City of Appleton

Sec. 3-116. Keeping for exhibition purposes; keeping wild animal as pet.

  1. No person shall exhibit or permit to be kept on their premises or any public place any wild animal for display or exhibition purposes, whether gratuitously or for a fee.
  2. The prohibitions in (a) of this section do not apply when the creatures are in the care, custody or control of a veterinarian for treatment.
  3. Public or private educational institutions, nonprofit organizations, itinerant or transient carnivals, circuses or other theatrical performances may seek, from the Health Officer, a limited exemption from this section provided the display will be of limited duration and meet any other requirements or conditions mandated by the Health Officer. The person or organization having custody and control of any animal permitted by this section shall be responsible for compliance with all other provisions of this chapter while the animal remains within the City limits.
  4. No person shall keep or permit to be kept any wild animal as a pet.

Sec. 3-52. Restricted species.

  1. Except as otherwise permitted within this section, no person shall keep, sell or offer for sale within the City any horses, cows, pigs, goats, sheep, bees, pigeons, chickens, geese, ducks or other fowl or any other domestic animal other than a dog, cat, rabbit, small caged birds, small caged animals or reptiles or aquatic and amphibian animals, kept solely as pets.
  2. Upon obtaining a permit issued by the Health Department, honeybee hives in areas zoned P-I, Public Institutional District; on building rooftops within the Central Business District (CBD), and areas approved as urban farms, may be maintained subject to the requirement and limitations on file with Health Department.
  3. Upon obtaining a permit issued by the Health Department, residential honeybee hives may be maintained subject to the requirements and limitations on file with the Health Department.
  4. Upon obtaining a permit issued by the Health Department, and subject to the requirements and limitations on file with the Health Department, a limited number of pigeons may be maintained by the permit holder.
  5. Upon obtaining a permit issued by the Health Department, and subject to the Rules and Regulations for hen keeping, up to six (6) chicken hens may be maintained by the permit holder. The Rules and Regulations for chicken hen keeping shall be on file in the Health Department. The permit will allow up to six (6) chicken hens at all one- (1-) and two (2-) family dwellings.

11.12 Keeping Of Goats, Pigs, Rabbits, Fowl, And Bees

  1. No person shall keep or harbor any reptiles, pigs, sheep, goats, cattle, horses, ducks, geese, bees, or hives of bees within the corporate limits of the city. No person shall keep or harbor any pigeons, doves, or game birds, or build, erect, or maintain and use on any lot or parcel of land within the city limits any building or yard for the purpose of keeping or housing pigeons, doves, or other fowl without first obtaining a written permit from the city board of health and payment of the fee of $5.00 for a two-year period. The issuance of such written permit shall depend upon the compliance of the applicant with standards of health and sanitation as set down by the city board of health, and such premises shall be at all times open to inspection to representatives of such board.
  2. No person shall possess, keep, or harbor rabbits in the city as a commercial enterprise. No more than four rabbits shall be permitted to be kept as pets in a household at any time. No person shall keep, possess, or harbor pet rabbits without first obtaining a written permit from the board of health and payment to the city of a $5.00 fee for a two-year period. No permits shall be issued except upon compliance with standards specified by the city board of health.
  3. No person shall possess, keep, or harbor chickens in the city as a commercial enterprise. No person shall possess, keep, or harbor roosters in the city.
    1. Permit required. No person shall possess, keep, or harbor hens or chicks in the city without first obtaining a chicken keeping permit, and payment to the city of a $24.00 annual chicken keeping permit fee. No more than a total of six (6) hens and/or chicks shall be permitted to be kept for each chicken keeping permit issued. No more than one chicken keeping permit shall be issued for any property or household.
    2. Permits limited. Not more than ten (10) chicken keeping permits shall be issued and in effect at any one time. Permits shall be issued to the first ten (10) applicants evidencing conformance with all requirements set forth in this section 11.12(3).
    3. Property requirements. A coop shall be located only in the rear yard. Coops shall be located not less than 50 feet from any side and rear lot lines, and shall be a minimum of 100 feet from any dwelling structure and a minimum of 25 feet from any public sidewalk
    4. Property requirement exceptions for those properties or coop locations that do not meet the setback requirements as set forth in paragraph (4)(c). When prior written approval is provided from all abutting property owners that have an occupied dwelling unit within 100 feet of proposed coop location the following coop location requirements shall apply: A coop shall be located only in the rear yard. Coops shall be located not less than ten feet from any side and rear lot lines, and shall be a minimum of 25 feet from any dwelling structure or public sidewalk.
    5. New dwellings, new owners. If a new dwelling unit is built upon, or if a new owner purchases, abutting property after permit is issued, the permit holder shall be responsible for meeting all requirements set forth in this section, and shall be required to move the coop, obtain written authorization of abutting property owners that have an occupied dwelling unit within 100 feet, or remove the coop from the premises within 30 days of non-compliance resulting from such new dwelling unit or new ownership.
    6. Coop requirements. All chickens shall be kept in a ventilated and roofed coop with the floor area of not less than three (3) square feet for each hen. All coops must include an enclosed run area, and all components of the coop shall be enclosed with wire netting or material that prevents chickens from escaping the coop and of adequate structure to prevent predators from entering the coop. All coops must be kept in clean and sanitary condition, and shall not cause any objectionable odor. Chickens shall not be kept upon a vacant lot, inside a residential dwelling unit or attachments thereto, including basements, garages, porches, sheds or other similar structures. Chickens shall not be allowed within a residential dwelling unit.
    7. Permit subject to review. Premises shall be subject to review by City personnel. Where deficiencies in compliance with this section are noted upon review and/or inspection, permits may be revoked. Upon revocation or expiration of a non-renewed annual chicken keeping permit coops shall be removed within 30 days of such revocation or expiration. If the permit holder, owner or occupant fails or refuses to remove the coop within 30 days of such revocation or expiration, the city shall enter upon the premises and cause the coop and any animals therein to be removed and the city shall recover the costs and expenses thereof from the property owner, occupant, or permit holder. In addition to any other penalty imposed by this, the cost of abating a non-compliant coop by the City shall be collected as a debt from the owner, occupant, or permit holder, and if notice to abate the nuisance has been given to the owner, such cost shall be assessed against the real estate as a special charge.

§ 108-14: Prohibited and protected animals.

  1. Protected animals.
    1. Possession and sale of protected animals. It shall be unlawful for any person, firm, or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the Village any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas), or Mexican ridley turtle (lepidochelys kempi).
    2. Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian, or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
    3. Regulating the importation of certain birds. No person, firm, or corporation shall import or cause to be imported into this Village any part of the plumage, skin or dead body of any species of hawk, owl, or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body, or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
  2. Exceptions. The provisions of Subsection A above shall not be deemed to prevent the importation, possession, purchase, or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collector’s permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
  3. Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any poisonous reptile or any other dangerous or carnivorous wild animal or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any of the following animals:
    1. All poisonous animals and reptiles, including rear-fang snakes.
    2. Apes: chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).
    3. Baboons (Papio, Mandrillus).
    4. Bears (Ursidae).
    5. Bison (Bison).
    6. Cheetahs (Acinonyx jubatus).
    7. Crocodilians (Crocodilia), 30 inches in length or more.
    8. Constrictor snakes, six feet in length or more.
    9. Coyotes (Canis latrans).
    10. Deer (Cervidae); includes all members of the deer family, for example, whitetailed deer, elk, antelope and moose.
    11. Elephants (Elephas and Loxodonta).
    12. Game cocks and other fighting birds.
    13. Hippopotami (Hippopotamidae).
    14. Hyenas (Hyaenidae).
    15. Jaguars (Panthera onca).
    16. Leopards (Panther a pardus).
    17. Lions (Panthera leo).
    18. Lynxes (Lynx).
    19. Monkeys, old world (Cercopithecidae).

    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
    3. Animals are maintained in quarters so constructed as to prevent their escape.
    4. No person lives or resides within 100 feet of the quarters in which the animals are kept.

  5. Farm animals. Cows, horses, pigs, sheep, poultry and other farm animals shall not be kept within the Village limits, unless a conditional use permit under Chapter 390, Zoning, of this Code is obtained.

  2. Exceptions. The provisions of Subsections (a) and (c) herein shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
  3. Wild Animals. No person shall keep or permit to be kept any wild animal as a pet.
  4. Farm Animals. Except as otherwise permitted within this Section, no person shall keep, sell or offer for sale within the Village of Combined Locks any horses, cows, pigs, goats, sheep, bees, pigeons, chickens, geese, ducks or other fowl or any other domestic animal other than a dog, cat, rabbit, small caged birds, small caged animals or reptiles or aquatic and amphibian animals, kept solely as pets.
  5. Wild Animals Kept for Display Purposes. No person shall exhibit or permit to be kept on their premises or any public place any wild animal for display or exhibition purposes, whether gratuitously or for a fee.
  6. Exception for Animals Kept in a Veterinarian’s Care. The prohibitions in Subsection (c) of this Section do not apply when the creatures are in the care, custody or control of a veterinarian for treatment.
  7. Exemptions. Public or private educational institutions, nonprofit organizations, itinerant or transient carnivals, circuses or other theatrical performances may seek, from the Health Officer, a limited exemption from this Section provided the display will be of limited duration and meet any other requirements or conditions mandated by the Health Officer and the location complies with provisions of Title 13 of this Code of Ordinances, pertaining to zoning of the Village. The person or organization having custody and control of any animal permitted by this Section shall be responsible for compliance with all other provisions of this Chapter while the animal remains within the Village limits.
  8. Prohibition on Feeding Deer. No person may place any salt, mineral, grain, fruit or vegetable material outdoors on any public or private property for the purpose of feeding whitetail deer:
    1. Presumption. There shall be a rebuttable presumption that either of the following acts are for the purpose of feeding whitetail deer: a. The placement of salt, mineral, grain, fruit or vegetable material in an aggregate quantity of greater than one-half (1/2) gallon at the height of less than six (6) feet off the ground. b. The placement of salt, mineral, grain, fruit or vegetable material in an aggregate quantity of greater than one-half (1/2) gallon in a drop feeder, automatic feeder, or similar device regardless of the height of the grain, fruit, mineral, or vegetable material.
    2. Exceptions. This Section shall not apply to the following situations:
      1. Hunting. The placement of bait for the purpose of hunting whitetail deer subject to all other laws, ordinances, rules, and regulations governing hunting and the discharge of hunting weapons.
      2. Naturally Growing Materials. Naturally growing grain, fruit, or vegetable material, including gardens and residue from lawns, gardens, and other vegetable materials maintained as a mulch pile.
      3. Bird Feeders. Unmodified commercially purchased bird feeders or their equivalent.
      4. Authorized by the Village Board. Deer feeding may be authorized on a temporary basis by the Village Board for a specific public purpose as determined by the Village Board.

Article IV: Possession of Exotic or Wild Animals

§ 76-23 Intent and purpose.

The Village Board of the Village of Greenville hereby finds that wild animals are inherently dangerous and do not adjust well to captive environment. It is the intent of the Village Board to protect the public against health and safety risks that wild animals pose and hereby prohibit the possession of wild animals with the limits of the Village of Greenville.

§ 76-24 Definitions.

As used in this article, the following terms shall have the meanings indicated:

  • CIRCUS – A scheduled event staged by a traveling company with mobile facilities in which entertainment consisting of a variety of performance by acrobats, clowns or trained animals is the primary attraction or principal business.
  • EXOTIC ANIMAL – Any animal that is not normally domesticated in the United States or is wild by nature.
  • PERSON – An individual, partnership, firm, joint-stock company, corporation, association, trust, estate or other legal entity.
  • POSSESS – To own, control, restrain, transport or keep.
  • PUBLIC ZOO OR AQUARIUM – A zoo or aquarium that is operated by the state or municipality or that is an accredited member of the American Zoo and Aquarium Association.
  • VETERINARIAN – A person who is licensed in this state to practice veterinary medicine under § 89.02 et seq., Wis. Stats., and who is certified under rules promulgated by the Department of Agriculture, Trade and Consumer Protection.
  • WILD ANIMAL – Any of the following animals, whether bred in the wild or in captivity, and also any of their hybrids with domestic species. The animals listed in parentheses are intended to act as examples and are not to be construed as an exhaustive list or limit the generality of each group of animals, unless otherwise specified.
    1. Nonhuman primates and prosimians (chimpanzees, monkeys);
    2. Felids, except domesticated cats;
    3. Canids (wolves, coyotes, foxes) except domesticated dogs;
    4. Prairie dogs;
    5. Elephants;
    6. Crocodilians (alligators, crocodiles);
    7. Marsupials (kangaroos, opossums) except sugar gliders;
    8. Ungulates (hippopotamus, rhinoceros);
    9. Hyenas;
    10. Mustelids (skunks, otters, badgers) except ferrets;
    11. Procyonids (raccoons, coatis);
    12. Dasypodidae (anteaters, sloth, armadillos);
    13. Viverrids (mongooses, civets, genets);
    14. Reptilia over six feet in length (boa constrictor, pythons);
    15. Venomous reptilia.
§ 76-25 Possession of exotic or wild animals.

It shall be unlawful for any person to possess, sell or purchase an exotic or wild animal.

§ 76-26 Exceptions.

The following persons or entities may possess exotic or wild animals:

  1. A person licensed by the state under Wis. Stats. Ch. 169.
  2. A veterinarian, for the purpose of providing medical treatment to wild animals.
  3. A public zoo or aquarium.
  4. A circus.
  5. A person authorized by the Department of Natural Resources.
§ 76-27 Violations and penalties.
  1. Any person convicted of a violation of this article shall be subject to a forfeiture of not more than $500 for each animal listed in this article for the first offense.
  2. Any person convicted of a violation of this article shall be subject to a forfeiture of not more than $1,000 for each animal listed in this article for any subsequent offense(s).

    3. Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into this Village any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
  2. Exceptions. The provisions of Subsections A and C herein shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collector permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
  3. No person shall keep or permit to be kept any wild animal as a pet.
  4. Public or private educational institutions, nonprofit organizations, itinerant or transient carnivals, circuses or other theatrical performances may seek from the Health Officer a limited exemption from this section, provided that the display will be of limited duration and meet any other requirements or conditions mandated by the Health Officer and the location complies with provisions of Chapter 525, pertaining to zoning, of the Village Code. The person or organization having custody and control of any animal permitted by this section shall be responsible for compliance with all other provisions of this chapter while the animal remains within the Village limits.

Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any of the following animals, reptiles or insects:
    1. All poisonous animals and reptiles including rear-fang snakes.
    2. Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); ans siamangs (Symphalangus).
    3. Baboons (Papoi, Mandrillus).
    4. Bears (Ursidae).
    5. Bison (Bison).
    6. Cheetahs (Acinonyx jubatus).
    7. Crocodilians (Crocodilia), thirty (30) inches in length or more.
    8. Constrictor snakes.
    9. Coyotes (Canis latrans)
    10. Deer (Cervidae); includes all members of the deer family; for example, whitetailed deer, elk, antelope and moose.
    11. Elephants (Elephas and Loxodonta).
    12. Game cocks and other fighting birds.
    13. Hippopotami (Hippopotamidae).
    14. Hyenas (Hyaenidae).
    15. Jaguars (Panthera onca).
    16. Leopards (Panthera pardus).
    17. Lions (Panthera leo).
    18. Lynxes (Lynx).
    19. Monkeys, old world (Cercopithecidae).
    20. Ostriches (Struthio).
    21. Pumas (Felis concolor); also known as cougars, mountain lions and panthers.
    22. Rhinoceroses (Rhinocero tidae).
    23. Sharks (class Chondrichthyes).
    24. Snow leopards (Panthera uncia).
    25. Tigers (Panthera tigris).
    26. Wolves (Canis lupus).
    27. Poisonous insects.
    28. Except on farms and as provided in Subsection (e) below, horses, mules, ponies, donkeys, cows, pigs, goats, sheep, chickens or any animal raised for fur-bearing purposes unless otherwise permitted elsewhere in this Code.
  4. Exceptions; Pet Shops. The prohibitions of Subsection (c) above shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
    1. Their location conforms to the provisions of the zoning ordinance of the Village.
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
    3. Animals are maintained in quarters so constructed as to prevent their escape.
    4. No person lives or resides within one hundred (100) feet of the quarters in which the animals are kept.
  5. Harboring Large Animals. No person shall harbor or maintain any horse, cow or similar large animal within the Village limits unless said person owns a minimum of three (3) acres of properly fenced land within the Village limits so as to adequately provide for said large animal.

For purposes of this Subsection, the term “swine” shall not include any miniature pigs of either sex weighing less than eighty (80) pounds which are intended for and kept as domestic pets.

§ 139-9 Animals.

  1. No person who owns, harbors or keeps a dog, horse, cow, sheep, swine or any fowl shall permit the same to run at large within the Village at any time. For the purpose of this section, the phrase “running at large” includes all places within the Village except the owner’s premises and all streets, alleys, sidewalks or other public property which may abut on the owner’s premises.
  2. No person shall own, harbor or keep more than three cats that are more than three months of age except in a place or places where animals are impounded by the Village. If a total of more than three cats are owned, harbored or kept in or by any one household, the head of the household shall be deemed the person so owning, harboring or keeping said cats, not withstanding that the cat may be owned by other members of the household.

Harmful and Exotic Wild Animals

SECTION I − TITLE AND PURPOSE

The title of this ordinance is the Town of Osborn Harmful and Exotic Wild Animal Ordinance. The purpose of this ordinance is for the town to regulate by permit and penalty the possession, display, sale, purchase, and exhibition of certain harmful wild animals and exotic or wild animals in the town.

SECTION II − AUTHORITY

The Town Board of the Town of Osborn has the specific authority under s. 169.43, Wis. stats., and general authority under its village powers under s. 60.22, Wis. stats., to adopt this ordinance.

SECTION III − ADOPTION OF ORDINANCE

This ordinance, adopted by a majority of the town board on a roll call vote with a quorum present and voting and proper notice having been given, provides for the regulation by permit of the possession, display, sale, purchase, and exhibition of certain harmful wild animals or exotic or wild animals within the town.

SECTION IV − DEFINITIONS

In this ordinance:

  1. Bovine animal” means domestic cattle and American bison of any age or sex.
  2. Cattle” means any of the various animals of the domesticated genus Bos.
  3. Cervid” means a member of the family of animals that includes deer, elk, moose, caribou, reindeer, and the subfamily musk deer. “Cervid” includes all farm−raised deer.
  4. Circus” means a scheduled event staged by a traveling company with mobile facilities in which entertainment consisting of a variety of performances by acrobats, clowns, or trained animals is the primary attraction or principle business.
  5. Domestic animal” means any of the following:
    1. Domesticated cats of the subspecies Felis silvestris catus.
    2. Domesticated dogs of the subspecies Canis lupus familiaris.
    3. Rodents kept in cages, aquariums, or similar containers, including gerbils, hamsters, guinea pigs, and white mice.
    4. Fish kept in aquariums or self−contained bodies of water and farm−raised fish, except fish that have been released to waters of the state.
    5. Farm−raised deer that are kept by a person registered under s. 95.55, Wis. stats.
    6. Livestock.
    7. Poultry.
    8. Farm−raised game birds, except farm−raised game birds that have been released to the wild.
    9. Ratites.
    10. Foxes, fitch, nutria, marten, fisher, mink, chinchilla, rabbit, or caracul that are born, bred, and raised in captivity and are not endangered or threatened species.
    11. Pet birds.
    12. Any other animal listed as a domestic animal by rule by the State of Wisconsin, Department of Agriculture, Trade and Consumer Protection.
  6. Equine animal” means a horse, mule, zebra, donkey, or ass.
  7. “Exotic or wild animal” means any animal that is not a domestic animal and specifically includes all of the following:
    1. Nonhuman primates and prosimians, including chimpanzees and monkeys.
    2. Felids, except domesticated cats of the subspecies Felis silvestris catus, including lions, tigers, and other felids generally referred to as big cats;
    3. Canids, except domesticated dogs of the subspecies Canis lupus familiaris, including foxes not born, bred, and raised in captivity, and all wolves, coyotes, and wolf hybrids.
    4. Ursids, including all bears.
    5. Elephants.
    6. Crocodilians, including alligators and crocodiles.
    7. Marsupials, including kangaroos, wallabies, and opossums.
    8. Hippopotami.
    9. Rhinoceroses.
    10. Hyenas.
    11. Mustelids, except domestic ferrets, including skunks, otters, and badgers.
    12. Procyonids, including raccoons and coatis.
    13. Dasypodidae, including anteaters, sloth, and armadillos.
    14. Viverrids, including mongooses, civets, and genets.
    15. Reptilia over 12 inches in length, including boa constrictors, pythons, and any other snakes.
    16. Venomous reptilia.
    17. Cervids, except farm−raised deer that are kept by a person registered under s. 95.55, Wis. stats.
    18. Camelids, except South American camelids.
  8. Farm−raised deer” means a captive cervid, but includes a non−captive cervid that has an ear tag or other mark identifying it as being raised on a farm. “Farm−raised deer” does not include a cervid kept by an institution accredited by the American association of zoological parks and aquariums.
  9. Farm−raised game bird” means a captive bird of a wild nature that is not native. “Farm−raised game bird” does not include poultry or ratites, or birds kept pursuant to a license issued under ss. 169.15, 169.19, 169.20, or 169.21, Wis. stats.
  10. Harmful wild animal” means members of the family ursidae commonly knows as bears, the species Felis concolor commonly known as cougars, and any other animal designated as a harmful wild animal under Wisconsin Statutes, or by rule of the State of Wisconsin, Department of Natural Resources.
  11. Livestock” means bovine animals, equine animals, goats, poultry, sheep, swine other than wild hogs, farm−raised deer, farm−raised game birds, South American camelids, and ratites.
  12. Person” means an individual, partnership, firm, joint stock company, corporation, association, trust, estate, or other legal entity.
  13. Pet bird” means a psittacine or soft-bill that is not native, is not identified on the federal list of endangered and threatened species, and is not a migratory bird.
  14. Poultry” means domesticated fowl, including chickens, turkeys, and waterfowl, that are bred for the primary purpose of exhibition or producing eggs or meat. “Poultry” does not include ratites.
  15. Possess” means to own, control, restrain, transport, or keep.
  16. Public zoo or aquarium” means a zoo or aquarium that is an accredited member of the American Zoo and Aquarium Association.
  17. Ratite” means a member of the group of flightless birds that includes the ostrich, emu, cassowary, kiwi, and rhea.
  18. Self−contained body of water” means a body of water that has no inlet from or outlet to a natural body of water, except that it may have pipes or similar conduits to put in or withdraw water that are equipped with barriers that prevent the passage of fish between the body of water and the other waters of the State of Wisconsin.
  19. South American camelid” means a llama, alpaca, vicuña, or guanaco.
  20. Town” means the Town of Osborn, Outagmie, County, Wisconsin.
  21. Town board” means the board of supervisors for the Town of Osborn,Outagamie County, Wisconsin, and includes designees of the board authorized to act for the board.
  22. Town clerk” means the clerk of the Town of Osborn,Outagamie County, Wisconsin.
  23. Veterinarian” means a person who is licensed in the State of Wisconsin to practice veterinary medicine under chapter 453, Wis. stats., and who is certified under rules promulgated by the Department of Agriculture, Trade and Consumer Protection.
  24. Wis. stats.” means the Wisconsin Statutes, including successor provisions to cited statutes.
SECTION V − SUBDIVISION AND NUMBERING OF THIS ORDINANCE

This ordinance is divided into sections designated by uppercase Roman numerals. Sections may be divided into subsections designated by uppercase letters. Subsections may be divided into paragraphs designated by numbers. Paragraphs may be divided into subdivisions designated by lowercase letters. Subdivisions may be divided into subdivision paragraphs designated by lowercase Roman numerals. Reference to a “section,” “subsection,” “paragraph,” or “subdivision” includes all divisions of the referenced section, subsection, paragraph, or subdivision.

SECTION VI − AUTHORIZED POSSESSION
  1. The following persons may possess exotic or wild animals in the town:
    1. A person licensed by the State of Wisconsin, Department of Natural Resources under chapter 169, Wis. stats.
    2. A veterinarian, for the purpose of providing medical treatment to the animal.
    3. A public zoo or aquarium, with a permit issued by the town.
    4. A circus, with a permit issued by the town.
    5. A person authorized by the State of Wisconsin, Department of Natural Resources for the possession of the specific type of harmful wild animal or exotic or wild animal in the town;
  2. Except as provided in subsection C, any person not included in Subsection A may possess in the town an exotic or wild animal only with a permit issued by the town board under the specific conditions established by the town board.
  3. A person is exempt from holding a license or other approval under s. 169.04 (4), Wis. stats., or any permit from the town, to possess live native wild animals, if these wild animals are not endangered or threatened species and are any of the following:
    1. Arthropods.
    2. Chipmunks.
    3. Pocket gophers.
    4. Mice.
    5. Moles.
    6. Mollusks.
    7. Opossums.
    8. Pigeons.
    9. Porcupines.
    10. Rats.
    11. Shrews.
    12. English sparrows.
    13. Starlings.
    14. Ground squirrels.
    15. Red squirrels.
    16. Voles.
    17. Weasels.
SECTION VII − EXHIBITION OF CERTAIN ANIMALS
  1. No person may without a permit issued under Section VIII display in the town for the purpose of public viewing any exotic or wild animals or harmful wild animals.
  2. This section shall not apply to any of the following:
    1. Persons that have received a license or authorization from the State of Wisconsin, Department of Natural Resources under chapter 169, Wis. stats.
    2. A public zoo or aquarium, with a permit issued by the town board.
    3. A veterinarian, for the purposes of providing medical treatment to the animal.
    4. A circus with permits issued by the town board.
SECTION VIII − PERMITS
  1. No person may exhibit, possess, sell, or purchase an exotic or wild animal or harmful wild animal in the town without a written permit from the town board.
  2. The applicant for a permit shall submit an application that contains all of the following:
    1. The name of the applicant, any agent of the applicant, and the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
    2. The address of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased.
    3. The business and residential telephone number of the applicant, the business and residential telephone number of any agent of the applicant, and the business and residential telephone number of the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
    4. The age of the applicant and of the owner of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased, if different from the applicant.
    5. The legal description of the premises where the exotic or wild animal or harmful wild animal will be exhibited, possessed, sold, or purchased.
    6. The manner, if any, of keeping the exotic or wild animal or harmful wild animal.
    7. The type and number of wild animals or harmful wild animals, if more than one, that will be exhibited, possessed, sold, or purchased.
    8. Any other items requested by the town board in writing.
  3. No permit for the display, possession, sale, or purchase in the town of an exotic or wild animal or a harmful wild animal shall be issued by the town board until a public hearing is held by the town board on the application for a permit. The town clerk shall publish a notice of hearing as a class 2 notice under chapter 985, Wis. stats., the cost of which shall be paid by the permit applicant. The town board may, after the public hearing, issue a permit in writing only if it determines that the exhibition, possession, sale, or purchase in the town proposed by the applicant will not constitute a public nuisance or a threat to health and safety of the residents of the town. The town board may include in the permit specific conditions to protect public health and safety and to prevent a public nuisance. A permit shall be for a fixed period determined by the town board and is subject to revocation in the event of the violation of the conditions of the permit or this ordinance after an applicable public hearing and notice and determination, as provided in this subsection for an initial permit application. Upon a determined emergency condition in the town, the town board may suspend the permit without a hearing.
SECTION IX − PROHIBITION

No person may permit an exotic or wild animal or a harmful wild animal to run at large or to be released from captivity within the town. Any exotic or wild animal or harmful wild animal running at large shall be subject to seizure, detention, and disposal.

SECTION X − PENALTY PROVISION

Any person, partnership, corporation, or other legal entity that fails to comply with the provisions of this ordinance shall, upon conviction, pay a forfeiture of not less than $500.00, plus the applicable surcharges, assessments, and costs for each violation. Each day a violation exists or continues constitutes a separate offense under this ordinance. In addition, the town board may seek injunctive relief from a court of record to enjoin further violations.

SECTION XI − SEVERABILITY

If any provision of this ordinance or its application to any person or circumstances is held invalid, the invalidity does not affect other provisions or applications of this ordinance that can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable.

SECTION XII − EFFECTIVE DATE

This ordinance is effective on publication or posting. The town clerk shall properly post or publish this ordinance as required under s. 60.80, Wis. Stats. Adopted this 12th day of April, 2021.
