- Any exotic animal kept in the County of Waupaca shall be contained in a pen or enclosure of proper size and strength as to prohibit the animals escape. B. It shall be the duty of each individual city, town, or local municipality to regulate or implement any ordinance concerning the sale or keeping of exotic animals, as they see fit. If at any time, County personnel are needed in order to Chapter 12.11(f) amended July 19, 2011 contain, capture, or humanely destroy an exotic animal, the animal owner will be responsible for the costs associated.

§ 94-17 Prohibited and protected animals.
- Protected animals.
- Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale or buy or attempt to buy within the city any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna) or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas) or Mexican ridley turtle (lepidochelys kempi).
- Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the importation of certain bids. No person, firm or corporation shall import or cause to be imported into this city any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of Subsection A above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning or persons holding federal permits or by a person holding a scientific collector’s permit issued by the Secretary of the Department of Natural Resources of the state or by any person or organization licensed to present a circus.
- Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the city any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the city any of the following animals, reptiles or insects:
- All poisonous animals and reptiles, including rear-fang snakes.
- Apes: chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).
- Baboons (Papio, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), 30 inches in length or more.
- Constrictor snakes, six feet in length or more.
- Coyotes (Canis latrans).
- Deer (Cervidae); includes all members of the deer family, for example, whitetailed deer, elk, antelope and moose.

- Their location conforms to the provisions of Chapter 303, Zoning, of this Code.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.

- Farm animals. The keeping of cattle, horses, hogs, poultry and other farm animals is prohibited within the City of Marion, except in areas zoned agricultural.
- Keeping for exhibition purposes; keeping wild animal as pet.
- No person shall exhibit or permit to be kept on his premises or any public place any wild animal for display or exhibition purposes, whether gratuitously or for a fee.
- The prohibitions in Subsection F(1) of this section do not apply when the creatures are in the care, custody or control of a veterinarian for treatment.
- Public or private educational institutions, nonprofit organizations, itinerant or transient carnivals, circuses or other theatrical performances may seek from the Police Department a limited exemption from this section, provided that the display will be of limited duration and meet any other requirements or conditions mandated by the Police Department. The person or organization having custody and control of any animal permitted by this section shall be responsible of compliance with all other provisions of this chapter while the animal remains within the City limits.
- Feeding of waterfowl prohibited.
- No person may place any salt, mineral, grain, seed, fruit or vegetable material outdoors on any public or private property for the purpose of feeding waterfowl.
- Exceptions. Subsection G(1) shall not apply to the following situations:
- Naturally growing materials. Naturally growing grain, seed, fruit or vegetable material, including gardens.
- Bird feeders. Unmodified commercially purchased bird feeders or their equivalent.

- It shall be unlawful for any person to keep, maintain or have possession of or control of within the city any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities.
- For the purposes of this section, the term “wild animal” means any of the following animals, whether bred in the wild or in captivity, and also any of their hybrids with domestic species. The animals listed in parentheses are intended to act as examples and are not to be construed as an exhaustive list or limit the generality of each group of animals, unless otherwise specified.
- Nonhuman primates and prosimians (chimpanzees, monkeys).
- Felids, except domesticated cats.
- Canids (wolves, coyotes, foxes) except domesticated dogs.
- Prairie dogs.
- Elephants.
- Crocodilians (alligators, crocodiles).
- Marsupials (kangaroos, opossums).
- Ungulates (hippopotamus, rhinoceros).
- Hyenas.
- Mustelids (skunks, otters, badgers) except ferrets.
- Procyonids (raccoons, coatis).
- Dasypodidae (anteaters, sloth, armadillos).
- Viverrids (mongooses, civets, genets).

- Their location conforms to the provisions of the zoning ordinance of the city.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.

Specifically, it shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the City any of the following animals, reptiles or insects:
- All poisonous animals and reptiles, including rear-fang snakes.

- No person lives or resides within 100 feet of the quarters in which the animals are kept.
- Farm animals; miniature pigs.
- Except as provided in § 190-19, regarding miniature pigs, it shall be unlawful for any person, firm, or corporation to own, house, keep or possess, in any area within the City of Weyauwega which is zoned as a single-family or multifamily residential district or in a general business or highway business district, any animals commonly known as “farm animals,” including but not limited to cows, horses, pigs, goats, sheep, turkeys, roosters, ducks and fowl.
- The Chief of Police shall have the authority, in addition to other penalties provided herein, to impound said animals as set forth in this Code of Ordinances.

The prohibitions of Subsection (c) above shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
- Their location conforms to the provisions of the zoning ordinance of the Village.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within on hundred (100) feet of the quarters in which the animals are kept.
- Livestock and Poultry. No horse, mule, donkey, pony, cow, pig, goat, sheep, or animal raised for fur-bearing purposes, and no dove cote, rabbit warren, or other yard or establishment where small animals or fowl such as ducks, geese, turkeys, pheasants, rabbits, or guinea pigs are kept shall be allowed within the Village limits. However, chickens may be kept as permitted in 6-1-13(f).
- Excepted from the prohibitions set forth in this section are chickens and chicken coops, which meet the following requirements.
- Chickens Allowed
- A “chicken” is defined as a domestic fowl of the subspecies Gallus domesticus.
- Any person may keep up to 5 female chickens on any residential zoned lot less than one acre in size in the Village which contains one single-family residential dwelling unit.
- Any person may keep up to 5 female chickens per acre on any residential or agricultural zoned lot one acre or larger in size which contains one single-family residential dwelling unit.
- No rooster shall be allowed to be kept under this section.
- Chickens may only be kept in a chicken coop or the attached and contiguous run located in the rear yard area. The chicken coop or run shall not be located in the front, interior side, or corner side yard of the residential zoning lot.
- Slaughtering of chickens. No person shall slaughter any chicken within the Village of Scandinavia other than at a licensed meat processing facility.
- Construction and maintenance of coop.
- A coop shall be constructed from conventional building materials in a workmanlike fashion or be a premanufactured enclosed structure designed specifically for the keeping of urban chickens. Such coop must be secure and impermeable to rodents, wild birds and predators, including dogs and cats and must be constructed or modified in a fashion to provide a humane environment for the chickens, including adequate ventilation, adequate sun, adequate shade and adequate protection from adverse weather. A newly built or installed coop shall have a minimum of 3 square feet per chicken and cannot exceed 24 square feet in size on any lot less than one acre in size.
- A chicken coop may have a run attached and contiguous to the coop with the run constructed in a fashion to confine the chickens and in compliance with the provisions of this section. A chicken run is a fenced cage that may not exceed 40 square feet in area or one percent of the rear yard area, whichever is greater. However, in no instance, may the chicken run exceed 100 square feet in area.
- Chicken coops and runs must be kept clean, dry, and odor free and kept in a sanitary condition at all times in such a manner as to not disturb the use or enjoyment of adjoining property due to noise, odor or any other adverse impact.
- Confinement of chickens. Chickens must be kept in a chicken coop or the attached and contiguous run at all times. Between sunrise and sunset, chickens may be allowed outside of the coop in the run. Chickens must be secured within the coop between sunset and sunrise.
- Location of chicken coop and run. A chicken coop must be located no closer than 10 feet to the rear wall of the residential dwelling unit located on the zoning lot and no portion of the coop or run shall be located within 10 feet of any lot line of the zoning lot upon which the coop and run are located. No portion of the coop or chicken run shall be located within 25 feet of any principal structure located upon any adjacent property.
- Annual residential chicken premises permit required. No person shall keep any chickens nor construct any chicken coop or run without first obtaining an annual residential chicken premises permit hereunder.
- Fees. Initial and annual permit fees, established by the Village Board and listed in the Village of Scandinavia Fee Schedule, shall be paid to the Village Treasurer by the applicant when the initial and annual renewal applications are filed. The annual renewal permit fee shall be paid to the Village Treasurer by the applicant no later than January 15 of each year.
- Application. The application for the annual residential chicken premises permit shall be made using such forms required by the Village Board and must contain an accurately scaled drawing showing the location of the proposed coop and any chicken run, distances to lot lines and distances to the nearest adjoining principal structure, together with dimensions of the coop and chicken run. Chicken runs shall be exempt from the Village of Scandinavia Zoning Code related to fencing regulations. However, all chicken runs constructed shall be of wire normally used for the containment of chickens. If, owing to special conditions, a literal enforcement of a specific provision of this Ordinance will result in practical difficulty or unnecessary hardship it will be at the discretion of the Village Board to grant an exception from that provision. If the applicant is not the owner of the parcel, the property owner must sign the application certifying approval for the use of the premises for this purpose. The property owner’s signature must be notarized.
- Registration. Any permit application shall be accompanied with satisfactory evidence that the applicant has registered the proposed location with the Wisconsin Department of Agriculture, Trade, and Consumer Protection pursuant to Sec 95.51, Wis. Stats. and ATCP 17, Wis. Adm. Code.
- Permit Year. The permit year shall be January 1 through December 31.
- Miscellaneous
- All food supplies maintained for the coop must be kept in a secure and rodent-proof container.
- Should any person feed chickens kept under this section with food meant for human consumption or scraps of such food, it shall only be fed within the coop and shall be prohibited within the chicken run.
- All waste generated by the operation of the coop and chicken run, including, but not limited to, chicken carcasses, manure, droppings and spoiled feed, shall be disposed of in a bag placed in a container for collection by a commercial waste hauler or disposed of at an approved waste collection site.
- A member of the Village Board may enter the rear yard of a residential or agricultural zoned lot at any reasonable time to determine if a property is in compliance with the provisions of this section.
- Farm Animals. Cows, horses, pigs, sheep, poultry and other farm animals shall not be kept within the Village limits unless kept in a properly zoned agricultural district under Title 10, Chapter 1 (Zoning Code) of this Code of Ordinances is obtained.
- Penalty.
- A One Hundred Dollar ($100.00) re-inspection fee shall be charged by the Village against and paid by the property owner if the violation is not corrected by the re-inspection date. One Hundred Dollars ($100.00) will be charged for each subsequent re-inspection until full compliance is achieved. Re-inspection fees that are not timely paid shall be entered upon the tax roll as a special charge against the lot or parcel of land, pursuant to the provisions of Sec 66.0627, Wis. Stats.
- Any property with two or more nuisance activities resulting in enforcement action within a 12-month period shall be ineligible to receive a renewal permit for a period of one year after the date of the last enforcement action. In addition, no other person may apply for a permit hereunder on the zoning lot subject to such prior permit during said period of renewal ineligibility.

§ 108-14 Prohibited and protected animals.
- Protected animals.
- Possession and sale of protected animals. It shall be unlawful for any person, firm, or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the Village any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas), or Mexican ridley turtle (lepidochelys kempi).
- Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian, or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the importation of certain birds. No person, firm, or corporation shall import or cause to be imported into this Village any part of the plumage, skin or dead body of any species of hawk, owl, or eagle. This subsection shall not be construed to forbid or restrict the importation or use of the plumage, skin, body, or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of Subsection A above shall not be deemed to prevent the importation, possession, purchase, or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collector’s permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
- Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any poisonous reptile or any other dangerous or carnivorous wild animal or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the Village any of the following animals:
- All poisonous animals and reptiles, including rear-fang snakes.
- Apes: chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).
- Baboons (Papio, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), 30 inches in length or more.
- Constrictor snakes, six feet in length or more.
- Coyotes (Canis latrans).
- Deer (Cervidae); includes all members of the deer family, for example, whitetailed deer, elk, antelope and moose.
- Elephants (Elephas and Loxodonta).
- Game cocks and other fighting birds.
- Hippopotami (Hippopotamidae).
- Hyenas (Hyaenidae).
- Jaguars (Panthera onca).
- Leopards (Panther a pardus).
- Lions (Panthera leo).
- Lynxes (Lynx).
- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Piranha fish (Characidae).
- Pumas (Felis concolor); also known as cougars, mountain lions and panthers.
- Rhinoceroses (Rhinocero tidae).
- Sharks (class Chondrichthyes).
- Snow leopards (Panther a uncia).
- Tigers (Panthera tigris).
- Wolves (Canis lupus).
- Poisonous insects.
- Pit bull and Staffordshire terrier dogs (all types).
- Pet shops. The provisions of Subsection C above shall not apply to licensed pet shops, zoological gardens and circuses, if:
- Their location conforms to the provisions of Chapter 390, Zoning, of the Village Code.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.
