Chapter 6.11 POSSESSION OF WILD ANIMALS

6.11.010 Definitions.

Possess” means to own, possess, keep, harbor, or exercise any care, custody, or control of an animal.

Wild animal” means those species of animal that are not typically domesticated by humans and usually live in nature or outside of one’s residence. Wild animals include, but are not limited to, animals belonging to any or all of the following orders and families:

  1. Class Mammalia.
    1. Order Chiroptera (bats).
    2. Order Artiodactyla (e.g., hippopotamuses, giraffes, camels, deer, cattle, swine, sheep, goats, alpaca, and llama).
    3. Order Carnivora.
      1. Family Felidae (e.g., lions, tigers, cougars, leopards, ocelots, servals), but not domestic cats.
      2. Family Ursidae (e.g., bears).
      3. Family Mustelidae (e.g., weasels, skunks, martens, minks, wild ferrets), but not the domestic ferret species, Mustela putorius furo.
      4. Family Procyonidae (e.g., raccoons, coatis).
      5. Family Hyaenidae (e.g., hyenas).
      6. Family Viverridae (e.g., civets, genets).
      7. Family Mephitidae (e.g., skunks).
      8. Family Herpestidae (e.g., mongooses).
    4. Order Edentata (e.g., anteaters, armadillos, sloths).
    5. Order Marsupialia (e.g., opossums, kangaroos, wallabies), except sugar gliders.
    6. Order Perissodactyla (e.g., rhinoceroses, tapirs), except domestic horses and donkeys.
    7. Order Primates (e.g., lemurs, monkeys, chimpanzees, gorillas), except humans.

      4. Family Viperidae (e.g., copperheads, cottonmouths, rattlesnakes).
      5. Subfamily Atractaspidinae (e.g., burrowing asps).
    2. Order Crocodilia (e.g., crocodiles, alligators, caimans, gavials).
    3. Any constricting snake greater than four feet in length or twenty (20) pounds in weight.
    4. Any venomous snake.
  3. Class Aves.
    1. Order Falconiformes (e.g., eagles, hawks, vultures).
    2. Order Rheiformes (e.g., rheas).
    3. Order Struthioniformes (e.g., ostriches).
    4. Order Casuariiformes (e.g., cassowaries and emus).
    5. Order Strigiformes (e.g., owls).
    6. Order Galliformes (e.g., turkeys, chickens).
    7. Order Anseriformes (e.g., ducks, geese).
  4. Class Arachnida.
    1. Order Scorpiones.
    2. Any of the following members of Order Araneae, Family Therididae:
      1. Argentina red widow spider: Latrodectus coralinus.
      2. Brown widow spider: Latrodectus geometricus.
      3. Red-black widow: Latrodectus hasselti.
      4. Red widow spider: Latrodectus bishop.
      5. Black widow spider: Latrodectus mactans.
      6. Western widow: Latrodectus Hesperus.
    3. Brown recluse spider: Loxosceles reclusa.
  5. Class Chilopoda.
    1. Any of the following members of Order Scolopendromorpha, Family Scolopendridae:
      1. Amazon giant banded centipede: Scolopendra giganea.
      2. Arizona tiger centipede: Scolopendra viridis.
      3. Florida Keys centipede: Scolopendra alternans.
    2. Any other venomous chilopoda that is not native to Wisconsin.
  6. Any species of the class Insecta that is not native to Wisconsin.

6.11.020 Purpose.

The purpose of this chapter is to protect the public against health and safety risks that wild animals pose to the community. By their very nature, wild animals are potentially dangerous and do not adjust well to a captive environment. (Ord. 2729-20 § 1, 2020)

6.11.030 Possession of wild animals prohibited.

No person shall possess a wild animal unless one of the exceptions in subsection (A) of this section applies.

  1. Exceptions. This subsection shall not apply to wild animals being kept or harbored on property in compliance with Section 17.28.010(C), persons who are temporarily exhibiting wild animals in the city pursuant to a valid license issued by the state of Wisconsin under Chapter 169, Wisconsin Statutes, institutions accredited by the American Zoo and Aquarium Association, veterinarians who possess a valid license from the state of Wisconsin under Chapter 453, Wisconsin Statutes, state licensed veterinary hospitals or clinics, state licensed circuses, state licensed or accredited research or medical institutions, state licensed or accredited educational institutions, an animal certified as having been specially trained to assist an individual with a disability, any government-owned or government-operated facility, volunteers working on behalf of a government-owned or government-operated facility, a person with a valid federal permit to possess a particular wild animal, or a person temporarily transporting a wild animal through the city if the transit time is not more than twenty-four (24) hours and the wild animal is at all times maintained within a confinement sufficient to prevent the wild animal from escaping.
  2. Registration. Any person that meets the exceptions listed in subsection (A) of this section shall register each wild animal that he/she possesses within the city of Brookfield with the police department. The registration information shall include: the type of wild animal; a description of the wild animal, including size, color, and name of the animal; and the name and address of the wild animal’s owner or custodian.
  3. Escape.
    1. If a wild animal escapes the possession of a person, the person shall notify the Brookfield police department immediately of the following information: the type of wild animal; a description of the wild animal, including size, color, and name of the animal; the nature of how the wild animal escaped; the name and address of the wild animal’s owner or custodian; and the location and time where the wild animal was last observed. If the wild animal returns to the possession of a person after notification to the Brookfield police department, the person shall notify the Brookfield police department immediately that the wild animal has returned to the person’s possession.
    2. Costs. Upon the escape of a wild animal, any person possessing such wild animal shall be responsible for the costs of the seizure, detention, and disposal of the wild animal and any city response to the report of escape.
  4. Prohibition Against Release. No person may permit a wild animal to run at large. Any wild animal running at large shall be subject to seizure, detention, and disposal. (Ord. 2729-20 § 1, 2020)
6.11.040 Penalty for violation of this chapter.

Any person, firm, partnership, or corporation who violates any part of this chapter shall be subject to the penalty and enforcement provisions in Chapter 1.12. (Ord. 2729-20 § 1, 2020)

Sec. 6-16. – Regulation of animals (except dogs).

In addition to any other restrictions contained in this chapter, the following provisions shall apply to animals other than dogs:

  1. Wild animals—Prohibition on keeping. It shall be unlawful for any person to keep, maintain, possess or have the care, custody, or control, within the city, of any poisonous reptile or other dangerous or carnivorous wild animal or reptile, or any non-domesticated animal or reptile of wild, vicious or dangerous propensities. As used herein, the term “wild animal” does not include captive-bred species of caged birds, rodents, turtles, fish, and non-poisonous, non-constricting snakes.
  2. Wild animals—Release. It shall be unlawful for any person who keeps, maintains, has possession of, or has the custody, care or control of any animal or reptile having wild, vicious or dangerous propensities to release that animal, or to relinquish possession, custody, care or control of that animal to anyone other than a law enforcement officer, humane officer or any other organization or individual who has the lawful authority to take possession of the animal.
  3. Pet shops. The provisions of this chapter shall not apply to licensed pet shops, zoological gardens, circuses, professional animal acts and wild life exhibits if:
    1. Their location conforms to the provisions of the Zoning Ordinance of the city.
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
    3. Animals are maintained in quarters so constructed as to prevent their escape.
    4. No person lives within 100 feet of the quarters in which the animals are kept.

§ 140-4 Wild animals; prohibition on keeping.

  1. It shall be unlawful for any person to keep, maintain, or have in his possession or under his control within the City any poisonous reptile or any other dangerous or carnivorous wild animal or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain, or have in his possession or under his control within the City any of the following animals:
    1. All poisonous animals and reptiles including rear-fang snakes.
    2. Apes. Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).
    3. Baboons (Papoi, Mandrillus).
    4. Bears (Ursidae).
    5. Cheetahs (Acinonyx jubatus).
    6. Constrictor snakes, six feet in length or more.
    7. Crocodilians (Crocodilia) 30 inches in length or more.
    8. Coyotes (Canis latrans).
    9. Elephants (Elephas and Loxodonta).
    10. Game cocks and other fighting birds.
    11. Hippopotami (Hippopotamidea).
    12. Hyenas (Hyaenidae).
    13. Jaguars (Panthera onca).
    14. Leopards (Panthera pardus).
    15. Lions (Panthera leo).
    16. Lynxes (Lynx).
    17. Monkeys, old world (Cercopithecidae).
    18. Pumas (Felis concolor), also known as cougars, mountain lions and panthers.
    19. Ocelots (Felis pardalis).

    4. No person lives within 100 feet of the quarters in which the animals are kept.

City of Oconomowoc

12.03(7a) WILD OR VICIOUS ANIMALS.

  1. Generally:
    1. Definitions; Keeping Wild Animal as Pet.
      1. Definitions.
        Canine animal. Includes all members of the family Canidae except foxes.
        Coyote. Canis latrans.
        Dingo. Canis dingo.
        Domesticated dog. Canis familiaris.
        Jackal. Canis aureus.
        Vicious Animal. Vicious animal means any animal that, when unprovoked, inflicts bites, injures, kills or attacks a human being or domestic animal on either public or private property.
        Wild animal. Wild animals means any live monkey or other nonhuman primate, raccoon, skunk, fox, wolf, wolf-dog hybrid, poisonous snake exceeding 3 feet in length, leopard, panther, tiger, lion, lynx or any other warm-blooded animal which can normally be found in the wild state.
        Wolf. Includes both Canis lupus and Canis niger.
        Wolf-dog hybrid. Any cross-breed resulting from the mating of a domesticated dog and a wolf, coyote, jackal or dingo, or resulting from the mating of any wolf-dog hybrid and another wolf-dog hybrid or domesticated dog.
      2. Keeping Wild Animal as Pet. No person shall keep or permit to be kept any wild animal as a pet.
  2. Vicious Animals.
    1. Procedure for Declaring Animal Vicious. Any law enforcement officer empowered to conduct an investigation into the circumstances surrounding an unprovoked animal attack, after conducting such an investigation, is hereby empowered to declare the animal in question vicious. The owner of the animal declared vicious pursuant to this section shall be served personally, or by certified mail with return receipt, with an order declaring the animal vicious. Any animal owner aggrieved by the order may petition the Common Council for a review of the order in accordance with the procedure set forth in this section. Upon receipt of the petition of the aggrieved owner, the Common Council shall schedule a hearing at the next regular meeting of the Common Council. If the petition is received within 7 days of the next regularly scheduled meeting, the hearing shall be scheduled at the next monthly meeting. The hearing shall be conducted in conformance with the existing rules of the Common Council regarding administrative hearings. After the hearing, the owner or keeper of the animal shall be notified in writing of the determination. If a determination is made that the animal is vicious, the owner or keeper shall comply with the provisions of this division in accordance with a time schedule established by the Common Council, but in no case more than 30 days subsequent to the date of determination. If the owner or keeper of the animal contests the determination, he/she may, within a reasonable time, seek review of the Common Council’s decision by the circuit court. The aggrieved party may also seek review of the Common Council’s declaration of viciousness upon showing of a significant change in circumstances regarding the animal’s disposition.
    2. Reserved
    3. Certain Animals Not Be Declared Vicious. Notwithstanding the definition of a vicious animal in §12.03(7A)(a)1.a.
      1. No animal may be declared vicious if death, injury or damage is sustained by a person who, at the time such injury or damage was sustained was intentionally committing a trespass on the land or criminal trespass on the dwelling upon premises occupied by the owner of the animal, was teasing, tormenting, abusing or assaulting the animal; or was committing or attempting to commit a crime or violating or attempting to violate an ordinance which protects persons or property.
      2. No animal may be declared vicious if death, injury or damage was sustained by a domestic animal which, at the time such was sustained was teasing, tormenting, abusing or assaulting the animal.
      3. No animal may be declared vicious if the animal was protecting or defending a human being within the immediate vicinity of the animal from an unjustified attack or assault.
      4. No animal may be declared vicious for acts committed by the animal while being utilized by a law enforcement agency for law enforcement purposes while under the control and direction of a law enforcement officer.
    4. Confinement and Restraint.
      1. On Premises of Owner. While on the owner’s or caretaker’s property, a vicious animal must be:
        1. Securely confined indoors;
        2. In a securely enclosed and locked pen or structure suitable to prevent the entry of young children and designed to prevent the animal from escaping. The pen or structure must be constructed with chain link fencing on all 4 sides and top. If the pen or structure has no bottom secured to the sides, the sides must be imbedded in the ground no less than 2 feet, or have a concrete pad for the bottom; or,
        3. Securely leashed or chained to an immovable object, with the owner or caretaker being physically present.
      2. Off Premises of Owner. While off the owner’s or caretaker’s premises, the vicious animal must be muzzled and restrained by a substantial chain or leash not exceeding 4 feet in length and under the control of a responsible person. The muzzle must be made in a manner that will not cause injury to the animal or interfere with its vision or respiration, but must prevent it from biting any person or animal.
      3. Warning Signs. All owners or caretakers of vicious animals shall display, in prominent places on their premises, near all entrances to the premises, signs in letters of not less than 2 inches high using the words “Warning-Vicious Animal.” A similar sign is required to be posted on the kennel or pen of the animal.
    5. Sale or Transfer of Animal. No person may sell or transfer possession of a vicious animal to another person without first notifying the person to whom the vicious animal is being sold or transferred of the fact that such animal is a vicious animal and of any requirements imposed upon the selling or transferring party. No person may sell or transfer possession of a vicious animal to another person without first notifying the Police Department in writing at least 3 days in advance of the sale or transfer of possession.
    6. Impoundment and Destruction of Animal Injuring Humans. If the animal control officer has probable cause to believe that an animal has caused serious injury to a person by an attack without provocation, the officer shall request the Common Council to convene a hearing for the purpose of determining whether or not the animal in question should be impounded and destroyed by the City. The owner of the animal shall be notified of the hearing date as specified in subsection (b)1. hereof, and the hearing shall be conducted and the final determination made in accordance with the procedure set forth therein.

11.05(3) – Animal Regulations

  1. It shall be unlawful to keep farm animals in any zoning district except the A-1 and A-2 Districts or the Rs-1 District, which requires a conditional use permit, as set forth in sections 17.0403, 17.0404 & 17.0405 of the City Zoning Ordinance.
  2. Prohibited Animals:
    1. Poisonous Animals, Arachnids or Insects. It shall be unlawful to keep any animal, arachnid or insect that is known to have a bite, sting, secretion or other physical action that may cause sickness, injury or death to humans or other animals, with the exception of honey bees which may be kept in the A-1 or A-2 Zoning Districts.
    2. Vicious animals. It shall be unlawful to keep a vicious animal within the City. A visual confirmation or written documentation that an animal has bitten, attacked, killed or injured any person, killed or maimed other animals or is a wild animal known for its potential viciousness shall constitute a prima facie showing that such an animal is vicious.
    3. Wild or exotic animals. No person shall keep, maintain or have in possession or control any alligators, bears, cheetahs, coyotes, crocodiles, cougars, elephants, gamecocks or other fighting birds, hippopotami, hyenas, jaguars, leopards, lions, lynx, non-human primates, ocelots, tigers, wolves, or any hybrid of these animals.

City of Waukesha

33.01 Animals – General Regulations

  1. RUNNING AT LARGE. The owner or keeper of any animal regulated in this chapter shall prevent the animal from running at large in any part of the city. Unless otherwise provided in this chapter, an animal is considered “running at large” if it is off the premises of the owner or keeper and is not under the physical control of the owner or keeper. A dog is not considered to be running at large if the dog is on City owned property in areas designated as “dog runs” by official signs.
  2. ANIMAL NOISE. The owner or keeper of animal shall not allow the animal to disturb the peace and quiet of the City or of any person.
  3. MAXIMUM ANIMALS PER DWELLING UNIT. No person shall keep or maintain a combined total of more than four cats, dogs, Vietnamese Pot-Bellied Pigs or Nigerian dwarf goats in any dwelling unit in the City, subject to the provisions of sections 33.02(4) and 33.03(1).
  4. INSPECTION OF PREMISES. Premises used in keeping or maintaining one or more domestic animal shall always be open to inspection by City officials or their duly designated representatives.
  5. WASTE PRODUCTS AND MANURE.
    1. The owner or person in charge of any animal shall not permit solid fecal matter of such animal to be deposited on any street, alley, or other public or private property unless it is immediately removed by the owner of person in charge of the animal.
    2. The owner of person in charge of private property shall not permit solid fecal matter of animals kept on the private property to accumulate on the private property, including the space between the street or curb and the sidewalk adjacent to such property, for a period more than 24 hours.
  6. HORSES AND CATTLE PROHIBITED. No person shall keep any horse, cow or bull in the City of Waukesha.
  7. WILD AND EXOTIC ANIMALS PROHIBITED.
    1. No person shall keep, maintain or have in such person’s possession or under such person’s control any poisonous reptile, dangerous or wild animal or insect including, but not limited to, poisonous insects and arachnids, all poisonous snakes, constrictor snakes, non-human primates, bears, crocodiles, alligators, coyotes, elephants, gamecocks and other fighting birds, hippopotami, hyenas, jaguars, leopards, lions, lynx, pumas, cougars, mountain lions, panthers, ocelots, tigers or other wild feline species, and wolves.
    2. Exceptions. The prohibitions set forth in sub. (1) shall not apply to licensed pet shops; zoological gardens; public or private educational institutions; circuses and professional animal acts or other shows requiring an amusement activity permit as required in sec. 8.11(1) of this Municipal Code, provided that (1) their location conforms to the zoning requirements of Chapter 22; (2) all animals and animal quarters are kept in clean and sanitary conditions and maintained so as to eliminate objectionable odors, and (3) animals are maintained in quarters constructed to prevent their escape.
  8. COMPLIANCE WITH OTHER LAWS. Owners and keepers of animals shall at all times comply with all other requirements of the Waukesha Municipal Code, including zoning and property maintenance codes; and shall observe all federal, state and local laws applicable to ownership or keeping of animals.
  9. VIOLATION AND PENALTIES.
    1. Conduct not in compliance with this Section is prohibited.
    2. Violation of the terms of this Section shall result in the revocation of a permit for the location. Upon revocation, all ownership or keeping of animals at the location shall cease, subject to the appeals procedure given in subsection (k).
    3. Any person who keeps animals without a permit required by this Chapter shall be subject to the penalties provided in Municipal Code §25.05.
    4. Any person having the permit required by this Chapter who violates this Chapter shall, in addition to having his or her permit revoked, be subject to the penalties provided in Municipal Code §25.05.
  10. APPEAL OF PERMIT REVOCATION. Revocation of a permit by the Department pursuant to subsection (9)(b) may be appealed to the City Administrative Review Appeals Board pursuant to the procedure given in Municipal Code §2.11(3).
  11. STRAY ANIMALS.
    1. The City shall utilize facilities designated by the City for the impoundment of stray animals. The facilities designated, by agreement with the City, shall follow adopted provisions, procedures and policies, in compliance with pertinent state statutes, for the handling and care of stray animals.
    2. A person who captures or restrains a stray animal shall notify the City of Waukesha police department. The police may also apprehend any animal running at large and confine the animal in the facilities designated by the City for impoundment.
    3. The owner or keeper of any animal confined in the facilities designated by the City may reclaim the animal at any time before it is disposed of upon payment of all costs and charges incurred by the City in confining and keeping the animal and by compliance with statutory requirements.

Village of Big Bend

12.02(18) Exotic Animals, Reptiles, Spiders, and Non-Domesticated Animals Prohibited.

No exotic animal, reptile, spider, nor non-domesticated animal shall be brought into the Village of Big Bend nor kept, harbored, nor allowed to remain on any premises within the Village. For purposed of this Ordinance, the terms “exotic animals, reptiles, spiders, and non-domesticated animals” shall include mammals, such as lions, tigers, panthers, cougars, ocelots, wolves, fox, bear, raccoons, skunks or other mammals or non- mammals snakes or lizards which are ordinarily found in the wild or in zoos.

Sec. 6-39. – Keeping of certain wild, poisonous and dangerous animals, insects and reptiles.

  1. Prohibited. It is unlawful for any person to keep, maintain or have in his possession or under his control within the village any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous animal or any other animal or reptile of wild, vicious or dangerous propensities.     1. Their location conforms to the provisions of the zoning ordinance of the village.
    2. All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
    3. Animals are maintained in quarters so constructed as to prevent their escape.
    4. No person lives or resides within 100 feet of the quarters in which the animals are kept.

  1. SANITARY REQUIREMENTS. All structures, pens, buildings, stables, coops or yards wherein animals or fowl are kept shall be maintained in a clean and sanitary condition, free of rodents, vermin and objectionable odors. Interior walls, ceilings, floors, partitions and appurtenances of such structures, except structures or houses occupied by no more than one dog, cat, rabbit, skunk or similar animal kept as a pet, shall be whitewashed or painted annually or oftener as the Health Officer shall direct.
  2. ANIMALS EXCLUDED FROM FOOD HANDLING ESTABLISHMENTS. No person shall take or permit to remain any dog, cat or other live animal on or upon any premises where food is sold, offered for sale or processed for consumption by the general public.
