Sec. 4-3. – Wild animals.
(a) It shall be unlawful for any person to keep, maintain or have in their possession or under their control within the city any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in their possession or under their control within the city any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), 30 inches in length or more.
- Constrictor snakes, capable of growing to five feet one inch or more at maturity.
- Coyotes (Canis latrans).
- Deer (Cervidae); includes all members of the deer family, for example, white-tailed deer, elk, antelope and moose.
- Elephants (Elephas and Loxodonta).
- Gamecocks and other fighting birds.
- Hippopotami (Hippopotamidae).
- Hyenas (Hyaenidae).
- Jaguars (Panthera onca).
- Leopards (Panthera pardus).
- Lions (Panthera leo).
- Lynxes (Lynx).
- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Pumas (Felis concolor); also known as cougars, mountain lions and panthers.
- Rhinoceroses (Rhinocero tidae).
- Sharks (class Chondrichthyes).
- Snow leopards (Panthera uncia).
- Tigers (Panthera tigris).
- Wolves (Canis lupus).
- Squirrels of flying or nonflying variety.
- Poisonous insects.
- Bees, wasps and hornets.
- Pigs, to include pot-bellied.
- Except in properly zoned districts, horses, mules, ponies, donkeys, cows, pigs, goats, sheep, chickens, ducks, or any animal raised for fur-bearing purposes, unless otherwise permitted elsewhere in this Code.
(b) Exceptions to prohibition on keeping. The prohibitions of this section shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; or zoological gardens if:
- Their location conforms to the provisions of chapter 44, pertaining to zoning.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.
- No food establishment is located within 100 feet of the quarters in which the animals are kept.

Article V – Possession of Wild Animals
§ 80-29 Definitions.
As used in this article, the following terms shall have the meanings indicated:
POSSESS – To own, possess, keep, harbor, or exercise any care, custody, or control of an animal.
WILD ANIMAL – Those species of animal that are not typically domesticated by humans and usually live in nature or outside of one’s residence. Wild animals include, but are not limited to, animals belonging to any or all of the following orders and families:
- Class Mammalia:
- Order Chiroptera (bats).
- Order Artiodactyla (e.g., hippopotamuses, giraffes, camels, deer, cattle, swine, sheep, goats, alpacas, and llamas.
- Order Carnivora.
- Family Felidae (e.g., lions, tigers, cougars, leopards, ocelots, servals), but not domestic cats.
- Family Ursidae (e.g., bears).
- Family Mustelidae (e.g., weasels, skunks, martens, minks, wild ferrets), but not the domestic ferret species, Mustela putorius furo.
- Family Procyonidae (e.g., raccoons, coatis).
- Family Hyaenidae (e.g., hyenas).
- Family Viverridae (e.g., civets, genets).
- Family Mephitidae (e.g., skunks).
- Family Herpestidae (e.g., mongooses).
- Order Edentata (e.g., anteaters, armadillos, sloths).
- Order Marsupialia (e.g., opossums, kangaroos, wallabies), except sugar gliders.
- Order Perissodactyla (e.g., rhinoceroses, tapirs), except domestic horses and donkeys.
- Order Primates (e.g., lemurs, monkeys, chimpanzees, gorillas), except humans.
- Order Proboscidea (e.g., elephants).
- Order Rodentia (e.g., squirrels, beavers, porcupines, prairie dogs), but not guinea pigs, rats, mice, gerbils, and hamsters.
- Class Reptilia.
- Order Squamata.
- Family Helodermatidae (e.g., Gila monsters and Mexican beaded lizards).
- Family Varanidae (e.g., monitor lizard).
- Family Elapidae (e.g., coral snakes, cobras, mambas).
- Family Viperidae (e.g., copperheads, cottonmouths, rattlesnakes).
- Subfamily Atractaspidinae (e.g., burrowing asps).
- Order Crocodilia (e.g., crocodiles, alligators, caimans, gavials).
- Any constricting snake greater than four feet in length or 20 pounds in weight.
- Any venomous snake.
- Order Squamata.
- Class Aves.
- Order Falconiformes (e.g., eagles, hawks, vultures).
- Order Rheiformes (e.g., rheas).
- Order Struthioniformes (e.g., ostriches).
- Order Casuariiformes (e.g., cassowaries and emus).
- Order Strigiformes (e.g., owls).
- Order Galliformes (e.g., turkeys, chickens).
- Order Anseriformes (e.g., ducks, geese).
- Class Arachnida.
- Order Scorpiones.
- Any of the following members of Order Araneae, Family Therididae:
- Argentina red widow spider: Latrodectus corallinus.
- Brown widow spider: Latrodectus geometricus.
- Red-black widow: Latrodectus hasselti.
- Red widow spider: Latrodectus bishopi.
- Black widow spider: Latrodectus mactans.
- Western widow: Latrodectus hesperus.
- Brown recluse spider: Loxosceles reclusa.
- Brown recluse spider: Loxosceles reclusa.
- Class Chilopoda.
- Any of the following members of Order Scolopendromorpha, Family Scolopendridae:
- Amazon giant banded centipede: Scolopendra giganea.
- Arizona tiger centipede: Scolopendra viridis.
- Florida Keys centipede: Scolopendra alternans.
- Any other venomous chilopoda that is not native to Wisconsin.
- Any of the following members of Order Scolopendromorpha, Family Scolopendridae:
- Any species of the Class Insecta that is not native to Wisconsin.
- Any federal or state endangered or threatened species.
§ 80-30 Purpose and application.
The purpose of this chapter is to protect the public against health and safety risks that wild animals pose to the community. By their very nature, wild animals are potentially dangerous and do not adjust well to a captive environment. The provisions of this Article V are subject to and do not repeal or amend any other provisions of the Municipal Code specifically pertaining to the animals regulated herein, which provisions were existing upon April 5, 2021, the date of adoption of this Article V, including, but not limited to this Chapter 80 – Animals; Chapter 183 – Orderly Conduct, Article III – Animals; and Chapter 183 – Orderly Conduct, Article XVI: Rural Areas, § 183-86: Parking trucks and raising animals; the provisions of this Article V shall not apply to and do not prohibit, regulate or affect any meat and/or food processing use and/or facility, or farm use and/or facility, licensed and/or authorized by and having obtained any required approvals therefor, pursuant to any applicable federal, State of Wisconsin and/or City of Franklin laws, rules and ordinances as may be required.
§ 80-31 Possession of wild animals prohibited.
No person shall possess a wild animal unless one of the exceptions in Subsection A of this section applies:
(a) Exceptions. This section shall not apply to wild animals being kept or harbored on property in compliance with Chapter 80 – Animals; Chapter 183 – Orderly Conduct, Article III – Animals; and Chapter 183 – Orderly Conduct, Article XVI – Rural Areas, § 183-68 Parking trucks and raising animals, of this Municipal Code, persons who are temporarily exhibiting wild animals in the City pursuant to a valid license issued by the state of Wisconsin under Ch. 169. Wis. Stats., institutions accredited by the American Zoo and Aquarium Association, veterinarians who possess a valid license from the State of Wisconsin under Ch. 89, Wis. Stats., state-licensed veterinary hospitals or clinics, state-licensed circuses, state-licensed or -accredited research or medical institutions, state-licensed or -accredited educational institutions, an animal certified as having been specially trained to assist an individual with a disability, any government-owned or government-operated facility, volunteers working on behalf of a government-owned or government-operated facility, a person with a valid federal permit to possess a particular wild animal, or a person temporarily transporting a wild animal through the City if the transit time is not more than 24 hours and the wild animal is at all times maintained within a confinement sufficient to prevent the wild animal from escaping.
(b) Registration. Any person that meets the exceptions listed in Subsection A of this section shall register each wild animal that he/she possesses within the City of Franklin with the Police Department. The registration information shall include: the type of wild animal; a description of the wild animal, including size, color, and name of the animal; and the name and address of the wild animal’s owner or custodian.
(c) Escape.
- If a wild animal escapes the possession of a person, the person shall notify the Franklin Police Department immediately of the following information: the type of wild animal; a description of the wild animal, including size, color, and name of the animal; the nature of how the wild animal escaped; the name and address of the wild animal’s owner or custodian; and the location and time where the wild animal was last observed. If the wild animal returns to the possession of a person after notification to the Franklin Police Department, the person shall notify the Franklin Police Department immediately that the wild animal has returned to the person’s possession.
- Costs. Upon the escape of a wild animal, any person possessing such wild animal shall be responsible for the costs of the seizure, detention, and disposal of the wild animal and any City response to the report of escape.
(d) Prohibition against release. No person may permit a wild animal to run at large. Any wild animal running at large shall be subject to seizure, detention, and disposal.
§ 80-32 Penalty for violation of this article.
Any person, firm, partnership, or corporation who violates any part of this article shall be subject to the penalty and enforcement provisions in § 1-19, Penalty provisions, of this Code and any other enforcement actions available pursuant to law.

7.1.13 – Prohibited and protected animals, fowl, and insects.
(a) Protected animals.
- Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the city any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas), Mexican ridley turtle (lepidochelys kempi).
- Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into this city any pan of the plumage, skin or dead body of any species of hawk, owl or eagle. This paragraph shall not be construed to forbid or restrict the importation or use or of the plumage, skin, body or any pan thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
(b) Exceptions. The provisions of subsection (a) above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
(c) Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the city any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the city any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); am siamangs (Symphalangus).

7.1.24 – Animals, other than dogs, kept as pets regulated.
(a) Definition. For purposes of this section, the word “animal” includes cats and other animals kept as pets, but does not include do or such animals as are set forth in section 7.1.25(a)(3) and (4) of this chapter, such animals being regulated elsewhere.
(b) Restrictions. It shall be unlawful to own, harbor or keep any animal which:
- Habitually pursues any vehicle on any public street, alley or other thoroughfare.
- Assaults, attacks, bites, scratches or otherwise injures any person or any other animal kept by anyone as a pet.
- Destroys, damages or defaces any public or private property.
- Habitually barks, howls, squeals, screeches, honks, quacks or habitually makes any other offensive or annoying noise disturbing to any person or persons.
(c) Prohibited conduct. It shall be unlawful for any person having immediate custody and control of animal to permit the same to:
- Assault, attack, bit scratch or otherwise injure any person or any other animal kept by anyone as a pet.
- Destroy, damage or deface any public or private property.
- Deposit any solid fecal matter on any public street, alley or other thoroughfare or any public or private property other than that of the owner or keeper of such animal.
- Commit any other obnoxious or offensive act on any public or private property or against any person or persons.
(d) Running at large.
- It shall be unlawful to permit any animal to run at large if the same commits any acts set forth in subsection (c) above.
- Any animals shall be deemed to be running at large if it is off the property of the owner or keeper thereof unless it is in the immediate control of a person of suitable discretion and ability to control it.
(e) Impounding animals. Any stray animal or animal running at large maybe picked up or captured by any member of the police department or any citizen and turned over to the humane society for impounding. Such animals may be recovered as provided in section 7.1.7. if not so recovered, such animals shall be disposed of as provided in section 7.1.7.

12.11 – Animal health.
- Permitted animals.
- No animal that is not a domesticated animal may be kept or brought into the City, except as provided elsewhere in this chapter.
- No person shall keep, harbor, shelter or possess at any time more than 2 dogs or cats, or any combination thereof, which are over the age of 3 months, unless a person holds a valid animal fancier permit, kennel permit, pet shop permit or grooming establishment permit.
- The keeping, harboring, sheltering or possessing at any time more than 2 dogs or cats, or any combination thereof, which are under the age of 3 months shall be prohibited unless a person holds a valid animal fancier permit, kennel permit, pet shop permit or grooming permit. An exemption to the requirement of obtaining a permit herein exists if the dogs or cats were born on the premises in which the owner resides. (Cr. #2776)
- Restraint of animals.
- An owner may not leave a dog unattended by use of a restraint:
- On public property or on public streets;
- Outdoors in the case of extreme weather conditions, including conditions in which:
- The actual or effective outdoor temperature is below 32 degrees Fahrenheit;
- The actual or effective outdoor temperature is above 85 degrees Fahrenheit; or,
- A heat or wind chill advisory has been issued for the jurisdiction by the National Weather Service.
- By use of a collar that is pinch-type, prong-type, or choke-type or that is not properly fitted to the dog;
- Is a length shorter than the greater of:
- Five times the length of the dog, as measured from the tip of the dog’s nose to the base of the dog’s tail; or,
- 10 feet.
- Not designed for dogs. Logging chains, tow chains or other lines or devices not intended for the purpose of restraining dogs may be used. No chain or tether shall weigh more than one-eighth of the dog’s body weight.
- Free from entanglement to allow free movement of the full length of tether;
- Is in an unsafe condition; or,
- Causes injury to the dog.
- An owner may not leave a dog unattended by use of a restraint:
- Enforcement. The Police Department, Health Department or MADACC may enforce any provision of this section, and they are authorized to confiscate and remove animals from a premises for violation of any part of this section. Animals removed because of such action may be stored or disposed of in a humane manner by MADACC or its designee. Probable cause that such a violation exists is sufficient reason to confiscate such animal. Conviction is not required.
- Exemption This section does not apply to dogs used while in the line of duty by the Police Department, any other law enforcement agency or unit of the United States military service.
- Certain animals prohibited.
- Livestock. Except as otherwise provided in this chapter, no person shall harbor, raise or possess within the City, either temporarily or permanently, fowl, cows, cattle, horses, sheep, swine, goats, chickens, rabbits, ducks, turkeys, geese, pigeons or any other domesticated livestock, provided however, that such animals or fowl may be kept at places approved by the Health Officer. No rodents commonly considered domesticated shall be kept within any portion of any multiple dwelling units.
- Wild animals. No person shall harbor, raise or possess, either temporarily or permanently, within the City limits, a wild animal, such as a live monkey (nonhuman primate), bat, raccoon, skunk, fox, poisonous snake or reptile, poisonous insects or arachnids, cheetah, cougar, jaguar, leopard, lion, lynx, panther, tiger, wolf or wolf-dog hybrids, offspring of wild species cross-bred with domestic dogs and cats or any other warm blooded animal which can normally be found in the wild state, except when approved for a temporary educational event, circus or similar recreational event. Application for such events shall be made to the Health Officer.
- Exotic animals. No person may bring into or keep in the City, for sale or otherwise, either for food or for any other purposes whatsoever, any animal which, in accordance with the recommendations of the Compendium of Animal Rabies Control from the National Association of State Public Health Veterinarians, Inc., is not able to be effectively vaccinated against rabies, or any animal dead or alive, insect, which is otherwise dangerous or detrimental to health, any exotic animal or wild animals.
- Phase out the keeping of certain animals. Persons in possession of any animals within the City prior to September 5, 1967, shall have the right to retain such animals, providing they do not cause a nuisance or are injurious to the health, safety and welfare of the immediate neighborhood. The retention of these animals is permitted under prior usage, is not transferable, and they shall be deemed to have nonconforming use status. Since it is the intent to phase out the keeping of certain animals in the City, changes of use of property and/or natural termination of existence of the animals shall also terminate nonconforming use status and the animal or animals may not be replaced.
- Licensing. Every dog and cat kept sheltered or harbored within the City shall be currently licensed by the City Treasurer, in accordance with section 13.16(1) of this Municipal Code.
- Dangerous/vicious animals.
- Harboring dangerous/vicious animals. No person may harbor or keep a dangerous animal within the City, unless all provisions of this subsection, as well as the general provisions of this chapter are complied with.
- An animal may be deemed to be vicious by the Health Officer, police officer or deputy sheriff if it has attacked or bitten any person(s) more than 2 times or when a propensity to attack without provocation or bite people exists and is known or ought to reasonably be known to the person harboring such animal. If the animal is deemed vicious by the Health Officer, police officer or deputy sheriff, the Health Officer may order the humane termination of such animal.
- No person may bring into or keep in the City, an animal that a Wisconsin city, village, town or county has declared dangerous or vicious, has been banished from a city, village, town or county, or has been ordered to be destroyed. An officer may declare such an animal to be a prohibited dangerous animal in the City, upon receipt of an official written declaration from the other city, village, town or county setting forth the grounds for the declaration, the name of the animal, if known, and a description of the animal.
- Declaration that animal is prohibited, dangerous or prohibited dangerous.
- If a police, health or other designated officer determines that an animal is prohibited dangerous as defined in this section or elsewhere in this chapter, he/she may declare the animal to be prohibited, dangerous or prohibited dangerous. The Police or Health Officer shall immediately inform the owner in writing, by personal service or certified mail, of such determination.
- Hearing. If an owner contests the designation of the animal as prohibited, dangerous or prohibited dangerous, the owner may request a hearing in writing within 72 hours of issuance of the notice. Any interested party may present evidence as to whether the dog or other animal is prohibited, dangerous or prohibited dangerous. The hearing shall be held before the Board of Health within no less than 5 days or more than 10 days of the request for hearing.
- Compliance with restrictions. Pending the decision of the hearing, the owner or caretaker must comply with provisions of this section. After the hearing, if the dog or other animal is determined to be dangerous, the owner must continue to comply with the provisions of this section. After the hearing, the owner shall be notified in writing of the determination. If the animal is declared to be prohibited or prohibited dangerous, the owner shall remove the animal from the City or have it humanely euthanized within the time period set by the Board of Health, but in any case, no longer than 10 days. Until removed from the City or euthanized, it must continue to be kept as noted in this subsection.
- Appeal. If the owner contests the determination, he/she may appeal the decision in writing within 10 days of receiving the decision, to the Board of Health.
- The owner or caretaker of any animal which is or has been declared prohibited, dangerous or prohibited dangerous, shall not give, sell or in any way transfer ownership to any other person residing in the City.
- The issuance of a citation for a violation of this section need not necessarily be predicated on a determination by the Officer, that an animal is prohibited, dangerous or prohibited dangerous animal.
- Harboring dangerous/vicious animals. No person may harbor or keep a dangerous animal within the City, unless all provisions of this subsection, as well as the general provisions of this chapter are complied with.
- Sale of fowl as pets prohibited. No person shall sell or offer for sale or barter or give away baby chicks, ducklings or other fowl as pets or novelties. This provision shall not prohibit the sale or display of natural chicks or ducklings in proper brooder facilities by hatcheries or stores engaged in the business of selling fowl to be raised for commercial purposes.
- Turtles. No person shall sell, distribute, harbor, shelter or keep turtles as pets or novelties that are less than 4 inches in diameter. Only box or painted turtles are permitted. Snapping turtles are prohibited.

78-5. Keeping of Animals Within City.
- PERMITTED ANIMALS. No animal that is not a domesticated animal may be kept or brought into the city except as provided in this chapter or as otherwise authorized by the commissioner.
- CERTAIN ANIMALS PROHIBITED. Except as otherwise provided in this chapter, no person shall keep within the city, either temporarily or permanently, any live cows, cattle, horses, sheep, swine, goats, roosters, ducks, turkeys, geese or any other domesticated livestock, or undomesticated fowl provided, however, that the animals or fowl may be kept at places approved by the commissioner for slaughtering, educational purposes, research purposes and for circuses or similar recreational events. Upon approval by the commissioner, horses used for livery service may be kept within the city. No rabbits or guinea pigs shall be kept within any portion of any multiple dwelling.
- No person may bring into or keep in the city an animal that a Wisconsin city, village, town or county has declared dangerous or vicious, has banished from the city, village, town or county or has ordered to be destroyed. The commissioner may declare such an animal to be a prohibited dangerous animal in Milwaukee upon receipt of an official written declaration from the other city, village, town or county setting forth the grounds for the declaration, the name of the animal, if known, and the description of the animal.
- No person may bring into or keep in the city, for sale or otherwise, either for food or for any other purposes whatsoever, any animal which, in accordance with the recommendations of the Compendium of Animal Rabies Control from the National Association of State Public Health Veterinarians, Inc., is not able to be effectively vaccinated against rabies, or any animal dead or alive, bird, insect, reptile or fish which is otherwise dangerous or detrimental to health.
- NUMBER PERMITTED. No person may keep, harbor, shelter or possess at any time more than 4 rabbits, dogs or cats or any combination thereof which are over the age of 5 months unless the person holds a valid animal fancier permit, kennel permit, pet shop permit or grooming establishment permit. The keeping of more than 4 rabbits, dogs or cats over the age of 5 months per dwelling unit in a multiple dwelling is declared to be a nuisance. No person in a multiple dwelling shall be granted an animal fancier permit. There shall be no more than one animal fancier permit issued to any qualified dwelling unit.
- ANIMAL REMOVAL. The department may confiscate and remove animals from a premises for violation of sub. 1, 2 or 3 or ss. 78-6, 78-6.5, 78-23, 78-25 and 78-31, or if the animals constitute a public health threat as determined by the health department. The department may convey such animals to be housed and handled appropriately. If necessary, such animals may be disposed of in a humane manner by the department or their designee.
78-43. Turtles.
No person may sell live turtles with a carapace length of less than 4 inches as pets or novelties.

SEC. 7.47 PROHIBITED AND PROTECTED ANIMALS, FOWL, REPTILES AND INSECTS.
(a) Protected Animals.
- Possession and Sale of Protected Animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the City any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas), Mexican ridley turtle (lepidochelys kempi).
- Compliance with Federal Regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign spe- cies or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the Importation of Certain Birds. No person, firm or corporation shall import or cause to be imported into this City any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This paragraph shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part there- of legally collected for use by the American Indians for ceremonial purposes or in the preser- vation of their tribal customs and heritage.
(b) Exceptions. The provisions of Subsection (a) above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
(c) Wild Animals; Prohibition on Keeping. Except for state-licensed game farms, it shall be unlawful for any person to keep, maintain or have in his posses- sion or under his control within the City any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); ans siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), thirty (30) inches in length or more.
- Constrictor snakes, six (6) feet in length or more.
- Coyotes (Canis latrans).
- Game cocks and other fighting birds.
- Hyenas (Hyaenidae).
- Jaguars (Panthera onca).
- Leopards (Panthera pardus).
- Lions (Panthera leo).
- Lynxes (Lynx).
- Ostriches (Struthio).
- Pumas (Felis concolor); also known as cougars, mountain lions and panthers.
- Sharks (class Chondrichthyes).
- Snow leopards (Panthera uncia).
- Tigers (Panthera tigris).
- Wolf hybrids or any animal resulting from the breeding of a wolf with a domestic dog.
- Wolves (Canis lupus).
- Poisonous insects.
- Except in properly zoned districts, horses, mules, ponies, donkeys, cows, pigs, goats, sheep, chickens, poultry or any animal raised for fur-bearing purposes unless otherwise permitted elsewhere in this Code.
(d) Exceptions; Pet Shops. The prohibitions of Subsection (c) above shall not apply where the creatures are in the care, custody or control of: a state-licensed game farm; a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat or cat shows or trials; public or private educational institutions; zoo- logical gardens; if:
- Their location conforms to the provisions of the zoning ordinance of the City.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
SEC. 7.48 DANGEROUS ANIMALS RESTRICTED.
It shall be unlawful to keep, harbor, own or in any way possess within the corporate limits of the City of Oak Creek:
- Any warm-blooded, carnivorous or omnivorous, wild or exotic animal including but not limited to non-human primates, raccoons, skunks, foxes and wild and exotic cats, but excluding potbellied pigs.
- Any animal having poisonous bites.

City of South Milwaukee
§ 24.33 Regulate exotic pet animals and provide for keeping of animals.
(A) Permit. Except as herein specifically provided, no person may keep any animal in or on any premises in the City of South Milwaukee without first obtaining a permit for the keeping of the animal. All permits issued under this section shall be issued by the City Health Department and no permit shall be issued to any person for any animal if, in the judgment of the City Health Administrator or designee, the animal or the keeping of the animal on the proposed premises poses a danger to the residents of the premises, the neighbors or the City residents generally. In determining whether to grant or deny a permit, the Health Inspector shall consider the number of animals currently kept on the premises, the size of the premises, the number of residents on the premises and nearby, the characteristics of the animal and all other matters relevant to a determination of the degree of danger, health risk, or nuisance posed by the animal. Any permit issued under this section shall only be issued on payment of the permit fee established by resolution of the Common Council and satisfactory annual inspection to insure continuing compliance with the requirements of this chapter. Permits shall expire on June 30 following the date on which the permit is issued and all renewals shall commence on July 1 of the year in which an application for renewal is approved.
(B) Protected animals.
- Possession and sale. Specifically, it shall be unlawful for any person to keep, maintain or have in their possession or under their control within the City any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).

- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Pumas (Felis concolor); also known as cougars, mountain lions and panthers.
- Rhinoceroses (Rhinocero tidae).
- Sharks (class Chondrichthyes).
- Snow leopards (Panthera uncia).
- Tigers (Panthera tigris).
- Wolves (Canis lupus).
- Squirrels of flying or non-flying variety.
- Poisonous insects.
- Bees, wasps and hornets.
- Pigs, to include pot-bellied.
- Snapping turtles.
(E) Wild animals; exceptions to prohibition on keeping. The prohibitions of Subsection C of this section shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; or zoological gardens if:
- Their location conforms to the provisions of the zoning ordinance of the City.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.
- No food establishment is located within 100 feet of the quarters in which the animals are kept.
(F) Animals and birds, keeping of.
- Horses, swine, cattle, etc. No person, except a permitted slaughterhouse or meat packer, shall keep horses, swine, cattle, fowl and chickens, sheep or goats in the City, except horses for riding may be kept upon special permit of the City Council after recommendation by the Board of Health.
- Selling poultry; dyed baby chicks. No person shall display, give, or sell dyed, colored or artificially treated baby chicks or ducklings as pets or novelties. No person shall sell, give away or distribute live chicks, ducklings, goslings, poultry or any other young of the poultry family to be used as pets or novelties.
- Prohibition. No person, firm or corporation shall keep, feed, or breed any hares, rabbits, guinea pigs, rats, mice, gerbils, chickens, turkeys, geese, ducks, doves, pigeons, parrots of any species, games birds of any species, dogs, cats, reptiles, and amphibians for commercial purposes, within the residential districts.
- Commercial purposes. No person shall conduct for commercial purposes any establishment in which dogs, cats, hares, rabbits, guinea pigs, rats, mice, gerbils, chickens, turkeys, geese, ducks, doves, pigeons, parrots of any species, game birds or any species, are kept and maintained in the commercial or industrial districts without first obtaining from the Department of Public Health a permit so to do.
(G) Exemptions. Section 24.33 does not apply to the following animals which are regulated elsewhere or which the Common Council believes do not pose a potential danger if limited to the number specified herein. All numerical limitations apply to the building structure in which the animal is kept. Nothing in this ordinance is intended to supersede existing regulations governing dogs, cats, and pigeons:
- Dogs (canis familiaris), Cats (felis domesticus), and Pigeons.
- Small birds such as Finches, Parakeets, Cockatoo, Canaries, Cockatiels, etc. if not more than four in total.
- Tropical fish.
- Turtles weighing less than one pound, excludes snapping turtles.
- Parrots if not more than two in total.
- Non-venomous snakes capable of growing to no more than five feet at maturity, if not more than two in total. Snakes capable of growing to more than five feet at maturity are prohibited unless permitted under Subsection A above regardless of the current length of the snake.
- Non-venomous lizards capable of growing to no more than three feet at maturity if not more than two in total. Lizards capable of growing to more than three feet at maturity are prohibited unless permitted under Subsection A above regardless of the current length of the lizard.
- Gerbils, guinea pigs, rabbits, rats and mice, not more than five in total.
- Frogs, toads, geckos, salamanders, not more than 10 in total.
- Ferrets, not more than two in total.
- Such other animals as the Board of Health may from time to time determine do not pose a danger, possible health risk, or nuisance. All such animals determined by the Board of Health that do not pose a danger shall be exempt from the provisions of this ordinance on adoption of a Common Council resolution reflecting the Board’s determination.
(H) Each permit issued under this section shall provide that when the number of animals increases over the number permitted by reason of propagation by permitted animals, the person holding the permit shall remove sufficient number of animals from the premises to again be in compliance with the permit within 60 days after the birth of the new animals. Nothing herein or in any permit shall be construed to authorize the operation of a commercial animal enterprise on any premises other than a pet store located in a properly zoned district. The fee for permits issued hereunder shall be established by the Common Council and be included in the Administrative Fee Schedule.
(I) Health nuisances. The Health Officer may prohibit the keeping of any animal or fowl in any place, location or manner which in his judgment would constitute a health nuisance or be in violation of this section.
(J) Penalty. If a person violates any provision of this Section such person shall be subject to the general penalty provisions set forth under § 24.99 of the South Milwaukee Code. Each day a person keeps any animal in violation of any of the provisions of this ordinance constitutes a separate offense for each animal so kept.

It shall be unlawful for any person to keep, maintain or have in their possession or under their control within the City any venomous/poisonous reptile or any other dangerous noncarnivorous or carnivorous nondomesticated and wild animal, insect or reptile, any vicious or dangerous domesticated and wild animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in their possession or under their control within the City any of the following animals, reptiles or insects:
- All venomous/poisonous animals and reptiles.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), capable of growing to 30 inches in length or more.

The prohibitions of Subsection C of this section shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens or other similarly situated entities with legal federal or state permits that are consistent with the St. Francis Code of Ordinance governing such animal if:
- Their location conforms to the provisions of the zoning ordinance of the City.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.
- No food establishment is located within 100 feet of the quarters in which the animals are kept.
- Keeping of animals and birds.

- As a novelty, prize or premium as an inducement to enter a place of amusement; or,
- As an incentive to enter into any business establishment or to enter into any business agreement or transaction; provided, however, that this Subsection F(4)(b) shall not be construed to apply to any establishment in the City that sells animals at retail as a primary business or to any entity organized and existing for the purpose of the medical and/or humane treatment of animals.

It is unlawful for any person to keep swine, horses, ponies and other nonhousehold pets in the city of Wauwatosa, within one hundred feet of any public street, alley or highway of the city, or upon any lot or parcel of land in the city within one hundred feet of the lot line or boundary line of an adjoining owner.

7.12(1) Keeping of Certain Animals Prohibited.
- Definitions.
- Wild Animal. Those species of animal that are not typically domesticated by humans and usually live in nature. Wild animals include, but are not limited to, animals belonging to any or all of the following orders and families.
- Class Mammalia.
- Order Chiroptera (bats).
- Order Artiodactyla (e.g., hippopotamuses, giraffes, camels, deer, cattle, swine, sheep, goats, alpaca, and llama).
- Order Carnivora.
- Family Felidae (e.g., lions, tigers, cougars, leopards, ocelots, servals), but not domestic cats.
- Family Canidae (e.g., wolves, wolf-dog hybrids, coyotes, foxes, jackals), but not domestic dogs.
- Family Ursidae (e.g., bears).
- Family Mustelidae (e.g., weasels, skunks, martens, minks, wild ferrets), but not the domestic ferret species, mustela putorius furo.
- Family Procyonidae (e.g., raccoons, coatis).
- Family Hyaenidae (e.g., hyenas).
- Family Viverridae (e.g., civets, genets).
- Family Mephitidae (e.g., skunks).
- Family Herpestidae (e.g., mongooses).

- Any federal or state endangered or threatened species.
- Class Mammalia.
- Person. Any person, firm, partnership, association, corporation, company, or organization of any kind.
- Possess. To own, possess, keep, harbor, or have custody or control of an animal.
- Wild Animal. Those species of animal that are not typically domesticated by humans and usually live in nature. Wild animals include, but are not limited to, animals belonging to any or all of the following orders and families.
- Intent. It is the intent of the City of West Allis to protect the public against health and safety risks that wild animals pose to the community. By their very nature, wild animals are potentially dangerous and do not adjust well to a captive environment.
- Possession of Wild Animals. No person shall possess a wild animal.
- Exceptions. This subsection shall not apply to institutions accredited by the American Zoo and Aquarium Association, licensed veterinarians, licensed veterinary hospitals or clinics, licensed circuses, licensed or accredited research or medical institutions, licensed or accredited educational institutions, an animal certified as having been specially trained to assist an individual with a disability, any government-owned or -operated facility, volunteers working on behalf of a government-owned or -operated facility, a person with a valid federal permit to possess a particular wild animal, or a person temporarily transporting a wild animal through the City if the transit time is not more than twenty-four (24) hours and the wild animal is at all times maintained within a confinement sufficient to prevent the wild animal from escaping.
- Registration. Any person that meets the exceptions listed in Subsection (1)(c) 1 shall register each wild animal that he/she possesses and is kept within the City of West Allis with the Health Commissioner.
- Escape. If a wild animal escapes the possession of a person, the person shall notify the West Allis Police Department immediately of the following information: the type of wild animal; a description of the wild animal, including size, color, and name of the animal; the nature of how the wild animal escaped; the name and address of the wild animal’s owner or custodian; and the location and time where the wild animal was last observed. If the wild animal returns to the possession of a person after notification to the West Allis Police Department, the person shall notify the West Allis Police Department immediately that the wild animal has returned to the person’s possession.
- Costs. Upon the escape of a wild animal, any person possessing such wild animal shall be responsible for the costs of the capture or destruction of the wild animal and any City response to the report of escape.
- Keeping of Ferrets. All domestic ferrets kept or harbored in the City of West Allis shall be vaccinated against rabies in compliance with the Compendium of Animal Rabies Control of the National Association of State Public Health Veterinarians. Upon request by a law enforcement officer or employee of the West Allis Health Department, the person owning or keeping the ferret shall demonstrate proof of vaccination.

Keeping of animals within village.
(a) Permitted animals. No animal that is not a domesticated animal may be kept or brought into the village except in accordance with this chapter or as otherwise authorized by the village manager.
(b) Certain animals prohibited.
- Except as otherwise provided in this chapter, no person shall keep within the village, either temporarily or permanently, any live bees or chickens (except pursuant to a permit), fowl, cows, cattle, horses, sheep, swine, goats, ducks, turkeys, geese or any other domesticated livestock, provided, however, that such animals or fowl may be kept at places approved by the village for educational purposes, research purposes and for circuses or similar recreational events.
- No person may bring into or keep in the village an animal that a Wisconsin city, village, town or county has declared dangerous or vicious, has banished from the city, village, town or county or has ordered to be destroyed. The village manager may declare such an animal to be a prohibited dangerous animal in the village upon receipt of an official written declaration from the other city, village, town or county setting forth the grounds for the declaration, the name of the animal, if known, and the description of the animal.
- No person may bring into or keep in the village, for sale or otherwise, either for food or for any other purposes whatever, any animal dead or alive, bird, insect, reptile or fish which is dangerous or detrimental to health.
(c) Number permitted. No person may keep, harbor, shelter or possess at any time more than three dogs or cats or any combination thereof which are over the age of five months unless the person holds a valid animal fancier permit, kennel permit, pet shop permit or grooming establishment permit. No person in a multiple dwelling shall be granted an animal fancier permit. There shall be no more than one animal fancier permit issued to any qualified dwelling unit.
(d) Animal removal. Either the village or a humane society may confiscate and remove animals from a premises for violation of subsections (a), (b) and (c) of this section or section 8-16. The village may convey such animals to a humane society to be housed and handled appropriately. If necessary, such animals may be disposed of in a humane manner by the village, humane society or a designee of either.

Sec. 6-11. – Certain animals prohibited.
(a) No person shall harbor, raise, or possess, either temporarily or permanently, a wild animal, including, but not limited to, a live monkey or other nonhuman primate, bat, raccoon, skunk, coyote or coyote-dog hybrid, fox, prairie dog, poisonous reptile, or snake, poisonous insect or arachnid, cheetah, cougar, jaguar, leopard, lion, lynx, panther, tiger or hybrids thereof, wolf or wolf-dog hybrid, or any other animal or bird of prey which can normally be found in the wild state.
(b) No swine, goat, sheep, horses, ponies, mules, donkeys, bees, chickens, turkeys, geese, cattle or fur-bearing animals shall be kept or harbored within the village except on such lots where the pursuit of agriculture is permitted principal or accessory use.
(c) This section shall not be construed to apply to temporary educational events, circuses, or similar recreational events, or to animals in the custody of a veterinarian for treatment.

Village of Greendale
9.08(4) Keeping of animals and fowl within the Village limits.
(a) No person or persons living, lodging, cooking or eating together in a residence or residential unit, and no person or persons owning or operating any agricultural business, office or manufacturing use shall keep or harbor a number of dogs and/or cats over the age of 12 weeks which added together total no more than three animals, except upon issuance of a special permit per Subsection (b) below.
(b) Special permit. The Village Manager may issue a special permit to keep or harbor up to one or more dog or cat than allowed by Subsection (a) above, subject to the following application procedure and requirements:
- The application must be filed with the Village Clerk along with payment of the special permit fee as established by the Village Board from time to time. The application shall be filed and the fee shall be paid for each year that the special permit is sought to be issued or renewed.
- The Village Manager may issue the special permit if the Village Manager determines that the issuance of such special permit will not be inimical to the public health, safety and welfare and the maintenance of a harmonious residential neighborhood.
- The Village Manager may impose conditions upon the issuance of the special permit to ensure compliance with the standards of this section.
- If granted, such special permit shall be valid for one year from the date of issuance. If the holder of the special permit seeks to renew the special permit, a new application must be submitted to the Village Clerk and it is the applicant’s responsibility to ensure that it is submitted at least 30 days before the expiration of the prior permit.
- Such special permit may be revoked or not renewed by the Village Manager in the event that the Village Manager finds the continuance of such special permit would injure public health, safety or welfare, or be inimical to harmonious residential neighborhood life, or upon finding that the special permit holder failed to abide by the required terms of the special permit.
- All dogs and cats kept under the conditions of a special permit shall be licensed in the regular manner.
- Upon termination or expiration of the special permit the person keeping or harboring the animals shall immediately bring the property into compliance with Subsection (a) above.
(c) Except as otherwise provided herein, no person shall keep within the Village, either temporarily or permanently, any bees, pigeons, fowl, cows, cattle, horses, sheep, swine, goats, chickens, ducks, turkeys, geese or any other domesticated livestock; provided, however, that such animals or fowl may be kept at places approved by the Public Health Administrator/Health Officer for educational purposes, for research purposes, for circuses and similar recreational events and may be kept within residential or agricultural districts as permitted in the Zoning Code. No rabbits or guinea pigs shall be kept within any portion of any multiple dwelling.

Village of Hales Corners
§ 174-12 Prohibited and protected animals, fowls, reptiles and insects.
(A) Protected animals.
- Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess, possess with intent to sell or offer for sale, or buy or attempt to buy, within the Village, any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (Thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (canis lupus), sea otter (enhydra lutis), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas), or Mexican ridley turtle (lepidochelys kempi).
- Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into this Village any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
(B) Exceptions. The provisions of Subsection A above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collector’s permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
(C) Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any poisonous reptile or any other dangerous or carnivorous wild animal or hybrid thereof, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall constitute a public nuisance and be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any of the following animals, reptiles or insects:
- All poisonous animals and reptiles, including rear-fang snakes.
- Apes; chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia) 30 inches in length or more.
- Constrictor snakes six feet in length or more.
- Coyotes (Canis latrans).
- Deer (Cervidae); includes all members of the deer family; for example, white-tailed deer, elk, antelope and moose.
- Elephants (Elephas, Loxodonta).
- Gamecocks and other fighting birds.
- Hippopotami (Hippopotamidae).
- Hyenas (Hyaenidae).
- Jaguars (Panthera onca).
- Leopards (Panthera pardus).
- Lions (Panthera leo).
- Lynxes (Lynx).
- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Pumas (Felis concolor); also known as “cougars,” “mountain lions” and “panthers.”
- Rhinoceroses (Rhinocero tidae).
- Sharks (class Chondrichthyes).
- Snow leopards (Panthera uncia).
- Tigers (Panthera tigris).
- Wolves (Canis lupus).
- Poisonous insects.
- Horses, mules, ponies, donkeys, llamas, cows, pigs, goats, sheep, ducks, chickens or farm animals if not included aforesaid or any animal raised for fur-bearing purposes unless otherwise permitted under this section.
(D) Exceptions; pet shops. The prohibitions of Subsection C above shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; photo studios conducting seasonal portraitures; or zoological gardens, if:
- Their location conforms to the provisions of Chapter 445, Zoning, of this Code.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.

Section 2.17 – ANIMALS, PROHIBITED AND NUISANCE.
(1) No person shall harbor, raise or possess, either temporarily or permanently, a wild animal, including but not limited to a live monkey or other nonhuman primate, bat, raccoon, skunk, coyote and coyote-dog hybrids, fox, prairie dog, poisonous reptile, or snake, poisonous insect or arachnid, cheetah, cougar, jaguar, leopard, lion, lynx, panther, tiger or hybrids thereof, wolf and wolf-dog hybrids or any other animal or bird of prey which can normally be found in the wild state. No swine, goat, sheep, mules, donkeys, turkeys, geese, cattle, or fur bearing animals shall be kept or harbored within the Village, except goats are permitted for temporary periods of time not to exceed two months for grazing to manage or control invasive species upon notice to the Village Manager. § 192-17 Keeping of certain animals prohibited.
(A) No person, business or entity shall harbor, raise or possess, either temporarily or permanently, any wild animal, including but not limited to, a live monkey or other nonhuman primate, bat, raccoon, skunk, coyote and coyote-dog hybrids, fox, prairie dog, poisonous reptile, alligator, crocodile, or snake, poisonous insect or arachnid, bobcat, cheetah, cougar, jaguar, leopard, lion, lynx, panther, tiger or hybrids thereof, wolf and wolf-dog hybrids or any other animal or bird of prey which can normally be found in the wild, within the Village.
(B) No person, business or entity shall harbor, raise or possess, either temporarily or permanently, any swine, goat, sheep, horses, ponies, mules, donkeys, bees, chickens, turkeys, geese, cattle or fur-bearing animals within the Village.
(C) No person, business or entity shall harbor, raise or possess, either temporarily or permanently, any animal or animals of any kind, breed or nature whatsoever within the Village which, by its nature or conduct, may or in fact does constitute either a private or public nuisance.
(D) This section shall not be construed to apply to temporary educational events, circuses, or similar recreational events, or to animals in the custody of a veterinarian for treatment.

Village of West Milwaukee
Sec. 10-4. – Keeping animals within the village.
(a) Permitted animals. No animal that is not a domesticated animal may be kept or brought into the village, except as provided elsewhere in this chapter.
(b) Certain animals prohibited.
- Except as otherwise provided in this chapter, no person shall keep within the village, either temporarily or permanently, any live bees, fowl, cows, cattle, horses, sheep, swine, goats, or any other domesticated livestock, provided, however, that such animals or fowl may be temporarily kept at places approved and licensed by the village for slaughtering, educational purposes, research purposes and for animal shows or displays or similar recreational events which have been properly licensed. Upon approval by the village, horses owned and used by law enforcement agencies may be kept within the village.
- No person may bring into or keep in the village, an animal that a Wisconsin city, village, town or county has declared dangerous or vicious, has been banished from a city, village, town or county, or has been ordered to be destroyed. An officer may declare such an animal to be a prohibited dangerous animal in the village, upon receipt of an official written declaration from the other city, village, town or county setting forth the grounds for the declaration, the name of the animal, if known, and a description of the animal.
- No person may bring into or keep in the village, for sale or otherwise, either for food or for any other purposes whatsoever, any animal which, in accordance with the recommendations of the Compendium of Animal Rabies Control from the National Association of State Public Health Veterinarians, Inc., is not able to be effectively vaccinated against rabies, or any animal dead or alive, insect, which is otherwise dangerous or detrimental to health, any exotic animal or wild animals.
- No commercial or private stables or kennels shall be permitted in the village.
(c) Number permitted. No person may keep, harbor, shelter or possess at any time, more than two dogs or cats or any combination thereof, which are over the age of three months, unless the person holds a valid animal fancier permit, pet shop permit or grooming establishment permit or a permit allowing an “other type of animal related business”. The keeping of more than two dogs or cats over the age of three months per dwelling unit in a multiple dwelling is declared to be a nuisance. No person in a multiple dwelling shall be granted an animal fancier permit. There shall be no more than one animal fancier permit issued to any qualified dwelling unit.
(d) Animal removal. Any officer as defined at section 10-1 may seize and remove animals from a premises for violation of subsections (a), (b) or (c) or sections 10-23, and 10-31. The officer(s) may convey such animals to the Milwaukee Area Domestic Animal Control Commission to be housed and handled appropriately. If necessary, and subject to the requirements of Wis. Stats. § 173, such animals may be disposed of in a humane manner by the department, M.A.D.A.C.C. or their designee.
(e) State and federal permits. Except as noted elsewhere in this chapter, there are no exceptions to the provisions which restrict or prohibit the keeping of certain animals in the village. Possession of a state or federal permit does not exempt the permit holder from those restrictions or prohibitions.
Sec. 10-6. – General animal control provisions and restrictions.
Other provisions of this chapter notwithstanding, it shall be a violation of this chapter for the owner or caretaker of an animal to do or to permit any of the following within the village:
- To allow an animal to pursue a motor vehicle, bicycle or other type of vehicle whether motorized or not on public property;
- To have an animal that kills, wounds, threatens or assaults any person or domestic animal;
- Use any animal for the purpose of causing or encouraging the animal to attack human beings or domestic animals;
- Permit or allow any animal to be at large within the meaning of Wis. Stats. § 174.042(1);
- To abandon an animal on public or private property;
- To own or have in one’s possession any unlicensed dog or cat older than five months;
- Bring in to or keep in the village, any animal which is prohibited, prohibited dangerous or exotic as described or defined anywhere in this chapter;
- Own, keep, have in his or her possession, or harbor any bird or animal which by frequent and habitual howling, yelping, barking or otherwise, shall cause serious annoyance or disturbance to persons in the neighborhood. No persons may be convicted under the provisions of this section except upon testimony of one or more adult persons;
- Display, give away or sell baby chicks or ducklings or any other young domestic or nondomestic fowl as pets or novelties;
- Sell live turtles with a carapace length of less than four inches as pets or novelties;
- Raffle or give as a prize or premium, any live animal;
- Keep rabbits or guinea pigs within any portion of any multiple dwelling.
