15.17 – DANGEROUS ANIMALS AND POTENTIALLY DANGEROUS ANIMALS.

  1. DEFINITIONS.
    • ANIMAL. Any mammal, bird, reptile, fish, insect or other non-human member of the animal kingdom, whether wild or domestic.
    • APPARENT ATTITUDE OF ATTACK. Demonstrating an intent or desire to cause injury by one or more of the following actions:
      1. An attempt to bite a person or another animal.
      2. An attempt to scratch a person or another animal.
      3. Growling or barking in an unfriendly manner while approaching or chasing a person or another animal.
      4. Growling or barking in an unfriendly manner while making physical contact with a person or another animal.
    • BITE. Any breakage of the skin evidenced by bleeding and caused by the teeth of an animal.
    • DANGEROUS ANIMAL.
      1. Any rabid animal; or
      2. Any wild animal; or
      3. Any wild animal hybrid (including but not limited to wolf hybrids); or
      4. Any dog which is ordered killed by a court pursuant to §174.02(3), Wis. Stats.; or
      5. Any dog owned, harbored or trained, primarily or in part, for the purpose of dog fighting; or
      6. Any animal which causes severe injury to any person or domestic animal, whether provoked or unprovoked and whether on or off the owner’s property; or
      7. Any animal that, unprovoked, bites any person or domestic animal, whether on or off the owner’s premises.
    • DOMESTIC ANIMAL. Livestock, domesticated dogs and domesticated cats.
    • GUARD DOG. A dog which has been trained to attack human intruders.
    • INJURY. Any physical harm which requires medical attention, including a bite or scratch.
    • ISOLATION FACILITY. A humane society shelter, a veterinary hospital, a municipal pound or other place specified by an officer which is equipped with a pen or cage which isolates an animal from contact with other animals.
    • LIVESTOCK. Any domesticated horse, bovine, sheep, goat, pig, rabbit, fowl, or other farm animal.
    • OFFICER. Any law enforcement officer, community services officer, or animal control officer.
    • OWNER. Any person, firm, corporation, or other organization owning, keeping, possessing, harboring, controlling or having the care or custody, whether temporarily or permanently, of an animal.
    • POTENTIALLY DANGEROUS DOG. Any dog which:
      1. Is a guard dog; or,
      2. When unprovoked, chases or approaches a person, whether on or off the owner’s property, in an apparent attitude of attack; or
      3. When unprovoked and while off its owner’s property, approaches a domestic animal in an apparent attitude of attack.
      4. On 3 separate occasions during a 12-month period has been running at large and on each occasion:
        1. The owner was convicted of allowing the dog to run at large and/or;
        2. The dog was impounded for running at large.
      5. When unprovoked, causes a non-severe, non-bite injury to any person or domestic animal, whether on or off the owner’s premises. (Am. #2539)
    • PROVOKED. Any attack by an animal or physical injury caused by an animal shall be considered provoked if at the time the attack occurs or the injury is inflicted:
      1. The person who was attacked or injured was teasing, tormenting, abusing or assaulting the animal; or
      2. The animal was protecting a person, itself, its young or another domestic animal from an attack by a human being or another animal; or
      3. The person who was attacked or injured was committing a crime on the property of the animal’s owner.
    • RABID ANIMAL. Any animal known to have rabies or exhibiting the symptoms of rabies.
    • SCRATCH. Any breakage of the skin of a person or animal, evidenced by bleeding and caused by the claws of an animal.
    • SEVERE INJURY. Any physical harm that results in death, broken bones or disfiguring lacerations requiring multiple sutures or cosmetic surgery.
    • STRICT ISOLATION. Keeping an animal which has bitten a person from having contact with people and other animals by means of a pen or cage.
    • WILD ANIMAL. (Am. #2894; #3221) A non-domestic animal (whether born or raised in captivity) which normally survives without human assistance in a state of nature in its native land; an animal whose ferocity is liable to be awakened at any moment, suddenly and unexpectedly, under some provocation; an animal which is inclined to escape and which must be confined or restrained for the protection of others or to prevent its escape. Exception: “Wild animal” does not include captive-bred species of caged birds, rodents, turtles, fish and non-poisonous, non-constricting snakes.
  2. DANGEROUS ANIMALS PROHIBITED.
    1. Possession of a Dangerous Animal Prohibited . No person shall own, keep, possess, or harbor a dangerous animal within the City. This prohibition does not apply to circuses, zoos or other animal shows or exhibitions which are properly licensed.
    2. Pre-Trial Disposition . Whenever a person is charged with owning, keeping, possessing or harboring a dangerous animal, that person shall immediately quarantine the animal, if quarantine is required by sub. (4) of this section. At the end of the quarantine period, the owner shall immediately remove the animal from the City until the trial of the case. If quarantine is not required, the owner shall, upon receipt of a summons or citation, remove the animal from the City until the trial of the case. The owner shall provide the officer who issues the citation proof that the animal is quarantined and/or removed from the City. If the owner fails to remove the animal from the City at the end of the quarantine, or if no quarantine period was required, within 48 hours of the service of a summons or a citation, an officer shall order impoundment of the animal until the time of the trial. If the person charged is subsequently convicted of the violation, that person shall be required to pay, in addition to any forfeiture imposed, the fees set forth in §15.16(3).
    3. Post-Trial Disposition . If the animal is determined by plea or by trial, to be a dangerous animal, it shall not be returned to the City. If the animal is a dog which has been ordered killed pursuant to §174.02(3) Wis. Stats., the dog shall be destroyed in a humane manner.
    4. Return of Dangerous Animal Prohibited . No person shall return any animal, which the Municipal Court has determined to be dangerous, to the City, and no person shall keep, harbor or possess the same within the City.
    5. Dangerous Animal Not to Run at Large . No owner of a dangerous animal shall permit it to run at large in the City. A dangerous animal shall be considered running at large if it is not securely confined indoors or outdoors in a securely enclosed, locked pen or cage capable of preventing the animal from escaping. A dangerous animal shall not be allowed off the premises of the owner unless it is securely confined in a cage or pen which is capable of preventing the animal from escaping.
    6. Penalty. Any person who keeps, possesses or harbors a dangerous animal within the City shall, upon conviction, be subject to a forfeiture of not less than $200 nor more than $1,000. Any person who fails to obey the municipal court’s pre-trial order to remove an alleged dangerous animal from the City shall, upon conviction, be subject to a forfeiture of not less than $500 nor more than $1,000. Any person who keeps, possesses, harbors, or returns any dangerous animal to the City, after it has been determined as such by the Municipal Court, shall be subject to a forfeiture of not less than $500 nor more than $1,000. Any person who allows a dangerous animal to run at large in the City shall be subject to a forfeiture of not less than $500 nor more than $1,000.

§ 178-13 Protected animals; prohibited animals; exceptions.

  1. Protected animals.
    1. Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the City any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonian mydas), Mexican ridley turtle (lepidochelys kernpi).
    2. Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
    3. Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into this City any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This paragraph shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
  2. Exceptions. The provisions of Subsection A above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collectors permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
  3. Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any of the following animals, reptiles or insects:
    1. All poisonous animals and reptiles, including rear-fang snakes.
    2. Apes: chimpanzees (pan); gibbons (hylobates); gorillas (gorilla); orangutans (pongo); ans siamangs (symphalangus).
    3. Baboons (papoi, mandrillus).
    4. Bears (ursidae).
    5. Bison (bison).
    6. Cheetahs (acinonyx jubatus).
    7. Crocodilians (crocodilia), 30 inches in length or more.
    8. Constrictor snakes.
    9. Coyotes (canis latrans).
    10. Deer (cervidae); includes all members of the deer family; for example, white-tailed deer, elk, antelope and moose.
    11. Elephants (elephas and loxodonta).
    12. Ferret.
    13. Game cocks and other fighting birds.
    14. Hippopotami (hippopotamidae).
    15. Hyenas (hyaenidae).
    16. Jaguars (panthera onca).
    17. Leopards (panthera pardus).
    18. Lions (panthera leo).
    19. Lynxes (lynx).
    20. Monkeys, old world (cercopithecidae).
    21. Ostriches (struthio).
    22. Pumas (felis concolor); also known as “cougars,” “mountain lions” and “panthers.”
    23. Rhinoceroses (rhinocero tidae).
    24. Sharks (class chondrichthyes).
    25. Snow leopards (panthera uncia).
    26. Tigers (panthera tigris).
    27. Wolves (canis lupus).
    28. Poisonous insects.
  4. Exceptions; pet shops. The prohibitions of Subsection C above shall not apply where the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; or zoological gardens, if:
    1. Their location conforms to the provisions of Chapter 480, Zoning.
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
    3. Animals are maintained in quarters so constructed as to prevent their escape.
    4. No person lives or resides within 100 feet of the quarters in which the animals are kept.
  5. Farm animals; miniature pigs. Except as provided in § 178-22 regarding miniature pigs, and on properties zoned in an agricultural classification, no person shall own, keep, harbor or board any cattle, horses, ponies, swine, goats, sheep, fowl (more than two) or rabbits (more than two).

No person shall keep or permit to be kept any wild, exotic or vicious animal as a pet or otherwise.

ARTICLE III. EXOTIC ANIMALS

Sec. 14- 40. Licensing requirements.
  1. Any person who resides within the City limits and is the owner of an Exotic Animal which is within the City limits, shall license the Exotic Animal with the city clerk. Every person residing in the city who owns an Exotic Animal on January 1 of any year or within 30 days of acquiring ownership shall annually and thereafter obtain a license.
  2. Such owner shall pay to the City Clerk the amount as established by the council from time to time by resolution. The owner of any Exotic Animal who fails to obtain a license prior to April 1 of each year or within 30 days of acquiring ownership of an Exotic Animal shall pay an additional late fee as established by the council from time to time by resolution and be subject to further penalties pursuant to section 14-62.
Sec. 14- 41. Providing registration information to relevant personnel.

The City Clerk shall provide copies of all Exotic Animal registrations to the police department and other emergency rescue personnel which may have reason to enter the premises where wild animals are present for purposes of rescue operations resulting from a natural disaster or personal emergency.

Sec. 14- 42. Prohibited animals

It shall be unlawful for any person to keep maintain or have in their possession or under their control within the City any poisonous reptile or other dangerous animal, hybrid animal, carnivorous wild animal or reptile, vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious, or dangerous propensities. Short term educational exhibits are exempt from this provision.

Sec. 14- 43. Prohibited animals enumerated.

In addition to the prohibition in section 14 – 42, it shall be unlawful for any person to keep, maintain or have in their possession or under their control within the City any of the following animals:

  1. Any animal which has been declared to be protected or endangered by the U.S. Department of Interior;
  2. All poisonous animals, including snakes; that upon touch or bite may cause hallucinations, alter cardiopulmonary functions, or even death.
  3. Badgers;
  4. Bears
  5. Beavers
  6. Canids (such as: wolves, foxes, coyotes, jackals, dingoes, or raccoon dogs);
  7. Civet;
  8. Constrictor snakes above six (6) feet in length
  9. Crocodilian (such as: Alligators, crocodiles, or caimans);
  10. Falconiformes (such as: eagles, hawks, owls, or falcons) except falcons and hawks in the possession of a state or federally licensed handler;
  11. Edentata (such as: anteaters, tamaduas, sloths, or armadillos);
  12. Emus
  13. Felids (such as: lions, tigers, leopards, cheetahs, jaguars, pumas, lynx, ocelots, or bobcats);
  14. Game cocks and other fighting birds;
  15. Hyenas
  16. Marsupials (such as: opossums, Tasmanian wolf, kangaroos, koalas, or wombats);
  17. Muskrats
  18. Ostriches
  19. Porcupine
  20. Primates (such as: apes, monkeys, baboons, chimpanzees, gibbons, gorillas, orangutans, siamangs.)
  21. Procyonids (such as: raccoons, coatis, kinkajous, ring-tailed cats, or pandas)
  22. Rheas;
  23. Skunks;
  24. Squirrels;
  25. Sharks;
  26. Ungulates (such as: elephants, zebra, tapirs, rhinoceroses, camel, llama, caribou, antelope, bison, reindeer, deer, giraffe, hippopotamus, wild boar, gazelle, or gnu);
  27. Water buffalo;
  28. Wart hogs;
  29. Weasels;
  30. Wolverines;
  31. Woodchucks; or
  32. Any other dangerous animal
Sec. 14- 44. Owner to report escape of Exotic Animal.

The owner or keeper of any Exotic Animal that escapes from their custody or control shall within one hour after they discover or reasonably should have discovered the escape, report it to a law enforcement officer of the City and the County Sheriff where the escape occurred.

  1. No person shall keep, or permit to be kept, any wild, exotic or vicious animal as a pet.
  2. The term “vicious animal” means any animal, reptile, and/or fish, that constitutes a physical threat to human beings or other animals.
  3. The terms “wild animals” and “exotic animals” mean any venomous snake, constricting snake, tarantula, live monkey (nonhuman primate), raccoon, skunk, wolf, squirrel, fox, leopard, panther, tiger, lion, lynx or other warm-blooded animal which can normally be found in the wild state, any member of the crocodilian family, including, but not limited to, alligators, crocodiles, caymans and gavials.

Article II – Wild, Exotic or Vicious Animals; Farm Animals

§ 95-11 Not allowed.

No person shall keep or permit to be kept, any wild, exotic, or vicious animal as a pet.

§ 95-12 Definitions.

As used in this article, the following terms shall have the meanings indicated:

  • EXCEPTIONS – Guard dogs, ferrets, nonpoisonous snakes, nonconstricting snakes, rabbits, and laboratory rats which have been bred in captivity and which have never known the wild shall be excluded from this section.
  • VICIOUS ANIMAL – Any animal, reptile, and/or fish that constitutes a physical threat to human beings or other animals.
  • WILD AND EXOTIC ANIMALS – Any poisonous snake, constricting snake, tarantula, live monkey (nonhuman primate), raccoon, skunk, wolf, squirrel, fox, leopard, panther, tiger, lion, lynx, or other warm-blooded animal which can normally be found only in the wild state, any member of the crocodilian family including, but not limited to, alligators, crocodiles, caiman, and gavials.
§ 95-13 Farm animals not allowed except in agricultural district.

No horse, mule, donkey, pony, cow, pig, pot-bellied pig, goat, sheep, or animal raised for fur-bearing purposes, dove cote, rabbit warren, or other yard establishment where small animals or fowl such as ducks, geese, turkeys, pheasants, rabbits, or guinea pigs are kept shall be allowed within the corporate limits of the Village, except in areas zoned Agricultural (A).

§ 95-14 Chickens.

Chickens are allowed in any areas zoned Agricultural (A). Chickens are permitted in the First Single-Family Residence District (R), Single-Family Residence District (R1) and One- and Two-Family Residence District (R2) subject to the following regulations designed to prevent nuisances and prevent conditions that are unsanitary or unsafe. All persons who wish to keep, raise, and possess chickens in the Village of Footville must complete a permit, pay an annual permit fee of $20, and follow the instructions outlined in the permit and ordinances. No person shall keep chickens unless the following regulations are followed:

  1. Number. No more than six hens shall be allowed for each dwelling unit. Roosters are strictly prohibited.
  2. Setbacks. Coops or cages housing chickens shall be kept at least 20 feet from the door or window of any dwelling or occupied structure other than the owner’s dwelling. Coops and cages shall not be located within 10 feet of a side yard or rear yard lot line. All chicken coops must be located in the backyard of the residence. The coop and run combined area may not exceed 120 square feet in size. The chicken coop building shall not exceed 20 square feet. All construction and electrical work done on the coop shall be subject to the building codes and regulations of the Village of Footville, including the issuance of required building and electrical permits as applicable. Chicken coops are not considered accessory buildings under the Village’s Zoning Code.
  3. Sanitation. The coop and outdoor enclosure must be kept in a sanitary condition and free from offensive odors. No animal waste shall be disposed of in the Village sanitary sewer system.
  4. Containment. No person shall permit any chicken owned by him or within his charge or possession to run at large in any street, alley, or public place within the Village, or upon the premises of another unless by permission of the owner or occupant of such premises. Any violation of this section may result in a fine in accordance with the Running at Large Ordinance.
    1. Chickens shall not be allowed to be kept within a residential dwelling or garage.
  5. Rental properties. Any person(s) wanting to raise chickens on a property they rent must have a signed agreement from said property owner. Any person(s) wanting to raise chickens on a property zoned R2 must have written permission from all families who reside on said property. The documentation of written agreement in these circumstances must accompany the original permit application submitted for consideration to the Village.
§ 95-15 Keeping of bees.

It shall be unlawful for any person to establish or maintain any hive, stand, or box where bees are kept or keep any bee in or upon any premises within the corporate limits of the Village.

§ 95-16 Violations and penalties.

Violations of this article shall be subject to the penalties provided in § 1-4, Penalties.

  5. Livestock and fowl. Except in agriculturally zoned areas within the Village, no person shall keep within the Village any animals or fowl, except chickens (as regulated by §106-13F) and domesticated pets, without a conditional use permit issued by the Village Board of the Village of Orfordville. In issuing a permit which may contain limitations for other animals, such as horses, cows, pigs, sheep, pigeons and the like, the Village Board shall consider the number of such animals expected to be kept, the location and likelihood of a public or private nuisance being created.
  6. Chickens. The following regulations will govern the keeping of chickens in R-1 and R-2 Residential Zoning Districts and are designed to prevent nuisances and prevent conditions that are unsanitary or unsafe. All persons who wish to keep, raise, and possess chickens in the Village of Orfordville must complete a permit, pay a one-time permit fee of $20, and follow the instructions outlined in the permit and ordinances. No person shall keep chickens unless the following regulations are followed:
    1. Number. No more than six hens shall be allowed for each dwelling unit.
    2. Setbacks. Coops or cages housing chickens shall be kept at least 15 feet from the door or window of any dwelling or occupied structure other than the owner’s dwelling. Coops and cages shall not be located within 10 feet of a side yard or rear yard lot line. All chicken coops must be located in the backyard of the residence. The coop and run combined area may not exceed 120 square feet in size. The chicken coop building shall not exceed 20 square feet. All construction and electrical work done on the coop shall be subject to the building codes and regulations of the Village of Orfordville, including the issuance of required building and electrical permits as applicable.
    3. Sanitation. The coop and outdoor enclosure must be kept in a sanitary condition and free from offensive odors. No animal waste shall be disposed of in the Village sanitary sewer system.
    4. Containment. No person shall permit any chicken owned by him or within his charge or possession to run at large in any street, alley or public place within the Village, or upon the premises of another unless by permission of the owner or occupant of such premises. Any violation of this section may result in a fine in accordance with the Animal at Large Ordinance.
      1. Chickens shall not be allowed to be kept within a residential dwelling or garage.
    5. Rental properties. Any person(s) wanting to raise chickens on a property they rent must have a signed agreement from said property owner. Any person(s) wanting to raise chickens on a property zoned R-2 must have written permission from all families who reside on said property. The documentation of written agreement in these circumstances must accompany the original permit submitted for consideration to the Village.

No exotic animal, reptile, spider, nor non-domesticated animal shall be brought into the Town of Beloit nor kept, harbored, nor allowed to remain on any premises within the Town. Article II – Wild, Exotic or Vicious Animals

§ 170-8 Registration required.

Any person who shall keep or permit to be kept any wild, exotic or vicious animals as a pet shall be required to register the same with the Town of Fulton by filing the required registration form with the Town Clerk/Treasurer and pay the required fee. The registration form shall provide sufficient information concerning the description of the animal, address and location where the animal is kept. The Town Clerk/Treasurer shall determine if sufficient information is submitted.

§ 170-9 Definitions.

In this article the following definitions shall apply:

  • VICIOUS ANIMAL Any animal, reptile and/or fish that constitutes a physical threat to human beings or other animals.
  • WILD AND EXOTIC ANIMALS
    1. Any poisonous snake, constricting snake, tarantula, live monkey, including all nonhuman primates, raccoon, skunk, wolf, squirrel, fox, leopard, panther, tiger, lion, lynx or other warm-blooded animal which can normally be found in a wild state and any member of the crocodilian family, including but not limited to alligators, crocodiles, caymans and gavials.
    2. Guard dogs, ferrets, rabbits and laboratory rats which have been bred in captivity and which have never known the wild shall be excluded from this article.

§ 12-1 Prohibited activities.

It shall be unlawful to keep or maintain rabbit pens, dog kennels, horses, ponies, goats, cattle, ducks, chickens or any and all types of fowl together with all or any other form of livestock on any property within the Township of Milton which is located within any subdivision of said Township.

§ 12-2 Violations and penalties.

Any person who shall violate this article shall, upon conviction thereof, be subject to a fine of not less than $50 nor more than $100 together with the costs of prosecution. Each day a violation exists or continues shall constitute a separate offense.

TOWN OF ROCK – ORDINANCE NO. 831
CONTROL OF THE KEEPING AND MAINTENANCE OF WILD ANIMALS AND REPTILES

SECTION 1 – REGULATION

It shall be unlawful to own, keep, have control of or exercise custody over in any way a wild animal or reptile, snake or similar creature within the Town of Rock. Wild animal is defined by Section 29.01 (1) of the Wisconsin Statutes (1981-82), and it is the intention of this ordinance to adopt that definition which reads that “wild animal” means any mammal, bird, fish or other creature of a wild nature endowed with sensation and the power of voluntary action.

SECTION 2 – EXEMPTIONS

This ordinance shall not apply to the following:

  1. House pets, provided the pet is confined within the home or is tied up, securely penned or securely held by a leash.
  2. Pet stores.
  3. Pets customarily purchased at pet stores, provided the pets are confined wholly within the home or are tied up, securely penned or securely held by a leash and are readily domesticated.
  4. Domestic farm animals under the common law or under the Wisconsin Statutes provided the animals are confined as required under the common law or under the Wisconsin Statutes.
SECTION 3 – INTERPRETATION OF THIS ORDINANCE

This ordinance shall be interpreted to provide for the health and public safety of persons within the Town of Rock, and shall be construed to prohibit the keeping within the Town of Rock, whether confined or not, of any animal, reptile, bird or other creature that is not readily domesticated, or poses a threat to the neighborhood and others if the confined creature should break out of confinement.

SECTION 4 – PERSONS AFFECTED BY THIS ORDINANCE

This regulation applies within the territorial limits of the Town of Rock.

SECTION 5 – TEMPORARY PERMIT

If special circumstances arise which would justify the issuance of a temporary permit by the Town Board to keep a wild animal or reptile as defined in this ordinance within the Town for a limited period of time, the Town Board upon application duly made in writing, may by resolution grant such temporary permit.

SECTION 6 – REFERENCES

References to the term “person”, “anyone”, or like references shall be deemed to refer to a person, a sole proprietorship, a partnership, a corporation and also a responsible member or a responsible officer or a responsible managing agent of any single proprietorship, partnership or corporation unless the context clearly indicates otherwise.

SECTION 7 – SEVERABILITY AND CONFLICT

If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent pro- vision and such holding shall not affect the validity of the remaining portions thereof.

SECTION 8 – PENALTY

Any person violating this ordinance shall be fined not less than $50.00 nor more than $500.00 for each offense. Imprisonment in the county jail can be ordered only for failure to pay the fine that may be imposed. If imprisonment is ordered for failure to pay the fine, it shall be limited to 1 day of confinement for each $10.00 of fine or fraction thereof.
