City of Gillett
§ 6-14 Keeping of animals and fowl.
- Sanitary requirements. All structures, pens, buildings, coops or yards wherein animals are kept shall be maintained in a clean and sanitary condition, free of rodents, vermin and objectionable odors.
- Animals excluded from food-handling establishments. No person shall take or permit to remain any animal, except for a service animal, upon any premises where food is sold, offered for sale or processed for consumption by the general public.
- Animals excluded from within the City limits. No pig, except for a Vietnamese pot-bellied pig, horse, mule, donkey, pony, cow, goat, sheep, poultry, wild animal, venomous snake, or animal raised for fur-bearing purposes shall be kept within the City.
- Limitation on rabbits, guinea pigs and pigeons. Not more than two each of rabbits or guinea pigs more than four months old nor more than 10 pigeons shall be kept on any premises within the City.
- Exception. Notwithstanding whatever may be provided in Subsections C and D above, persons shall be allowed to have animals on City park property during special events, such as the Oconto County Youth Fair, dog shows, circuses and similar-type events, for not longer than a four-day period.

Sec. 7-1-6.4. – Animal Control – Exotic Animals.
- Requirements.
- The keeping of carnivores such as tigers, lions, cheetahs, leopards and other wild cats and other species such as snakes, alligators, bears, wolves, foxes, coyotes, or nonhuman primates shall require a permit. Annual inspection of the premises at which the animals are kept will be conducted at the discretion of the animal control agency. Permits will be issued for all or part of a calendar year and must be renewed at least fifteen (15) days prior to the expiration date.
- Certification of experience or proof of attendance at a recognized husbandry course covering the species involved and permanent identification of each animal by microchip are required to obtain a permit.
- Housing, including perimeter fencing surrounding interior pens and buildings, shall provide a safe and secure environment appropriate to the species. Exotic animals that may pose a threat to humans or pets must be confined behind a locked fence of sufficient height and materials to securely contain the animal and prevent risk to the animal and public.
- The keeping of poisonous snakes and rare or endangered species listed by the state is prohibited without a permit from the state department of wildlife and registration with the local jurisdiction.
- The keeping of rare or endangered species listed by the Federal government is regulated by Federal law.
- Exotic animals must be under the control of a legally competent person at all times.
- The keeping of exotic animals for exhibit or educational purposes is governed by the U.S. Department of Agriculture. Owners and exhibitors must also abide by State and local laws requiring permits, identification, and housing.
- Transporting Exotic Animals. Exotic animals must be confined in a crate in a closed, locked vehicle to prevent opportunities for escape and in a manner sufficient to prevent children from coming into contact with the animal through an open window in the vehicle.
- Procedure When Exotic Animals Run At Large.
- Owners must notify the authorities of the escape of an exotic animal that poses a threat to people, pets, or the environment immediately after the escape is discovered.
- Depending on the circumstances of the escape and the threat posed, the exotic animal may be returned to the owner, held until the facility passes inspection, or confiscated or killed.
- Owners who deliberately or negligently allow exotic animals to escape into the environment will be prosecuted.

City of Oconto Falls
§ 168-12 Prohibited and protected animals, fowl, reptiles and insects.
- Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the City of Oconto Falls any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family Felidae, polar bear (Thalarctos maritimus), red wolf (Canis niger), vicuna (Vicugna vicugna), or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (Canis lupus), sea otter (Enhydra lutris), Pacific ridley turtle (Lepidochelys olivacea), Atlantic green turtle (Chelonia mydas), or Mexican ridley turtle (Lepidochelys kempi).
- Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into the City of Oconto Falls any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of Subsection A above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institution of higher learning, or persons holding federal permits, or by a person holding a scientific collector’s permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
- Prohibition on keeping wild animals. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City of Oconto Falls any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile or any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any of the following animals, reptiles or insects:
- All poisonous animals and reptiles, including rear-fang snakes.
- Apes: chimpanzees (Pan), gibbons (Hylobates), gorillas (Gorilla), orangutans (Pongo) and siamangs (Syinphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), 20 inches in length or more.
- Constrictor snakes, three feet in length or more.
- Coyotes (Canis latrans).
- Deer (Cervidae). Includes all members of the deer family; for example, white-tailed deer, elk, antelope and moose.
- Elephants (Elephas and Loxodonta).
- Gamecocks and other fighting birds.
- Hippopotami (Hippopotamidae).
- Hyenas (Hyaenidae).
- Iguanas.
- Jaguars (Panthera onca).
- Leopards (Panthera pardus).
- Lions (Panthera leo).
- Lynxes (Lynx).
- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Piranha fish (Characidae).
- Pumas (Felis concolor), also known as cougars, mountain lions and panthers.
- Rhinoceroses (Rhinocero tidae).
- Sharks (class Chondrichthyes).
- Snow leopards (Panthera uncia).
- Tigers (Panthera tigris).
- Wolves (Canis lupus).
- Poisonous insects.
- Bees, wasps and hornets.
- Except in properly zoned districts, horses, mules, ponies, donkeys, cows, pigs, goats, sheep, chickens, alligators or any animal raised for fur-bearing purposes unless otherwise permitted elsewhere in this Code.
- Exceptions; pet shops. The prohibitions of Subsection E above shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; or zoological gardens if:
- Their location conforms to the provisions of Chapter 480, Zoning, of the City Code.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept, unless a special permit is obtained from the City. Exception: Chicken coops may be within 10 feet of buildings; must comply with Chapter 480, Article XI, Accessory Uses and Structures.
- Licensing and keeping of chickens. Chickens (hens only) may be kept in accord with the following requirements and standards:
- License. Prior to establishing the use, a license shall be obtained from the City Clerk for the keeping of chickens and the construction of the coop and related fencing. The application for the license shall include a location sketch of the coop and fencing, showing property lines and nearby structures. A fee shall be paid with submittal of the application in accord with the City’s Fee Schedule.
- Limitation.
- No person or persons may keep more than six chickens, or any combination of those exceeding six in number, per dwelling unit. Chickens shall be hens only; no roosters.
- Shelter and fencing. (See also City Code § 480-83, Accessory structure.) Chickens shall be kept in a coop and shall have an adjacent fence-enclosed area. The coop and fenced area shall be located in the rear yard only. The coop and fenced area shall not exceed 50 square feet in area or eight feet in height. The coop and fenced area shall not be closer than 10 feet to any lot line. Such facilities shall not conflict with any public or private utilities, drainage facilities or any easements related thereto.
- Public nuisance. Keeping Chickens shall not cause a public nuisance due to noise, odors, unsanitary conditions or any operational features. The City may take enforcement actions as necessary to abate any public nuisances in accord with public nuisance ordinance.
- Personal use only. The keeping of chickens shall be for the personal use of the owner. There shall be no business operations wherein the owner receives any compensation or trade for eggs, meat or the sale of chickens.
- Deed restrictions or covenants. It shall be the property owner’s responsibility to verify that keeping of chickens are permitted uses in any deed restrictions or covenants applicable to the subject property.
- Penalty. Any person who violates this section shall be subject, on conviction, to a forfeiture in the amount of not less than $50 nor more than $500, plus costs and fees imposed by law. Each day a violation continues or occurs shall constitute a separate offense. Repeated or ongoing violations may result in destruction of chickens.

- KEEPING OF EXOTIC SPECIES PROHIBITED. No person shall possess an exotic animal in the Village.
- PROHIBITED SPECIES LIST. The following orders and families of species, whether bred in captivity or the wild, and any and all genetic hybrids thereof shall be classified as an “Exotic Species” for purposes of the provisions of Sec. 30.12(a):
- Class Mammalia
- Order Chiroptera (any bat species)
- Order Artiodactyla (hippopotamuses, giraffes, camels, deer). Excludes domestic cattle, swine, sheep, goats, alpaca and llama.
- Order Carnivora.
- Family Felidae (lions, tigers, cougars, leopards, ocelots, servals). Excludes domestic cats.

No person, firm, or corporation shall bring into, kept, maintain, offer for sale, or barter, or release to the wild in the Town:
- any poisonous or venomous biting or injecting species or amphibian, arachnid or reptile (including snakes);
- any snake not indigenous to Wisconsin;
- any snakes indigenous to Wisconsin of the following species, upon attaining a length of five (5) feet or more:
- The pilot black snake (Elaphe obsoleta obsoleta).
- Bull snake (Pituophis melanoleucus).
- Fox snake (Elaphe vulpine gloydi).

4.0101 – Wild, Exotic, or Vicious Animals as Pets
- PURPOSE. The purpose of this ordinance is for the town to regulate by permit and penalty the possession, display, sale, purchase, and exhibition of certain harmful wild animals and exotic or wild animals in the town.
- AUTHORITY. The town board has the specific authority under Wis. Stats. § 169.43, and general authority under its village powers under Wis. Stats. § 60.22, to adopt this ordinance.
- DEFINITIONS. In this ordinance:
- “Bovine animal” means domestic cattle and American bison of any age or sex.
- “Cattle” means any of the various animals of the domesticated genus Bos.
- “Cervid” means a member of the family of animals that includes deer, elk, moose, caribou, reindeer, and the subfamily musk deer. “Cervid” includes all farm-raised deer.
- “Circus” means a scheduled event staged by a traveling company with mobile facilities in which entertainment consisting of a variety of performances by acrobats, clowns, or trained animals is the primary attraction or principle business.
- “Domestic animal” means any of the following:
- Domesticated cats of the subspecies Felis silvestris catus.
- Domesticated dogs of the subspecies Canis lupus familiaris.
- Rodents kept in cages, aquariums, or similar containers, including gerbils, hamsters, guinea pigs, and white mice.
- Fish kept in aquariums or self-contained bodies of water and farm-raised fish, except fish that have been released to waters of the state.
- Farm-raised deer that are kept by a person registered under Wis. Stas. §95.55.
- Livestock.
- Poultry.
- Farm-raised game birds, except farm-raised game birds that have been released to the wild.
- Ratites.
- Foxes, fitch, nutria, marten, fisher, mink, chinchilla, rabbit, or caraculs that are born, bred, and raised in captivity and are not endangered or threatened species.
- Pet birds.
- Any other animal listed as a domestic animal by rule by the Wisconsin Department of Agriculture, Trade and Consumer Protection.
- “Equine animal” means a horse, mule, zebra, donkey, or ass.
- “Exotic or wild animal” means any animal that is not a domestic animal and specifically includes all of the following:
- Nonhuman primates and prosimians, including chimpanzees and monkeys.
- Felids, except domesticated cats of the subspecies Felis silvestris catus, including lions, tigers, and other felids generally referred to as big cats.
- Canids, except domesticated dogs of the subspecies Canis lupus familiaris, including foxes not born, bred, and raised in captivity, and all wolves, coyotes, and wolf hybrids.
- Ursids, including all bears.
- Elephants.
- Crocodilians, including alligators and crocodiles.
- Marsupials, including kangaroos, wallabies, and opossums.
- Hippopotami.
- Rhinoceroses.
- Hyenas.
- Mustelids, except domestic ferrets, including skunks, otters, and badgers.
- Procyonids, including raccoons and coatis.
- Dasypodidae, including anteaters, sloth, and armadillos.
- Viverrids, including mongooses, civets, and genets.
- Reptilia over 10 feet in length, including boa constrictors, pythons, and any other snakes.
- Venomous reptilia.
- Cervids, except farm-raised deer that are kept by a person registered under Wis. Stats. § 95.55.
- Camelids, except South American camelids.
- “Farm-raised deer” means a captive cervid but includes a non-captive cervid that has an ear tag or other mark identifying it as being raised on a farm. “Farm-raised deer” does not include a cervid kept by an institution accredited by the American association of zoological parks and aquariums.
- “Farm-raised game bird” means a captive bird of a wild nature that is not native. “Farm-raised game bird” does not include poultry or ratites, or birds kept pursuant to a license issued under Wis. Stats. §§ 169.15, 169.19, 169.20, or 169.21.
- “Harmful wild animal” means members of the family ursidae commonly known as bears, the species Felis concolor commonly known as cougars, and any other animal designated as a harmful wild animal under Wisconsin Statutes, or by rule of the Wisconsin Department of Natural Resources.
- “Livestock” means bovine animals, equine animals, goats, poultry, sheep, swine other than wild hogs, farm-raised deer, farm-raised game birds, South American camelids, and ratites.
- “Pet bird” means a psittacine or softbill that is not native, is not identified on the federal list of endangered and threatened species and is not a migratory bird.
- “Poultry” means domesticated fowl, including chickens, turkeys, and waterfowl, that are bred for the primary purpose of exhibition or producing eggs or meat. “Poultry” does not include ratites.
- “Possess” means to own, control, restrain, transport, or keep.
- “Public zoo or aquarium” means a zoo or aquarium that is an accredited member of the American Zoo and Aquarium Association.
- “Ratite” means a member of the group of flightless birds that includes the ostrich, emu, cassowary, kiwi, and rhea.
- “Self–contained body of water” means a body of water that has no inlet from or outlet to a natural body of water, except that it may have pipes or similar conduits to put in or withdraw water that are equipped with barriers that prevent the passage of fish between the body of water and the other waters of the State of Wisconsin.
- “South American camelid” means a llama, alpaca, vicuñ a, or guanaco.
- “Veterinarian” means a person who is licensed in the State of Wisconsin to practice veterinary medicine under Wis. Stats. ch. 453, and who is certified under rules promulgated by the Wisconsin Department of Agriculture, Trade and Consumer Protection.
- AUTHORIZED POSSESSION.
- The following persons may possess exotic or wild animals in the town:
- A person licensed by the Wisconsin Department of Natural Resources under Wis. Stats. ch. 169.
- A veterinarian, for the purpose of providing medical treatment to the animal.
- A public zoo or aquarium, with a permit issued by the town.
- A circus, with a permit issued by the town.
- A person authorized by the Wisconsin Department of Natural Resources for the possession of the specific type of harmful wild animal or exotic or wild animal in the town.
- Except as provided in Section 4.0309(D)(3) , any person not included in Section 4.0309(D)(1) may possess in the town an exotic or wild animal only with a permit issued by the town board under the specific conditions established by the town board.
- A person is exempt from holding a license or other approval under Wis. Stats. § 169.04(4), or any permit from the town, to possess live native wild animals, if these wild animals are not endangered or threatened species and are any of the following:
- Arthropods.
- Chipmunks.
- Pocket gophers.
- Mice.
- Moles.
- Mollusks.
- Opossums.
- Pigeons.
- Porcupines.
- Rats.
- Shrews.
- English sparrows.
- Starlings.
- Ground squirrels.
- Red squirrels.
- Voles.
- Weasels.
- The following persons may possess exotic or wild animals in the town:
- EXHIBITION OF CERTAIN ANIMALS.
- No person may without a permit issued under Section 4.0309(F) display in the town for the purpose of public viewing any exotic or wild animals or harmful wild animals.
- This section shall not apply to any of the following:
- Persons that have received a license or authorization from the Wisconsin Department of Natural Resources under Wis. Stats. ch. 169.
- A public zoo or aquarium, with a permit issued by the town board.
- A veterinarian, for the purposes of providing medical treatment to the animal.
- A circus with permits issued by the town board.
- PERMITS.
- No person may exhibit, possess, sell, or purchase an exotic or wild animal or harmful wild animal in the town without a written permit from the town board.
- The applicant for a permit shall submit an application that contains all of the following:
- The name of the applicant, any agent of the applicant, and the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
- The address of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased.
- The business and residential telephone number of the applicant, the business and residential telephone number of any agent of the applicant, and the business and residential telephone number of the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
- The age of the applicant and of the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
- The legal description of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased.
- The manner, if any, of keeping the exotic or wild animal or harmful wild animal.
- The type and number of wild animals or harmful wild animals, if more than one, that will be exhibited, possessed, sold, or purchased.
- Any other items requested by the town board in writing.
- No permit for the display, possession, sale, or purchase in the town of an exotic or wild animal or a harmful wild animal shall be issued by the town board until a public hearing is held by the town board on the application for a permit. The town clerk-treasurer shall publish a notice of hearing as a class 2 notice under Wis. Stats. ch. 985, the cost of which shall be paid by the permit applicant. The town board may, after the public hearing, issue a permit in writing only if it determines that the exhibition, possession, sale, or purchase in the town proposed by the applicant will not constitute a public nuisance or a threat to health and safety of the residents of the town. The town board may include in the permit specific conditions to protect public health and safety and to prevent a public nuisance. A permit shall be for a fixed period determined by the town board and is subject to revocation in the event of the violation of the conditions of the permit or this ordinance after an applicable public hearing and notice and determination, as provided in this subsection for an initial permit application. Upon a determined emergency condition in the town, the town board may suspend the permit without a hearing.
- PROHIBITION. No person may permit an exotic or wild animal or a harmful wild animal to run at large or to be released from captivity within the town. Any exotic or wild animal or harmful wild animal running at large shall be subject to seizure, detention, and disposal.
- PENALTY PROVISION. Any person, partnership, corporation, or other legal entity that fails to comply with the provisions of this ordinance shall, upon conviction, pay a forfeiture of not less than $20.00, plus the applicable surcharges, assessments, and costs for each violation. Each day a violation exists or continues constitutes a separate offense under this ordinance. In addition, the town board may seek injunctive relief from a court of record to enjoin further violations.

Harmful & Exotic Wild Animal Ordinance
SECTION I – TITLE AND PURPOSE
The title of the ordinance is the Town of Townsend “Harmful and Exotic Wild Animal Ordinance”. The purpose of this ordinance is for the town to regulate by permit and penalty the possession, display, sale, purchase and exhibition of certain harmful wild animals and exotic of wild animals in the town.
SECTION II – AUTHORITY
The Town Board of the Town of Townsend has the specific authority under 5,169.43, Wis. stats., and general authority under its town powers under 5.60.22, Wis. stats., to adopt this ordinance.
SECTION III – ADOPTION OF ORDINANCE
This ordinance, adopted by a majority of the Town Board on a roll call vate with a quorum present and voting and proper notice in having been given, provides for the regulation by permit of the possession, display, sale, purchase, and exhibition of certain harmful animals or exotic or wild animals within the town.
SECTION IV – DEFINITIONS
In this ordinance:
- “Bovine animal” means domestic cattle and American bison of any age or sex.
- “Cattle” means any of the various animals of the domesticated genus Bos.
- “Cervid” means a member of the family of animals that include deer, elk, moose, caribou, reindeer, and the subfamily musk deer. “Cervid” includes all farm-raised deer.
- “Circus” means a scheduled event staged by a traveling company with mobile facilities in which entertainment consisting of a variety of performances by acrobats, clowns or trained animals Is the primary attraction or principle business.
- “Domestic animal” means any of the following:
- Domesticated cats of the subspecies.
- Domesticated dogs of the subspecies Canis lupus famillaris.
- Rodents kept in cages, aquariums, or similar containers, including gerbils, hamsters, guenea pigs, and white mice.
- Fish kept in aquariums or self-contained bodies of water and farm raised fish, except fish that have been released to waters of the state.
- Farm-raised deer that are kept by a parson registered under s.95.55, Wis.stats.
- Livestock.
- Poultry.
- Farm-raised game birds, except farm-raised game birds that have been released to the wild.
- Ratites.
- Foxes, fitch, nutria, marten, fisher, mink, chinchilla, rabbit, or caracul that are born, bred, and raised in captivity and are not an endangered or threatened species.
- Pet birds.
- Any other animal listed as a domestic animal by rule by the State of Wisconsin, Department of Agriculture, Trade and Consumer Protection.
- “Equine animal” means a horse, mule, zebra, donkey, or ass.
- “Exotic or wild animal” means any animal that is nota domestic animal and specifically includes all of the following:
- Nonhuman primates and prosimians, including chimpanzees and monkeys.
- Felids, except domesticated cats of the subspecies Felis silvestris catus, including lions, tigers, and other elids generally referred to as big cats.
- Canids, except domesticated dogs of the subspecies Canis lupus familaris, including foxes not born, bred, and raised in captivity, and all other wolves, coyotes, and wolf hybrids.
- Ursids, including all bears.
- Elephants.
- Crocodilians, including alligators and crocodiles.
- Marsupials, including kangaroos, wallabies, and opossums.
- Hippopotaml.
- Rhinoceroses.
- Hyenas.
- Musielids, except domestic ferrets, Including skunks, otters, and badgers.
- Procyonlds, including raccoons and coatis.
- Dasypodidae, including anteaters, sloth, and armadillos.
- Viverrids, including mongooses, civets, and genets.
- Reptile over ten (10) feet in length, including boa constrictors, pythons, and any other snakes.
- Venomous reptilia.
- Cervids, except farm-raised deer that ara kept by a person registered under s.95,55 Wis. stats, 18. Camelids, except South American camelids.
- “Farm–raised deer* means a captive cervid, but includes a non-captive cervid that has an ear tag or other mark identifying it as being raised ona farm. “Farm-raised deer” does not include a cervid kept by an Institution accredited by the American Association of Zoological Parks and Aquariums.
- “Farm–raised game bird” means a captive bird of a wild nature that is not native. “Farm-raised game bird” does not include poultry or ratites, or birds kept pursuant to a license issued under ss. 169.15, 169.19, 169,20, or 169,21, Wis, stats.
- “Harmful wild animal” means members of the family ursidae commonly known as bears, the species Felis concolor commonly known as cougars, and any other animal designated as a harmful wild animal under Wisconsin Statutes, or by rule of the State of Wisconsin.
- “Livestock” means bovine animals, equine animals, goats, poultry, sheep, swine other than wild hogs, farm-raised deer, farm-raised game birds, South American camelids, and ratites.
- “Person” means an individual, partnership, firm, joint stock company, corporation, association, trust, estate, or other legal entity.
- “Pet bird” means a psittacine or soft-bill that is not native, is not identified on the federal list of endangered and threatened species, and is not a migratory bird.
- “Poultry” means domesticated fowl, including chickens, turkeys, and waterfowl, that are bred for the primary purpose of exhibition or producing eggs or meat. “Poultry” does not include ratites.
- “Possess” means to own, control, restrain, transport, or keep.
- “Public Zoo or Aquarium” means a 200 or aquarium that is an accredited member of the American Zoo and Aquarium Association.
- “Ratite” means a member of the group of flightless birds that includes the ostrich, emu, cassowary, kiwi, and rhea.
- “Self–contained body of water” means a body of water that has no inlet from or outlet to a natural body of water, except that it may have pipes or similar conduits to put in or withdraw water that are equipped with barriers that prevent the passage of fish between the body of water and the other waters of the State of Wisconsin.
- “South American camelid” means a llama, alpaca, vicuna, or guanaco.
- “Town” means the Town of Townsend, Oconto County, Wisconsin.
- “Town Board” means the board of supervisors for the Town of Townsend, Oconto County, Wisconsin, and includes designees of the board authorized to act for the board.
- “Town Clerk” means the Clerk of the Town of Townsend, Oconto County, Wisconsin.
- “Veterinarian” means a person who is licensed in the State of Wisconsin to practice veterinary medicine under chapter 453, Wis. stats., and who is certified under rules promulgated by the Department of Agriculture, Trade and Consumer Protection.
- “Wis, stats.” means the Wisconsin Statutes, including successor provisions to cited statutes.
SECTION V – SUBDIVISION AND NUMBERING OF THIS ORDINANCE
This ordinance is divided into sections designated by uppercase Roman numerals. Sections may be divided into paragraphs designated by numbers Paragraphs may be divided into subdivision paragraphs designated by lowercase Roman numerals. Reference to a “section,” “subsection,” “paragraph,” or “subdivision” includes all subdivisions of the referenced section, subsection, paragraph, or subdivision.
SECTION VI – AUTHORIZED POSSESSION
- The following persons may possess exotic or wild animals in the town: 1. Aperson licensed by the State of Wisconsin, Department of Natural Resourses under chapter 169, Wis. stats, 2, Aveterinarian, for the purpose pf previding medical treatment to the animal. 3. A public 200, or aquarium, with a permit issued by the town. 4. Acircus, with a permit issued by the town. 5. A person authorized by the State of Wisconsin, Department of Natural Resourses for the passession of the specific type of harmful wild animal or exotic or wild animal in the town;
- Except as provided in subsection C, any person not included in Subsection A may possess in the town an exotic or wild animal only with a permit issued by the town board under the specific conditions established by the town board.
- A person is exempt from holding a license or other approval under s. 169.04(4), Wis, stats., or any permit from the town, to possess live native wild animals, if these wild animals are not endangered or threatened species and are any of the following:
- Anthropods.
- Chipmunks.
- Pocket Gophers.
- Mice.
- Moles.
- Mollusks.
- Opossums.
- Pigeons.
- Porcupines.
- Rats.
- Shrews.
- English Sparrows.
- Starlings.
- Ground Squirrels.
- Red Squirrels.
- Voles.
- Weasels.
SECTION VII -EXHIBITION OF CERTAIN ANIMALS
No person may without a permit issued under Section VIII display in the town for the purpose of public viewing any exotic or wild animals or harmful wild animals.
This section shall not apply to any of the following:
- Persons that have received a license or authorization from the State of Wisconsin, Department of Natural Resources under chapter 169, Wis. stats,
- A public zoo or aquarium, with a permit issued by the town board.
- A veterinarian, for the purposes of providing medical treatment to the animal.
- A circus with permits issued by the town board.
SECTION VIII – PERMITS
No person may exhibit, possess, sell, or purchase an exotic or wild animal or harmful wild animal in the town without a written permit from the town board. The applicant for permit shall submit an application that contains all of the following:
- The name of the applicant, any agent of the applicant, and the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
- The address of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased.
- The business and residential telephone number of the applicant, the business and residential telephone number of the agent of the applicant, and the business and residential telephone number of the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
- The age of the applicant and of the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased if different from the applicant.
- The legal description of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased.
- The manner, if any, of keeping the exotic or wild animal or harmful wild animal.
- The type and number of wild animals or harmful wild animals, if more than one, that will be exhibited, possessed, sold, or purchased.
- Any other items requested by the town board in writing.
No permit for the display, possession, sale, or purchase in the town of an exotic or wild animal or harmful wild animal shall be issued by the town board until a public hearing is held by the town board on the application for a permit. The Town Clerk shall publish a notice of hearing as a class two (2) notice under chapter 985, Wis. stats., the cost of which shall be paid by the permit applicant, The town board may, after the public hearing, issue a permit in writing only if it determines that the exhibition, possession, sale, or purchase in the town proposed by the applicant will not constitute a public nuisance or a threat to specific conditions to protect public health and safety and to prevent a public nuisance. A permit shall be for a fixed period determined by the town board and is subject to revocation in the event of the violation of the permit or this ordinance after an applicable public hearing and notice and determination, as provided in this subsection for an Initial permit application. Upon a determined emergency condition in the town, the town board may suspend the permit without a hearing.
SECTION IX – PROHIBITION
No person may permit an exotic or wild animal or harmful wild animal to run at large or be released from captivity within the town. Any exotic or wild animal or harmful wild animal running at large shall be subject to seizure, detention, and disposal.
SECTION X – PENALTY PROVISION
Any person, partnership, corporation, or other legal entity that fails to comply with the provisions of this ordinance shall, upon conviction, pay a forfeiture of not less than $20,00, plus the application surcharges, assessments, and costs for each violation. Each day’s violation exsists or continues constitutes a separate offense under this ordinance. In addition, the town board may seek injunctive relief from a court of record to enjoin further violations.
SECTION XI – SEVERABILITY
If any provision of this ordinance or its application to any person or circumstances ts held invalid, the invalidity does not affect other provisions or applications of this ordinance that can be given effect without the invalid provision or application, and to this and the provisions ofthi s ordinance are severable.
