§ 103-29 Keeping of certain restricted animals.
- Except as otherwise provided herein, no person within the unincorporated areas of Green Lake County shall own, keep, maintain, harbor, or have in his or her possession, or under his or her control, or sell, or offer to purchase, any wild animal, harmful wild animal, or animal with vicious or dangerous propensities, including, but not limited to, any of the following animals:
- Poisonous or venomous animals and reptiles, including snakes that are capable of causing serious injury to humans or other animals;
- Apes: Chimpanzees (Pan); Gibbons (Hylobates); Gorillas (Gorilla); Orangutans (Pongo); and Siamangs (Symphalangus);
- Baboons (Papoi, Mandrillus);
- Bears (Ursidae);
- Cheetahs (Acinonyx jubatus);
- Crocodilians (Crocodilia);
- All snakes not indigenous to Wisconsin. Exception: a boa constrictor or ball python up to four feet in length or any other snake which does not exceed three feet in length are allowed;
- Coyotes (Canis latrans);
- Elephants (Elephas and Loxodonta);
- Game cocks and other fighting birds;
- Hippopotami (Hippopotamidae);
- Hyenas (Hyaenidae);
- Jaguars (panther onca);
- Leopards (Panthera pardus);
- Lions (Panthera leo);
- Lynxes (Lynx);
- Monkeys, old world (Ceropithecidae);
- Piranha fish (Characidae) exceeding six inches in length;
- Pumas (Felis concolor); also known as “cougars,” “mountain lions,” and “panthers”;
- Rhinoceroses (Rhinocero tidae);
- Sharks (class Chondrichthyes) exceeding six inches in length;
- Snow leopards (Panthera unicia);
- Tigers (Panthera tigris);
- Wolves (Canis lupus);
- Wolf-dog hybrids;
- Poisonous or venomous biting insects; except beekeeping is allowed.
- Poisonous tarantula and poisonous or venomous biting spiders;
- Wolverines, fishers, martens, wild Russian boars, bobcats or ocelots;
- Any other wild animal not native to Wisconsin and not controlled by game farm licensure;
- Any hybrid or crossbreed of any of the above with a domestic animal.
- Any restricted animal listed in § 103-29 above, owned, possessed, harbored, kept, or maintained in violation of this section may be impounded and destroyed by the County, or its agents, at the expense of the violator.
- Any law enforcement, humane or public health officer shall have the authority to enforce the provisions of this section, including, but not limited to, seizing any animal that the officer reasonably believes is being possessed, harbored, owned, kept, or maintained in violation of this section.
- Any such animal or creature seized pursuant to this section shall be held in a facility designated by the County until the animal or creature is identified as to genus and species to ascertain if the animal is an endangered species identified as such in the Wisconsin Statutes. At any time after such identification, the County may destroy the animal as provided herein.
- The animal seized shall be impounded. The County may require the appealing party to post bond in an amount sufficient to satisfy the cost of holding and identifying the animal. If it is determined that the animal has been owned, possessed, harbored, kept, or maintained in violation of this section, the costs incurred by the County for impounding, holding, and identifying the animal shall be paid by the violator. Anyone found to be in violation of this section shall, in addition to the penalties provided, forfeit the prohibited animal to the County for destruction or disposition as deemed proper. Prior to such forfeiture, the County may direct a transfer of the animal to a qualified zoological, educational, or scientific institution or qualified private propagator for safe keeping, with the cost thereof being assessed and paid by the violator.
- This section shall not apply to:
- Any person exempt from licensing by the Department of Natural Resources under Ch. 169, Wis. Stats.
- Any person exempt under § 169.07, Wis. Stats.
- Any person who possesses a license or other approval issued by the Department of Natural Resources under Ch. 169, Wis. Stats. or § 29.319, Wis. Stats. to possess, purchase, or sell a live wild animal.
- Any person who is exempt under Subsection C shall ensure that:
- The location where the animal is housed conforms to the provisions of the zoning ordinances of the municipality in which the animal is housed.
- The animal is handled and treated humanely in conformity with all state statutes and administrative codes applicable to that particular animal.
- The licensed facility housing the animal conforms to all state statutes and administrative codes applicable to that particular animal.

City of Berlin
Sec. 10-18 – Prohibited animals.
- Keeping prohibited. It shall be unlawful for any person to keep, maintain or have in his possession or under his control within the city any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities, or any animal which may have the propensity to create a nuisance, specifically, the following:
- All poisonous animals and reptiles, including rear-fang snakes.
- Apes; chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and ans siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).
- Cheetahs (Acinonyx jubatus).
- Crocodilians (Crocodilia), 30 inches in length or more.
- Constrictor snakes, six feet in length or more.
- Coyotes (Canis latrans).
- Deer (Cervidae); including all members of the deer family, for example, whitetailed deer, elk, antelope and moose.
- Elephants (Elephas and Loxodonta).
- Game cocks and other fighting birds.
- Hippopotami (Hippopotamidae).
- Hyenas (Hyaenidae).
- Jaguars (Panthera onca).
- Leopards (Panthera pardus).
- Lions (Panthera leo).
- Lynxes (Lynx).
- Monkeys, old world (Cercopithecidae).
- Ostriches (Struthio).
- Poisonous insects.
- Pumas (Felis concolor), also known as cougars, mountain lions and panthers.
- Rhinoceroses (Rhinocero tidae).
- Sharks (class Chondrichthyes).
- Snow leopards (Panthera uncia).
- Tigers (Panthera tigris).
- Wolves (Canis lupus).
- Except in properly zoned districts, horses, mules, ponies, donkeys, cows, pigs, goats, sheep, roosters, chickens or any animal raised for fur-bearing purposes, unless otherwise permitted elsewhere in this Code.
- Exceptions; pet shops. The prohibitions of set forth in subsection (a) of this section shall not apply when the creatures are in the care, custody or control of a veterinarian for treatment; agricultural fairs; shows or projects of 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational institutions; zoological gardens, if:
- Their location conforms to the provisions of chapter 82 of this Code.
- All animals and animal quarters are kept in a clean and sanitary condition, and maintained so as to eliminate objectionable odors.
- Animals are maintained in quarters constructed so as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.

City of Green Lake
SEC. 7-1-12 – PROHIBITED AND PROTECTED ANIMALS, FOWL, REPTILES, AND INSECTS.
- Protected Animals.
- Possession and Sale of Protected Animals. It shall be unlawful for any person, firm or corporation to possess with intent to sell or offer for sale, or buy or attempt to buy, within the City any of the following animals, alive or dead, or any part or product thereof: all wild cats of the family felidae, polar bear (thalarctos maritimus), red wolf (canis niger), vicuna (vicugna vicugna), or alligator, caiman or crocodile of the order of crocodilia, gray or timber wolf (canis lupus), sea otter (enhydra lutris), Pacific ridley turtle lepidochelys olivacea), Atlantic green turtle (chelonia mydas), Mexican ridley turtle (lepidochelys kempi).
- Compliance with Federal Regulations. It shall be unlawful for any person, firm or corporation to buy, sell or offer for sale a native or foreign species or subspecies of mammal, bird, amphibian or reptile, or the dead body or parts thereof, which appears on the endangered species list designated by the United State Secretary of the Interior and published in the Code of Federal Regulations pursuant to the Endangered Species Act of 1969 (Public Law 135, 91st Congress).
- Regulating the Importation of Certain Birds. No person, firm or corporation shall import or cause to be imported into this City any part of the plumage, skin or dead body of any species of hawk, owl or eagle. This paragraph shall not be construed to forbid or restrict the importation or use of the plumage, skin, body or any part thereof legally collected for use by the American Indians for ceremonial purposes or in the preservation of their tribal customs and heritage.
- Exceptions. The provisions of Subsection (a) above shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a Scientific Collectors Permit issued by the Secretary of the Department of Natural Resources of the state, or to any person or organization licensed to present a circus.
- Wild Animals; Prohibition on Keeping. Except for state-licensed game farms, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the City any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.
- Apes: Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); ans siamangs (Symphalangus).
- Baboons (Papoi, Mandrillus).
- Bears (Ursidae).
- Bison (Bison).

- Crocodilians (Crocodilia), thirty (30) inches in length or more.

- Lions (Panthera leo).
- Lynxes (Lynx).

City of Markesan
§ 107-10 Certain animals prohibited; fowls regulated; poultry ranches.
- Animals.
- No person shall keep, feed or breed any swine, cattle, foxes, beavers, mink, otter, marten, fisher, raccoon, skunk, goat, horse, mule, ass, sheep, pheasant, poultry or bee in the City, except as herein provided and as provided in §107-21 of the City of Markesan Municipal Code. In the Agricultural Zoning District, swine, cattle, goats, horses, sheep, poultry or bees are permitted. In the event of the commercial raising of poultry for meat or eggs, a license, as provided in Subsection B below, shall be required and shall be zoned to permit such a use. Vietnamese potbellied pigs are permitted in one- and two-family residential housing units in other than the Agricultural Zoning District upon the issuance and maintenance of a license therefor under §107-11of this chapter. Notwithstanding the above, killer bees of the African or South American species may not be kept, fed or bred in the City under any circumstances.
- No person shall bring into, keep or maintain under their control, within the limits of the City, any wild animal or any animal which may endanger life or property. The word “animal” as used in this subsection is any living thing that is not human or a plant, and generally is capable of voluntary motion or sensation, and, the term “wild animal” includes, but is not limited to, all animals not indigenous to the North American Continent, and have a dangerous propensity.
- Any traveling circus or similar business having suitable structures or facilities for the safeguard of such animals as determined by the Police Chief are exempted from the provisions of this subsection. Also excepted from this subsection is any bona fide, accredited school having structures or facilities for the safekeeping of such animals, as deemed appropriate by the Chief of Police, or designee thereof, and offering protection to persons who may come in contact therewith, providing the head of the school or school system authorizes the keeping or maintaining of designated animals for educational purposes. Furthermore, also excepted from this subsection is an elderly community licensed as a “nursing home” as defined in W.S.A. § 50.01(3), having structures or facilities for the safekeeping of such animals, as deemed appropriate by the Chief of Police, or designee thereof, and offering protection to persons who may come in contact therewith, providing the head of the elderly community authorizes the keeping or maintaining of designated animals for therapeutic purposes.
- Fowl.
- Definitions. As used in this subsection, the following terms shall have the meaning indicated:
POULTRY RANCH – Any building, structure, enclosure or premises located in the City where 50 or more domestic fowl are kept or maintained for the primary purpose of producing domestic fowl, eggs or meat for hobby purposes, personal use or consumption, or commercial sale. - No person shall keep, feed, or harbor any chickens, turkeys, ducks, or geese unless the zoning district allows for such use or as provided in §107-21 of the City of Markesan Municipal Code.
- Application to operate a poultry ranch shall be made to the Clerk-Treasurer and, subject to the approval of the Common Council, shall be accompanied by a fee of $500. Such application shall state the location of the ranch, its size, approximate acreage and number of fowl maintained per day. The license term shall be the calendar year. No license shall be granted for any premises not in conformity with Chapter 400, Zoning, of the Code of the City of Markesan.
- Regulations.
- The licensee shall not knowingly permit any live fowl within 125 feet of the boundaries of the premises.
- The licensee shall maintain the premises in a sanitary condition such as to prevent obnoxious odors from escaping to any private or public property and such as to not jeopardize the public health, safety and welfare.
- The licensee shall permit the inspection of the premises by a designated City official, and shall obey any reasonable sanitation directive imposed by that official.
- Revocation of license. Upon recommendation of the Board of Zoning Appeals, the Common Council may revoke any license after a hearing has been afforded to the licensee.
- Definitions. As used in this subsection, the following terms shall have the meaning indicated:

§ 124-14 Prohibited and protected animals, fowl, reptiles and insects; farm animals.

The provisions of Subsections A and C shall not be deemed to prevent the lawful importation, possession, purchase or sale of any species by any public agency, institute of higher learning, persons holding federal permits, or by a person holding a scientific collectors permit issued by the Secretary of the Department of Natural Resources of the state, any party so authorized by the Common Council, or to any person or organization licensed to present a circus, except that such parties shall also have a conditional use permit issued by the Common Council.
- Wild animals; prohibition on keeping. It shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the City any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his/her possession or under his/her control within the City any of the following animals, reptiles or insects:
- All poisonous animals and reptiles including rear-fang snakes.
- Apes: chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); ans siamangs (Symphalangus).

- Their location conforms to the provisions of Chapter 430, Zoning, of the Code of the City of Princeton.
- All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
- Animals are maintained in quarters so constructed as to prevent their escape.
- No person lives or resides within 100 feet of the quarters in which the animals are kept.
- Farm animals; miniature pigs. Except as provided in § 124-23 regarding miniature pigs and on properties zoned in an agricultural classification, no person shall own, keep, harbor or board any cattle, horses, ponies, swine, goats, sheep, fowl (more than two including ostriches) or rabbits (more than two).

Ordinance 65: Relating to Prohibited and Protected Animals
- Protected animals.
- Possession and sale of protected animals. This Ordinance shall not apply where animals are in the care, custody, or control of a veterinarian for treatment; agricultural fairs; shows or projects of the 4-H Clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat shows or trials; public or private educational or medical institutions; a department of natural resources licensed animal rehabilitation facility; or licensed pet shops; provided that:
- All animals and animal quarters are kept in a clean and sanitary condition and so Maintained as to eliminate objectionable odors;
- Animals are maintained in quarters so constructed as to prevent their escape.
- Farm animals. Cows, horses, pigs, sheep, llamas, poultry and other farm animals shall not be kept within the Village limits unless approved by the Village Board. No animals, including rabbits, shall be kept if, in the opinion of the Village Board, they constitute a nuisance.
- Feral Cats. No person may feed a feral cat in the Village of Marquette unless the food is placed within a house with said house being occupied by an individual (s). This Section does not apply to humane society or animal shelter organizations that provide care to cats so long as the cats are fed within said shelter or society’s building.
- Any prohibited, protected or wild animal, listed in this ordinance, owned, possessed, harbored, kept, or maintained in violation of this section may be impounded and destroyed by the Village or its agents, at the expense of the violator.
- Any law enforcement, humane, or a public health officer, or a Village attorney shall have the authority to enforce the provisions of this ordinance including, but not limited to, seizing any animal that the officer reasonably believes is being possessed, harbored, owned, kept, or maintained in violation of this ordinance.

- Enforcement.
- The provisions of this article shall be enforced by the Village, the Green Lake County Sheriff, the Green Lake County Department of Public Health, and/or other persons authorized by the Village, County Sheriff or the Green Lake County Department of Public Health. This ordinance may be enforced by citation, injunction or civil forfeiture. The Village Attorney is also authorized to bring an action to enforce the provisions of this ordinance.
- The Village and its agents, the Green Lake County Sheriff and those designated by the Sheriff are authorized to catch and impound those animals at large in violation of this ordinance, with such authorization to include the pursuit of said animals upon non-animal-owner private property. It shall be a violation of this ordinance to interfere with the Village personnel, the law enforcement officer, public health officer or designee, trained individual or Green Lake County Sheriff’s office employee in the performance of their duties.
- Violations and penalties. Any person violating any provisions of this ordinance shall, upon conviction thereof, forfeit not less than $50 nor more than $1,000 together with all court costs and costs as indicated in this ordinance. If any violation be continuing, each day’s violation shall be deemed a separate violation.
