTION 7 – IN THE RESIDENTIAL DISTRICTS
Including the RCC, R-2, LMSR, LR and the PRD:
7.1 No residential structure, regardless the number of dwelling units contained therein, may exceed six (6) household pets provided, however, that no more than four (4) of the household pets may be dogs, and further provided that no more than five (5) of the household pets may be hen chickens.
7.2 No animals, fowl or pets may be bred or reared on such premises for commercial purposes or sold therefrom. However, offspring of permitted household pets may be kept at and sold from the premises until the age of eight months.
7.3 Cattle, swine, horses, sheep, goats, lamas or other livestock as defined in Wis. Stat. § 91.01 are prohibited in the Residential Districts.
7.4 Domesticated wild animals are prohibited in the Residential Districts.
7.5 Except as provided in Section 7.1, roosters, poultry, and other fowl are prohibited in the Residential Districts.
SECTION 8 – BARKING DOGS; NUISANCE PETS:
No person shall harbor any dog within his care or custody which shall continuously bark or create a continuous or intermittent noise or disturbance, or allow such animals to make any unusual or unnecessary noise to the disturbance of the neighborhood or to people passing upon the roadways. No person shall harbor any dog which is at large or by frequent and habitual howling, yelping, barking, or other noise, shall cause serious annoyance or disturbance to persons or to a neighborhood or habitually pursues any vehicle upon any public street or highway.
SECTION 9 – COMPLAINTS; VIOLATIONS
9.1 Complaints shall be investigated by the Town of Newton Animal Control Officer.
9.2 A violation of this Ordinance constitutes a public nuisance and is subject to enforcement under the Town’s Public Nuisance Ordinance.
SECTION 10 – INTERPRETATION:
The provisions of this Ordinance shall be liberally construed in favor of the protection of the health, safety and welfare of the public, and of the Town, and shall not be construed to be a limitation or repeal of any other power now possessed or granted to the Town.
SECTION 11 – SEVERABILITY AND CONFLICT:
If any section, subsection, sentence, clause, phrase, or word of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions. This Ordinance is not intended to repeal or overrule any other existing Ordinance or Town regulation, except that where a conflict between this Ordinance and another Ordinance occurs, the provisions of this Ordinance shall apply.
SECTION 12 – EFFECTIVE DATE
Following passage by the Town Board, this Ordinance shall take effect the day after the date of publication as provided by Wis. Stat. §60.80(2) and (3).
