26.09 KEEPING OF WILD AND EXOTIC ANIMALS REGULATED.

  1. Keeping Wild and Exotic Animals Prohibited. No person shall keep, maintain or have in such person’s possession or under such person’s control any poisonous reptile, dangerous or wild animal or insect, including, but not limited to, poisonous insects and arachnids, all venomous snakes, constrictor snakes, any snake exceeding four (4) feet in length, non-human primates, bears, crocodiles, alligators, monitor lizards, bats, wild and domestic animal hybrids such as coyote/dog, coyotes, elephants, gamecocks and other fighting birds, hippopotami, hyenas, jaguars, leopards, lions, lynx, pumas, cougars, mountain lions, panthers, ocelots, tigers, or other wild feline species, wolves, and prairie dogs.
    1. Exceptions. The prohibitions set forth in subsection (1) shall not apply to: residents of the City who possessed one or more of the prohibited species prior to October 25, 2005 and who register same with the office of the City Clerk within 60 days of the effective date; licensed veterinary clinics; licensed animal rehabilitation homes; zoological gardens; public or private educational institutions; agricultural fairs; a display for judging purposes; circuses and professional animal acts or other shows requiring a license under Section 32.01 of the Municipal Code; provided that:
      1. Their location conforms to the zoning requirements of Chapter 13 of the Municipal Code.
      2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
      3. Animals are maintained in quarters so constructed as to prevent their escape.
    2. Any resident who shall claim exemption under subsection (a) above shall furnish satisfactory evidence in the form of a bill of sale, veterinary records, or other proof satisfactory to the Clerk, which demonstrates ownership of the otherwise prohibited species prior to the effective date of this ordinance. All ordinances or parts of ordinances contrary to the terms of this ordinance are hereby and to that extent repealed.

City of West Bend

9.07 ANIMALS OR SPECIES PROHIBITED WITHIN THE CITY.

  1. KEEPING OF FOWL PROHIBITED. Except as provided in Section 9.075, no person shall keep, raise or have in his possession any live fowl within the City, erect or maintain and use on any lot or parcel of land within the City any run, coop, structure or other building for the purpose of keeping or housing any type of fowl, including, but not limited to, chickens, geese, ducks, turkeys, pheasants or guinea hens, except, however, the keeping of racing or show pigeons.
  2. KEEPING OF LIVESTOCK PROHIBITED.
    1. No person shall keep any livestock within the City, including, but not limited to, cattle, horses, mules, goats, sheep or pigs.
    2. Keeping of Pot-Bellied Pigs. The provisions of (a) do not apply to or include the subspecies of sus scrofa commonly known as Pot-Bellied Pig. Persons keeping Pot-Bellied Pigs in the city must comply with the following requirements:
      1. Every owner of a Pot-Bellied Pig shall pay a license fee and obtain a license in the same manner as is provided for the licensing of dogs under Chapter 12.17 of the Code and Sections 174.05 and 174.07, Wis. Stats, respectively.
      2. All Pot-Bellied Pigs kept in the City must not exceed 35 pounds. Prior to obtaining any license, every owner must produce a certification from a reputable breeder that the Pot-Bellied Pig being licensed will not exceed 35 pounds at any point during its lifespan.
      3. Pot-Bellied Pigs must be spayed or neutered prior to receiving the license required by this Section 9.07(2)(b).
  3. KEEPING OF WILD AND EXOTIC ANIMALS PROHIBITED.
    1. No person shall keep, maintain or have in such person’s possession or under such person’s control any poisonous reptile, dangerous or wild animal or insect, including, but not limited to, poisonous insects and arachnids, all poisonous snakes, constrictor snakes, any snake exceeding four (4) feet in length, non-human primates, bears, crocodiles, alligators, coyotes, elephants, gamecocks and other fighting birds, hippopotami, hyenas, jaguars, leopards, lions, lynx, pumas, cougars, mountain lions, panthers, ocelots, tigers, or other wild feline species, wolf hybrids and wolves.
    2. Exceptions. The prohibitions set forth in subsection (a) shall not apply to licensed pet shops, zoological gardens, public or private educational institutions, circuses and professional animal acts or other shows requiring an entertainment activity license required by sec. 12.07 of this Municipal Code; provided that:
      1. Their location conforms to the zoning requirements of Chapter 17 of this Municipal Code.
      2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors. Animals are maintained in quarters so constructed as to prevent their escape.

Village of Germantown

9.11 – KEEPING OF LIVESTOCK, POULTRY, WILD AND EXOTIC ANIMALS REGULATED.

  1. LIVESTOCK. No person shall keep or maintain any livestock such as horses, cattle, sheep, goats or pigs in any zoning district unless zoned “agricultural,” except upon conforming to the following standards:
    1. Not more than one horse more than 6 months of age, or 2 miniature horses, per 2 acres. (See sections 17.14(1)(c)1. and 17.15(2)(a)1. of this Code.) To determine permissible numbers of horses in combination with miniature horses, acreage counted for either class shall be exclusive of acreage counted for the other. No livestock may be raised for profit in any residential district.
    2. One Philippine pot-bellied pig (sus scrofa) per single-family household may be kept as a pet, but not for breeding purposes. Bred pot-bellied pigs shall be deemed livestock and are subject to the provisions of subsection (1) above. In addition, any person having a pot-bellied pig in his possession or under his control shall be subject to the running at large prohibitions provided in section 9.10(1) and (2) of this chapter and the animal excreta regulations provided in section 10.065(7)(i) of this Code.
  2. POULTRY. No person shall keep or maintain poultry or fowl in any zoning district unless zoned “agricultural” except upon conforming to the following standards:
    1. Ten head of poultry or fowl may be kept on 2 contiguous acres.
    2. Fifteen head of poultry or fowl may be kept for each contiguous acre of 3 or more.
  3. KEEPING WILD AND EXOTIC ANIMALS PROHIBITED.
    1. No person shall keep, maintain or have in such person’s possession or under such person’s control any poisonous reptile, dangerous or wild animal or insect, including, but not limited to, poisonous insects and arachnids, all venomous snakes, constrictor snakes, any snake exceeding 4 feet in length, nonhuman primates, bears, crocodiles, alligators, monitor lizards, bats, coyotes, wild and domestic hybrids such as coyote/dog, elephants, gamecocks and other fighting birds, hippopotami, hyenas, jaguars, leopards, lions, lynx, pumas, cougars, mountain lions, panthers, ocelots, tigers, or other wild feline species, wolves, and species demonstrated to have carried disease and/or pathogens dangerous to humans, including but not limited to prairie dogs.
    2. Exceptions. The prohibitions set forth in subsection (a) shall not apply to: residents of the Village who possessed one or more of the prohibited species prior to the effective date of this subsection [October 30, 2003], and who register same with the office of the Village Clerk within 60 days of the effective date; licensed veterinary clinics; DNR licensed animal rehabilitation homes; pet shops; zoological gardens; public or private educational institutions; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; circuses and professional animal acts or other shows requiring an entertainment activity license required by section 12.07 of this Municipal Code; provided that:
      1. Their location conforms to the zoning requirements of chapter 17 of this Municipal Code.
      2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
      3. Animals are maintained in quarters so constructed as to prevent their escape.
    3. Any resident who shall claim exemption under subsection (b) above, shall furnish satisfactory evidence in the form of a bill of sale, veterinary records, or other proof satisfactory to the Clerk, which demonstrates ownership of the otherwise prohibited species prior to the effective date of this subsection.
  4. FENCES REQUIRED. Any person shall, prior to keeping or maintaining livestock, poultry or fowl pursuant to this section, erect and maintain fences as described in Ch. 90, Wis. Stats.
  5. BUILDING SETBACKS. Any building or structure constructed or to be used for the keeping, maintaining and housing of live stock, poultry or fowl shall be set back a minimum of 50 feet from any residential building and 100 feet from all adjacent property lines.
  6. INSPECTION OF PREMISES; ACCESS TO. Wherein there is any reasonable apprehension on the part of any Village official regarding public health or safety in connection with the keeping of animals in the Village, a Village official charged with health, sanitation, building inspection or code enforcement responsibility shall seek to inspect the premises at which the animal or animals are kept. If such official shall be refused or is otherwise unable to gain entry and inspection, a peace officer of the Village shall apply to the circuit court for a special inspection warrant pursuant to §66.0119, Wis. Stats., and upon issuance shall carry out such inspection and make a report to the Village official having jurisdiction.
    The cost of inspection incurred by the Village to confirm compliance with this subsection shall be borne by the property owner, and shall be payable within 30 days of invoice by the Village to the property owner at the address to which the property tax bills are sent, and if not paid, shall be assessed as a special charge against the property on the property tax bill, pursuant to §66.0627, Wis. Stats.

Sec. 6-27. – Keeping of animals and fowl restricted.

No animals or fowl, except domesticated pets and chickens with a valid license obtained under Chapter 6, Division 4 of the Village Code of Ordinances, shall be kept within the village, except in areas used for agricultural purposes. The commercial raising of all animals and fowl is prohibited except when permitted as a conditional use or planned unit development use amendment. The keeping of exotic pets that might generate a neighborhood disturbance or possibly devalue property will require a conditional use permit or planned unit development use amendment.

Sec. 10-60. – Wild animals; prohibition on keeping.

  1. It shall be unlawful for any person to keep, maintain, or have in their possession or under their control within the village any poisonous reptile or other dangerous or carnivorous wild animal or reptile, any dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities specifically:
    1. It shall be unlawful for any person to keep, maintain, or have under their possession or under their control within the village any of the following animals:

      5. Cheetahs (Acinonyx).
      6. Crocodilians (Crocodilia and Alligators) 30 inches in length or more.
      7. Constrictor snakes, six feet in length or more.
      8. Coyotes (Canis latrans) Carnivore/Canidae: (wolves and foxes).
      9. Elephants (Elephas and Loxodonia).
      10. Game cocks and other fighting birds.
      11. Hippopotami (Hippopotamidea).
      12. Hyenas (Hyaenidea).
      13. Jaguars (Panthera onca).
      14. Leopards (Panthera pardus).
      15. Lions (Panthera leo).
      16. Lynxes (Lynx).
      17. Marsupials (Kangaroos and Opossums).
      18. Monkeys, old world (Cercopithecidae).
      19. Mustelids (Skunks, Weasels, Otters and Badgers) (except domesticated Ferret).

    1. Their location conforms to the provisions of the zoning ordinance of the village.
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
    3. Animals are maintained in quarters so constructed as to prevent escape.
    4. No person lives within 100 feet of the quarters in which the animals are kept.
  3. Exceptions. “Wild animal” does not include captive-bred species of caged birds, rodents, turtles, fish, and nonpoisonous, nonconstricting snakes.

Village of Richfield

§ 118-8: Exotic animals.

  1. A person shall not, within the Village, own, possess, keep, harbor, transport in, have in one’s possession, act as a custodian for, or have custody or control of an exotic animal.
    1. Exceptions: Exotic animals owned by and in the custody and control of a circus or traveling exhibit may be kept in the Village only for the length of the event, but not longer than seven days.
  2. The definition of “exotic animal” shall not include cattle, swine, sheep, goats, camels, domestic cats, domestic dogs, ferrets, horses, donkeys, mules, llamas, alpacas, guinea pigs, hamsters, common rats, mice, gerbils, nonvenomous snakes, nonvenomous iguanas, fish, turtles, or birds.
  3. Impoundment of exotic animals. The Washington County Sheriff’s Deputy, Village law enforcement officer or humane officer shall immediately impound all prohibited and/or dangerous animals found in violation of this chapter and place the animals in a suitable storage facility pending removal of the exotic animal from the Village or other lawful disposition.

Article III: Keeping of Exotic or Wild Animals

§ 184-7 Prohibition.

It shall be unlawful for any person or persons to keep, maintain, harbor, breed or sell exotic or wild animals on a property or in any residence, household or dwelling unit within the Village of Slinger.

§ 184-8 Definition.

As used in this article, the following term shall have the meaning indicated:

EXOTIC OR WILD ANIMAL” shall have the meaning of “wild animal” as provided in § 169.01, Wis. Stats., and shall include any dangerous, carnivorous, poisonous or venomous wild animal, insect, reptile, invertebrate or amphibian, including but not limited to the following:

  • Alligator
  • Ape; Chimpanzee; gibbon; gorilla; orangutan; and siamang
  • Baboon
  • Bear
  • Bison
  • Cayman
  • Coyote
  • Chinchilla
  • Crocodile
  • Deer; includes all members of the deer family, for example white-tailed deer, elk, antelope and moose
  • Elephant
  • Ferret
  • Gambian rat
  • Gamecock and other fighting bird
  • Hippopotamus
  • Hyena
  • Kangaroo
  • Lizard
  • Member of the canine species other than the domestic dog (canis familiaris)
  • Member of the feline species other than the domestic cat (felis domesticus)
  • Monkey
  • Pig, to include pot-bellied
  • Poisonous or venomous insect
  • Ostrich
  • Prairie dog
  • Raccoon
  • Rhinoceros
  • Snake, constrictor or nonvenomous
  • Snapping turtle
  • Squirrel of flying or nonflying variety

§ 184-9 Exceptions.

The prohibitions of this section shall not apply to the following animals, provided that the conditions listed under § 184-10 have been met:

  1. No more than six nonvenomous snakes capable of growing to no more than five feet at maturity.
  2. No more than six nonvenomous lizards capable of growing to no more than three feet at maturity, measured from snout to end of body.
  3. No more than three ferrets.
§ 184-10 Conditions for exception.

An exception as stated under § 184-9 is granted, provided that:

  1. The owner-keeper has complied with all applicable state and federal importation regulations and permit requirements and possesses any required veterinary health certificate;
  2. The animal shall be securely held and maintained in quarters so constructed as to prevent its escape.
§ 184-11 Fancier’s permit.
  1. A person who wishes to keep an exotic or wild animal, or who wishes to keep a number of animals in excess of the number allowed under §184-9 and/or §184-5C, may apply for a fancier’s permit, which may be granted at the discretion of the Village Board. The fancier’s permit application must be submitted to the Village Clerk, who shall schedule a public hearing on the matter at the first possible Village Board meeting. Notice of the public hearing shall be given in accordance with § 985.07(1), Wis. Stats., Class 1 notices, no less than two weeks before the Village Board meeting at which the public hearing will be held. The Village Clerk shall also give at least 10 days’ prior written notice to all property owners within 200 feet of the property for which a fancier’s permit is being sought. Failure of any notice to be received by any property owner shall not, however, invalidate the action taken by the Village Board. A fancier’s permit will not be considered for review until the following conditions have been met:
    1. The owner-keeper has complied with all applicable state and federal importation regulations and permit requirements, and possesses any required veterinary health certificate.
    2. The owner has submitted to the Village Clerk a completed application for a fancier’s permit, which shall list the type and number of the subject animal(s) and their proposed location within the residence, household or dwelling unit.
    3. The animals shall be securely held and maintained in quarters so constructed as to prevent their escape.
    4. Should a permit be granted, such permit shall be valid for one year from the date of issuance. The owner may apply annually with updated information on the subject animals by filing a renewal application form at least 30 days prior to the expiration date. If the Village Board decides not to renew the permit, notice of the nonrenewal shall be provided to the owner, and the owner shall have the option to appeal for a public hearing and reconsideration as described in § 184-12.
    5. Fees for any applications or permits shall be as set by the Village Board of the Village of Slinger by a duly enacted resolution and may be changed from time to time.
    6. Persons living in condominiums or other multifamily buildings must obtain written authorization from their condominium association or building owner to obtain a fancier’s permit.
    7. The Village Board has the authority to require additional conditions as it deems appropriate.
  2. When reviewing an application for a fancier’s permit, the Village Board shall consider, but is not limited to, the following factors:
    1. Type and number of animal(s).
    2. Size of the subject parcel and proximity to other neighbors.
    3. Qualifications of the requester.
§ 184-12 Nonrenewal or revocation of permit.
  1. Annually prior to renewal of the permit, the Village Clerk shall inquire of the Police Department regarding complaints and/or incidents regarding the permittee and the permit address with reference to any of the following:
    1. Personal injuries or property damages caused by permitted animal(s).
    2. Animal noise or animal waste complaints.
    3. Animal(s) at large.
    4. Permit violations.
    5. Any other animal-related nuisance or annoyance conditions.
  2. The presence of three or more separate such incidents within a twelve-month period, documented by an investigating police officer and having resulted in a warning or the issuance of a citation to the permittee, shall be presumed to arise to a condition where renewal or continuation of the permit would injure public health, safety or welfare and disrupt the peace and repose of the neighborhood, and shall require nonrenewal or revocation of the permit. The Village Board also may choose not to renew or revoke a permit for any cause if it finds that the keeping of the animals has an adverse impact upon the health, safety or welfare of the Village of Slinger or the immediate neighborhood where the animals are kept. The Village Clerk shall promptly notify the permittee of the nonrenewal or revocation by certified mail.
  3. Any person aggrieved by the nonrenewal or revocation of an animal-related permit may appeal to the Village Board by submitting a written request to the Village Administrator within 10 days of receipt of the notice of nonrenewal or revocation. The Village Administrator shall schedule a public hearing on the matter at the first possible Village Board meeting. Notice of the public hearing shall be given in accordance with § 985.07(1), Wis. Stats., Class 1 notices, no less than two weeks before the Village Board meeting at which the public hearing will be held. The Village Clerk shall also give at least 10 days’ prior written notice to all property owners within 200 feet of the property for which an appeal is being sought. Failure of any notice to be received by any property owner shall not, however, invalidate the action taken by the Village Board.
§ 184-13 Violations and penalties.

Any person found to be in violation of any one of the above sections in this article shall be subject to forfeitures as stated in the Village of Slinger Municipal Ordinance Deposit Schedule.

Town of Trenton

§ 158-15 Protected animals; wild animals.

  1. Protected animals.
    1. Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the Town of Trenton any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (Thalarctos maritimus), red wolf (Canis niger), vicuna (Vicugna vicugna), gray or timber wolf (Canis lupus), sea otter (Enhydra lutris), Pacific ridley turtle (Lepidochelys olivacea), Atlantic green turtle (Chelonia mydas), or Mexican ridley turtle (Lepidochelys kempi).
    2. Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
    3. Exceptions. The provisions of this Subsection A shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, or persons holding federal permits, or by a person holding a scientific collector’s permit issued by the Secretary of the Department of Natural Resources of the state, or by any person or organization licensed to present a circus.
  2. Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Town of Trenton any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Town any of the following animals, reptiles or insects:
    1. All poisonous animals and reptiles, including rear-fang snakes.
    2. Apes: chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).
    3. Baboons (Papoi, Mandrillus).
    4. Bears (Ursidae).
    5. Bison (Bison).
    6. Cheetahs (Acinonyx jubatus).

  3. Exceptions; animal permit.
    1. The prohibitions of Subsection B above shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; a temporary display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; or licensed pet shops.
    2. Any person not excepted by Subsection C(1) shall apply for and obtain an annual animal permit from the Town Board in order to own or harbor a mammal or reptile listed in Subsection B. Such permit shall expire on June 1 of each year. This subsection shall not be interpreted to permit the existence of any such mammal, reptile or other animal in contravention of Town zoning regulations. Such animal permit shall be acted on by the Town Board within 30 days of the filing of the application.
      1. No animal permit shall be issued by the Town Board unless it is satisfied that provisions for housing, proper confinement, care and feeding can be provided for the health and well-being of the mammal, reptile or other animal, that acceptable precautions to minimize the escape of such mammal, reptile or other animal will be taken, and that the keeping of such animal or reptile does not pose an unacceptable threat to public safety. The Town Chief of Police or other law enforcement officer may at any time necessary inspect the licensed premises.
      2. The owner or person responsible for such mammal, reptile or other animal shall report immediately to Town or county law enforcement officials should the mammal, reptile or other animal escape from confinement.
      3. In the event of any reasonable likelihood that it would be difficult or impossible to capture such mammal, reptile or other animal regulated by an animal permit this will warrant its immediate destruction by the owner or any other person in a humane manner to protect the public.
