Sec. 3-116. Keeping for exhibition purposes; keeping wild animal as pet.
- No person shall exhibit or permit to be kept on their premises or any public place any wild animal for display or exhibition purposes, whether gratuitously or for a fee.
- The prohibitions in (a) of this section do not apply when the creatures are in the care, custody or control of a veterinarian for treatment.
- Public or private educational institutions, nonprofit organizations, itinerant or transient carnivals, circuses or other theatrical performances may seek, from the Health Officer, a limited exemption from this section provided the display will be of limited duration and meet any other requirements or conditions mandated by the Health Officer. The person or organization having custody and control of any animal permitted by this section shall be responsible for compliance with all other provisions of this chapter while the animal remains within the City limits.
- No person shall keep or permit to be kept any wild animal as a pet.
Sec. 3-52. Restricted species.
- Except as otherwise permitted within this section, no person shall keep, sell or offer for sale within the City any horses, cows, pigs, goats, sheep, bees, pigeons, chickens, geese, ducks or other fowl or any other domestic animal other than a dog, cat, rabbit, small caged birds, small caged animals or reptiles or aquatic and amphibian animals, kept solely as pets.
- Upon obtaining a permit issued by the Health Department, honeybee hives in areas zoned P-I, Public Institutional District; on building rooftops within the Central Business District (CBD), and areas approved as urban farms, may be maintained subject to the requirement and limitations on file with Health Department.
- Upon obtaining a permit issued by the Health Department, residential honeybee hives may be maintained subject to the requirements and limitations on file with the Health Department.
- Upon obtaining a permit issued by the Health Department, and subject to the requirements and limitations on file with the Health Department, a limited number of pigeons may be maintained by the permit holder.
- Upon obtaining a permit issued by the Health Department, and subject to the Rules and Regulations for hen keeping, up to six (6) chicken hens may be maintained by the permit holder. The Rules and Regulations for chicken hen keeping shall be on file in the Health Department. The permit will allow up to six (6) chicken hens at all one- (1-) and two (2-) family dwellings.

SEC. 7-1-13 PROHIBITED AND PROTECTED ANIMALS, FOWL, REPTILES AND INSECTS. PROTECTED ANIMALS.
- It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the City any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle (lepidochelys olivacea), Atlantic green turtle (chelonia mydas), Mexican ridley turtle (lepidochelys kempi).
- EXCEPTIONS. The provisions of Subsection (a) above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
- WILD ANIMALS; PROHIBITION ON KEEPING. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of the wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and ans siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), thirty (30) inches in length or more.
- Constrictor snakes, six (6) feet in length or more.
- Coyotes (Canis latrans).
- Deer (Cervidae); includes all members of the deer family; for example, whitetailed deer, elk, antelope and moose.
- Elephants (Elephas and Loxodonta).
- Game cocks and other fighting birds.
- Hippopotami (Hippopotamidae).
- Hyenas (Hyaenidae).
- Jaguars (Pantera onca).
- Leopards (Panthera pardus).
- Lions (Pantera leo).
- Lynxes (Lynx).
- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Puma (Felis concolor); also known as cougars, mountain lions and panthers.

- EXCEPTIONS; PET SHOPS. The prohibitions of subsection (c) above shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
- Their location conforms to the provisions of the zoning ordinance of the City.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within one hundred (100) feet of the quarters in which the animals are kept.

Sec. 3-30. – Prohibited and protected animals, fowl, reptiles and insects; pet shops; potbellied pigs.
- Protected animals.
- Possession and sale of protected animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the City any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family Felidae, polar bear (Thalarctos maritimus), red wolf (Canis niger), vicuna (Vicugna vicugna), or alligator, caiman or crocodile of the order of Crocodilia, gray or timber wolf (Canis lupus), sea otter (Enhydra lutris), Pacific Ridley turtle (Lepidochelys olivacea), Atlantic green turtle (Chelonia mydas), Mexican Ridley turtle (Lepidochelys kempi).
- Compliance with federal regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United States Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the importation of certain birds. No person, firm or corporation shall import or cause to be imported into this City any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This paragraph shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of Subsection (a) above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the State, or to any person or organization licensed to present a circus.
- Wild and non-domesticated animals; prohibition on keeping. Except for State-licensed game farms located in properly zoned areas, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.

- Animals are maintained in quarters so constructed as to prevent their escape.
- Exception; Vietnamese potbellied pigs. Notwithstanding the prohibitions contained in this section, Vietnamese potbellied pigs may be kept within the City of Neenah provided that no more than one Vietnamese potbellied pig per premises and that the owners of such animals comply with the other regulations of this chapter except for the licensing requirement contained in Article II.

Sec. 6.04.060. – Animals, fowl and insects not permitted in city.
No person shall bring into, keep, maintain, offer for sale or barter, or release to the wild, nor shall any person permit such activities to occur on premises owned, controlled, rented, or maintained by that person, except as provided in Section 6.04.230:
- Any fowl, chickens, except as provided in 6.04.065 of this chapter, turkeys, ducks, geese, cows, cattle, horses, sheep, swine, goats, potbellied pigs, or any other domesticated livestock, unless part of an agricultural operation, zoned AG agricultural or AP agricultural preservation and authorized by the city zoning ordinance;
- Wild animals, including but not limited to, any live monkey, or other non-human primate, raccoon, skunk, ferret, prairie dog, fox, wolf, panther, lynx, opossum, or any other warm-blooded animal which can normally be found in the wild state. For the purposes of this code, wolf-dog hybrids are considered wild animals;
- Any poisonous or venomous, biting or injecting species of reptiles, amphibians, arachnids or insects, except for bees kept with a valid permit issued under Section 6.04.068;
- Snakes not indigenous to Wisconsin or any snake exceeding three feet in length.
- This section shall not be construed to apply to zoological parks, circuses or like entertainment organization or to an educational or medical institution.

However, such facilities shall comply with Village zoning requirements.
- Snakes.
- For purposes of this subsection, “poisonous” shall mean having the ability to cause serious harm or death by the transfer of venom or poison to a person or animal.
- No person shall keep or possess any snake in the Village which is poisonous or in excess of 10 feet in length. This prohibition shall not apply to bona fide zoos, educational institutions or exhibitions keeping such snakes for display or for instructional or research purposes. Any person legally possessing any such animal in this capacity shall notify the Chief of Police, in writing, of the location and type of snake being kept and the purpose for such possession.
- Exceptions; animal trials; wildlife rehabilitators. The prohibitions of Subsection C above shall not apply where the creatures are in the care, custody or control of: a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; licensed pet shops; zoological gardens; if:
- Their location conforms to the provisions of Chapter 580, Zoning.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 75 feet of the quarters in which the animals are kept.
- The prohibitions in this section shall not apply to animals in the possession of a wildlife rehabilitator who is licensed by the State of Wisconsin, Department of Natural Resources, while such animal is being lawfully nurtured or rehabilitated for release in the wild. No animal may be kept under this exception for a period of more than 55 days. No animal may be kept under this exception that poses a danger to the community.
- Farm animals; miniature pigs. Except on properties zoned in an agricultural classification, no person shall own, keep, harbor or board any cattle, horses, ponies, swine, goats, sheep, pigeons, fowl (more than five) or rabbits (more than four). For purposes of this subsection, the term “swine” shall not include any miniature pigs of either sex weighing less than 80 pounds which are intended for and kept as domestic pets.

Chapter 3: Small Pet Regulation
3.1 Purpose.
It is declared to be the purpose of the Town to establish regulations to prevent and control rabies disease and to prevent animals from running at large and/or disrupting town residents.
3.2 Generally.
No person having in his/her possession, or under his/her control, or present on his/her premises, any dog, cat, other domesticated animal, fowl, bird, or other domesticated pet, shall allow or permit the same to:
- run at large; or
- engage in unreasonable repeated barking, howling, baying, or other loud and disruptive noise or sound so as to disrupt the peace and quiet of the neighborhood within the Town; or
- trespass upon any private property belonging to another without the permission of the owner of said property; or
- trespass upon any public property within the Town unless the owner or person in charge of such animals:
- has, in his or her possession, a suitable device for the picking up, collection and proper sanitary disposal of the animal feces; and
- immediately removes all feces deposited by such animal(s) and disposes of same in a sanitary manner..
3.3 Definition.
An animal shall be deemed at large if said animal is not:
- on the owner’s property, or
- under the control of a person by means of a chain, rope, cord, or leash of such strength to control such animal, or
- kept within a substantial enclosure.
A dog that is actively engaged in a legal hunting activity, including training, is not considered to be running at large if the dog is monitored or supervised by a person and the dog is on land that is open to hunting or on land on which the person has obtained permission to hunt or to train a dog.
3.4 Enforcement.
The County Sheriff and his deputies, any Marshal or Constable, any police officer, or humane officer, and any other person designated by the Town to so act, shall apprehend any such animal running at large, contrary to this chapter, and confine the same at a suitable place. Every animal so confined may be reclaimed by the owner upon payment of all costs, charges, and expenses for apprehension and confining said animal, to the Town or to the person apprehending and confining said animal. All animals so apprehended and confined shall be kept for at least 7 days and if not reclaimed within that time, the animal may be euthanized or otherwise disposed of in accordance with Wis. Stats. 173.23(1m).
3.5 Adoption by Reference.
Chapter 174 and §95.21, Wis. Stats., as from time to time amended, are hereby adopted by reference as though fully set forth herein and such chapter and section are made a part of this chapter.
3.6 Amount of Penalties.
In addition to the apprehension and confinement cost heretofore provided, any person who may violate any section set forth in this chapter shall be subject to a Class I fine as established in Chapter 1 of this code. Citations shall be issued consistent with Chapter 1.11(b).
3.7 Collection of Forfeitures and Penalties.
All forfeitures and penalties imposed under this chapter may be collected in accordance with the provisions of §66.12, 165.87, and Chapter 288, Wis. Stats.

Town of Oshkosh
Sec. 7-1-6 Restrictions on Keeping of Dogs, Cats or Fowl and Other Animals.
- Restrictions. It shall be unlawful for any person within the Town of Oshkosh to own, harbor or keep any dog, cat or fowl or other animal which:
- Habitually pursues any vehicle upon any public street, alley or highway in the Town.
- Assaults or attacks any person or destroys property.
- Is at large within the limits of the Town.
- Habitually barks or howls to the annoyance of any person or persons. (See Section 7-1-11)
- Kills, wounds or worries any domestic animal.
- Is known by such person to be infected with rabies or to have been bitten by an animal known to have been infected with rabies.
- In the case of a dog, is unlicensed.
- Vicious Dogs and Animals.
- For purposes of enforcing this Section, a dog shall be deemed as being of a vicious disposition if, within any twelve (12) month period it bites two (2) or more persons or inflicts serious injury to one (1) person in unprovoked circumstances off the owner’s premises. Any vicious dog which is found off the premises of its owner other than as hereinabove provided may be seized by any person and, upon delivery to the proper authorities, may, upon establishment to the satisfaction of a court of competent jurisdiction of the vicious character of said dog, by testimony under oath reduced to writing, be killed by the law enforcement authorities.
- No person shall harbor or permit to remain on his/her premises any animal that is habitually inclined toward attacking persons or animals, destroying property, barking excessively, or making excessive noises or running after automobiles.
- Animals Running At Large.
- No person having in his/her possession or ownership any animal or fowl shall allow the same to run at large within the Town. The owner of any animal, whether licensed or unlicensed, shall keep his/her animal tied or enclosed in a proper enclosure so as not to allow said animal to interfere with the passing public or neighbors. Any animal running at large unlicensed shall be seized and impounded by a humane or law enforcement officer.
- A dog shall not be considered to be running at large if it is on a leash and under control of a person physically able to control it.
- Owner’s Liability for Damage Caused by Dogs; Penalties. The provisions of §174.02, Wis. Stats., relating to the owner’s liability for damage caused by dogs together with the penalties therein set forth are hereby adopted and incorporated herein by reference.
- Animal Feces. The owner or person in charge of any dog or other animal shall not permit solid fecal matter of such animal to deposit on any street, alley or other animal public or private property, unless such matter is immediately removed there from by said owner or person in charge. This Section shall not apply to a person who is visually or physically handicapped.

§ 167-16 Animals, fowl and insects not permitted in Town.
- No person shall keep within the Town of Vinland any bees, fowl, chicken, ducks, turkeys, geese, cows, cattle, horses, sheep, swine, goats, or any other domesticated livestock except such animals or fowl may be kept for commercial agricultural purposes, for slaughtering, for educational purposes, and for circuses or similar educational events. “Commercial agricultural purposes” shall mean for the period of raising animals for the purpose of slaughter or of sale for a profit not as a hobby.
- A minimum of five acres must be available to keep any stable animals (horses, cattle, goats, sheep, pigs, etc.).
- The total combined animal number may not exceed three animals.
